He can.... Since his punishment is for more then 3 years i.e 5 years the trial court can not grant him bail, so for bail he has to now approach High court... Which he will do tomorrow...

He will get bail, may take a few days at the most but he will stay out till the verdict of the high court after which the same procedure will be followed for an appeal to the Supreme Court. 3-5 years possibly before an SC verdict.
