ICJ rejects India’s plea for acquittal, repatriation of Kulbhushan - Updates, News & Discussion

.
If ICJ asked for a retrial, consular access and stay in death sentence then our conditions are met. That's why your diplomats had a real facepalm on hearing the verdict.

Winning a case in international courts is not your forte.

ICJ put fate of KBY in pakistani hands

Like his fate was always in pakistani hands. But now we have seal from ICJ on it too.

Thanks Harish. You worked well.

For us

.
And? What’s that going to do...
Again, our aim is not to save Jadhav, it’s to prove the sham that is Pakistan judicial process and it’s claims of terrorism against India.

All this while, you had a trial with zero evidence made public, trial in military court with no able representation for KJ.
Now you have to show the world the evidence and then hang him.
But this time around, we will have full right to retaliate through our media, including having KJ say publicly that he was kidnapped, tortured and coerced into a confession.

Then you can hang him...once we have our narrative spread across the media.
Yo Peshwa ponka, so when are you getting on your knees boy and start begging Pakistan for a review dear?

You better start begging early and sincerely dear or we might not consider your begging as sincere boy!

. .
ICJ crafted such a decision where both parties can claim victory But situation at ground will remain same.

And the status quo is inevitably a Pakistani victory. Hilarious how Indian media and politicians are shamelessly trying to twist the verdict as some kind of Indian victory. Then again the Indian masses will be fooled again
ICJ put fate of KBY in pakistani habds

Like his fate was always in pakistani hands. But now we have seal from ICJ on it too.

Thanks Harish. You worked well.

For us

Hahaha astounded by Indian members here! Besharmi ki bhi koi hadd hoti hae :lol:

.

Harish Salve was paid only INR 1/- for this case and rest was paid by us, hence, huge expenses. Frankly, Major Harish did the job well.

.
you should take it to ICJ ....but dont expect support from the US

No need to. We are not crying babies like Indians.
Yeah we know we don't expect support from the US. US would be firmly behind the terrorist and killer Modi, no doubts.

.
I have to give it to the pakistani propaganda machine tho......the indians will have to learn from them ....
the pakistanis clearly have an edge when it comes to information warfare

.
I also said, quote a single spy trial case to prove per Indian prospective. In fact, we did a courtesy call, informed his direct handler and made it public as well. There can be no more service than this.... Now read as follows, quoted from Post# 712 in this page.

Apparently you didn’t, so that’s a lie.
Else ICJ wouldn’t be making that judgement in our favor.
I would hope you know that legal procedures are based in writing, not phone calls to “handlers”.
Clearly if that even happened, it’s inadmissable in court.

In March 2005, following the decisions of the International Court of Justice in the LaGrand case (2001) and Avenacase (2004), the United States withdrew from the Optional Protocol to the Convention concerning the Compulsory Settlement of Disputes, which confers the ICJ with compulsory jurisdiction over disputes arising under the Convention.

In 2006, the United States Supreme Court ruled that foreign nationals who were not notified of their right to consular notification and access after an arrest may not use the treaty violation to suppress evidence obtained in police interrogation or belatedly raise legal challenges after trial (Sanchez-Llamas v. Oregon). In 2008, the U.S. Supreme Court further ruled that the decision of the ICJ directing the United States to give "review and reconsideration" to the cases of 51 Mexican convicts on death row was not a binding domestic law and therefore could not be used to overcome state procedural default rules that barred further post-conviction challenges (Medellín v. Texas).

Edit: KJ family came to meet through proper channel and India says was not informed
.

Was this case above referring to spies or drug cartel criminals?
Also, I don’t have knowledge on the inter governmental policy between US and mexico on handling such cases.
I believe they have a mechanism to deal with this which might be superceeding the ICJ. I’ll save my comment until I read more about this case before I provide my thoughts.

behind "strategic allies" ...trust me....

once the afghan peace process is done.... it will be pay back :)

.
slowly slowly they r waking up to the reality......

But still a lot would continue to call it a major victory just like that imaginary f16 they shot down or those 300 terrorists they killed at balakot which nobody else in the world can see. Delusional ignorant nation afelter all

And i don't mind it honestly speaking. I hope India would get many more similar "victories" in the future too. :D
