India must respect Vienna convention on Italy envoy's immunity says EU

The SC made a very valid observation - how can the diplomat claim relief (diplomatic immunity) under the Vienna convention after "voluntarily subjecting to court's jurisdiction"?

The SC has already embarrassed itself after being overtly generous to under-trials (Christmas break?!?! voting holidays?! WTF?!). It's time that the apex court works towards salvaging what little pride is left. A good start has been made.

India has a lot at stake here. The superpower reputation will not return once lost.

It is a lost cause for India.

It won't matter because if the ambassador gets away, then the pressure on the government to take stronger diplomatic action would grow. There is no way Italy will get away unscathed.

Does Vienna convention allow an envoy to file a false undertaking with highest court of the host country?:undecided:
Yes, all you can do is expel him and go after the real 'offender' the country behind him. But India only goes after the weak individual. Too afraid to go after a European powerhouse like Italy!

A Murderer killed one of your country men and flees in the name of diplomatic immunity, And this EU guy after allowing the murderer flee is asking the victim to withdraw in the name of a law which may not be applied for third world countries equally.

This won't go down well with Indian establishment and this will change the strategy of India,

The real intentions of west will be known with this incident which is very valuable for India to re calibrate its strategy in international arena.

It's getting interesting by the minute..EU jumps in, I say arrest all EU ambassadors as well :omghaha::omghaha:

I think India should accept Italian proposal and put the case to an international court. The EU seems to stand behind Italy.

The version is disputed: India vs Italy. I am not taking side of any.

That is no longer possible. Contempt has been shown to the Indian Supreme Court. That now has its own life & the GoI is bound by it. The pressure from people against this open deceit makes it impossible that the GoI will ever agree to any Italian proposal. Italy has pretty much kissed its relationship with India goodbye for the foreseeable future. Italian companies will pay the price and it won't be a small one.

Supreme court of India has decided that Italian ambassador will be responsible for all this mess.

Supreme court is not Kongress govt which will bow down to Italians (as they did with Bofors dalal)

As a matter of fact, a diplomat enjoys immunity (the Vienna Convention) and does not stand under host country jurisdiction.
So even if the Italian envoy lies, he does not violate Indian law.

Says it all.

India has every right to defend its position and at the same time Italy should take responsibility and should not behave like a misguided kid.

That is the wrong argument. It may turn out that the authorities in India were wrong. However that does not excuse deceit perpetrated at the highest levels by the government of Italy & its representatives in India. That is the only point that must be raised.

Even Vienna convention is not applied rightly.
