India not to criminalise marital rape

You know I am for women rights, but marital rape is a very difficult area. This combined with the lack of sexual knowledge or even heterosexual communication forget intimate communication is a huge huge problem.

Worst thing is for lot of women sex before marriage is taboo and to make the transition to an active sexual life is a big difficulty. On the flip side pron has screwed up the heads of the men, my uncles included. Tarzangiri doesn't help.

There is another issue of greyer areas like rough play and how do you distinguish it from rape. How do you prove rape especially if some time has passed? How do you prevent malicious use like 498a? How do you know it is rape if the forcing upon is only mental, with the physical part being gentle? If the woman loses interest halfway through the act, is the later part rape?

A lot of time intercourse happens without the willingness of the other person. How can a man prove he has been forced? Should that be considered marital rape as well?

There are of course cases of plain brutality, but does it need a new law? Don't the current laws protect against this. The greatest problem is in the implementing of the laws and the answer is to get better implementation.
