Hisba Bill, implementing Islam like a Punishment on Pakistanis

Hey PML-Q, PPP both walked out of the NWFP assembly wearing black bands in protest... PML-N instead sat in.

Mushy doesn't need to show anything about mullah pressures to anyone in Pakistan. The world is pretty much convinced, he now needs to show how is anti-Mullah policies are working to gain western favors.

So once again don't bring this on Musharraf.

Maulvi’s martial law

PESHAWAR, Nov 13: The NWFP assembly on Monday passed a watered-down version of the controversial Hasba bill to establish what critics described as a Taliban-style department under a powerful cleric entrusted with the task of enforcing Islamic morality.

The bill found surprise support from a few opposition legislators – some belonging to so-called liberal parties – when they voted for the bill against the instructions of their parliamentary leaders.

The bill is a revised version of one that was ruled unconstitutional in 2005 by the Supreme Court, following a challenge by President Pervez Musharraf under Article 186 of the 1973 Constitution.

The bill provides for the appointment of an anti-vice ombudsman enjoying sweeping powers to protect Islamic values and “forbid persons, agencies and authorities working under the administrative control of the government to act against Shariah”.

The bill was bitterly opposed by the Awami National Party, Pakistan People's Party (Sherpao), Pakistan People's Party Parliamentarians and Pakistan Muslim League, whose one member did not toe the party line and supported the bill.

The provincial Law and Parliamentary Affairs Minister, Malik Zafar Azam, who tabled the bill in the 124-member house, rejected the opposition’s demand that the bill should be sent to a select committee.

He recalled at length how the bill was first tabled in Dec 2003 and how its passage was subsequently delayed by the government – first by successive provincial governors and then by a presidential reference in the country’s apex court.

When protesting opposition lawmakers, wearing black armbands, described the bill as “maulvi’s martial law”, Mr Azam said: "We never wanted Talibanisation, neither in the past nor now or in future. The aim is to provide speedy justice to people."

Unconvinced, lawmakers from secular opposition parties staged a walkout as the treasury legislators adopted the bill with a majority.

The Leader of Opposition in the assembly, Shahzada Gistasip, said there was no need to pass a bill that had already been found to be repugnant to the existing laws by the Supreme Court.

NWFP Chief Minister Akram Khan Durrani thanked legislators from the PML (N), PML, Tehreek-i-Insaf, Swabi Qaumi Mohaz and independent groups for supporting the bill. He assured the opposition legislators that the bill would be used only to provide speedy justice to the masses.

Under Article 116 of the 1973 constitution, the bill will now go to Governor Ali Mohammad Jan Aurakzai for assent. His predecessors, Iftikhar Hussain Shah and Khalil-ur-Rahman, refused to sign the bill into law.

Interesting view from Asma Jehangir. The Mullahs will now be enabled to thrust a thugocracy on NWFP. They'd ensure by force, propaganda and intimidation that the 2007 elections turn out in their favor.

PESHAWAR: The Human Rights Commission of Pakistan (HRCP) has said that by passing the Hasba Bill the MMA government has put in place a powerful network that will play a crucial role in winning all future elections for the religious partiesí alliance.

In a statement issued here on Tuesday, HRCP Chairperson Asma Jehangir said the bill has nothing to do with Islam. “HRCP believes that it in fact amounts to a clever manoeuvring to create grass-roots level networks of Mullahs that would have serious repercussions on the future political scenario of NWFP. The network of Mohtasibs (ombudsmen) to be set up from Tehsil to provincial level will create a strong foundation upon which the MMA can confidently base its future political success,” she added.

The HRCP demanded that the powers of ìthe network of Mullahsî be curtailed if they infringed on the basic rights of women.

It also warned the NWFP bureaucracy that the meddlesome Mohtasibs, under the powers available to them, could cause considerable harassment and as such would be “a source of pressure”.

She said that the MMA has through the law tightened its grip over power strings in the NWFP.

This bill literally takes away ones freedom in our country and ought to be rejected and opposed in every manner. I favour prayer and every religous duty but this bill is insane in the worst manner.

Pakistan Govt could challenge Taliban-style NWFP Bill in court

Islamabad, Nov 14: Pakistan Government could challenge in Supreme Court a controversial Bill passed by the North West Frontier Province Assembly to impose Taliban-style religious rules.

"We are studying this Hasba Bill in detail in light of the previous verdict of the Supreme Court. We will see if the shortcomings pointed out in the verdict have been fulfilled. We will also study its impacts on the public. All our options are open," Pakistan's Information Minister Muhammad Ali Durrani was quoted as saying by a daily here.

He condemned the Muthaida Majlis-e-Amal for passing the bill saying the ruling Islamic alliance in NWFP wants to distribute Rs 8 billion in taxpayers' money among its own workers and leaders.

"It (the bill) has nothing to do with Islam," he was quoted as saying by Daily Times yesterday.


The Bill was first passed in July last year but the same year in August, it was rejected by the Supreme Court which termed its various clauses as unconstitutional and illegal.

The court had asked the provincial governor not to sign the Bill into law after which the MMA abandoned it.

MMA said it tailored the new bill removing objections raised by the Supreme Court. It brought it back again apparently to queer the pitch before the next year's general elections as well as to counter federal government's move to bring about a new Bill, Protection of Rights of Women, in Parliament to modify the religious laws introduced by former military ruler Zia-ul Haq.

1. On orders of the Supreme Court the governor still CAN reject it again.
2. The implementation of morality would mean providing salaries worth 8 billion rupees to mere Party workers. Money WILL be eaten up!
3. The Hisba bill attacks the amendment of the Hudood Ordinance, the protection of women when they are raped, and it will justify jailing the raped women.

Are we going to allow this in Pakistna?

I think that Islamic ummah has bigger problems right now, we need to focus on bigger picture then to be running after some Hisba bill.
Do these MMA leaders ever do anything constructive? Like opening more schools [ Education is important in Islam]. Or maybe like opening up orphanages that take care of children. How about selling 3 cars and donating Money to poor and needy people like companions of Prophet (SAW) used to do?

It's a miracle what people will do with Islam. Now its against the law to not observe your prayers or even sell food to somebody during a prayer.

The Quran I read stated in Surah Baqarah "There is no compulsion in religion". Why compel Pakistanis to these religious things then? What next? Forcible head-shaving of guys with stylish long hair? No congregation of men and women in Public? Women should wear headscarf? Women can't drive, women can't vote? Women can't work?

For the love of God, respect the wisdom of the founder of the nation if you don't want to respect the freedoms originally granted to Muslims within the Quran. I bow my Pakistani head in shame today, for we are allowing criminals to hijack our faith and abuse the freedoms of our fellow Pakistanis of NWFP.
