Yes, the latter case was about 40 year old Jinna and 14 year old Ruttie Petit.

I don't even want to get into what a 40 year old man was doing with a 14 year old girl for two years till she turned 16 and they broke the "story" to her unsuspecting father.

And then a further two years till she turned 18 and legally became old enough to marry.

As I said, I have never made any argument on legalities.

Only basic decency and propriety.

Me saying what I really think would get me banned. It's not worth the effort. I just brought up the point along with another incident close to home to ask you guys why these age disparities do not form a part of your community conscious?

Two consensual adults in India can enter into a relationship. I've never heard anything about this teacher-student thing.

The law says that anyone in a ‘position of trust’ cannot have any sexual contact with a person in their care, even when they are over the age of consent at 16. The reason for this is that the adult is in a position of responsibility and they are there to look out for the best interests of the young person in their care. Someone in a position of trust is classed as a teacher or someone whose job it is to look after you, so if you were in hospital, or in residential care, the people looking after you would also be breaking the law if they were to have a sexual relationship with you. This means that any sexual activity with someone under 18 is actually illegal, which includes any intimate touching, even kissing, as well as all sexual intercourse between both males and females.

It is important to remember that the person over the age of 18 is the one who is breaking the law, and the person receiving the care, such as the student, and are therefore deemed to be innocent. No matter what part they have played in the relationship, even if they want the relationship, and have taken active steps to encourage it where no charges will be brought against them.

Even when both people are over 18, many jobs where someone provides care or a service for someone else, have rules in place which make it against their policy to engage in a sexual relationship. If the worker ignores this rule, it can mean they can lose their job because the relationship is seen as inappropriate, and therefore goes against the company policies and procedures, which are there to protect the people who are being provided a service or being cared for.

Which law are you speaking about? Indian? Or in generalities?

Secondly, do you know how old the girl was? I could not find that in the article.

I repeat. I know of no Indian law that says a teacher and his/her student cannot have a relationship (including sex) should they both desire it.

There can be no criminal prosecution by the state.

Maybe the institution and it's private rules might not allow such. In which case the teacher might be removed. And the student too in many cases.

But jail no. Not unless you actually show me something specific in the Indian Penal Code.

Yes an adult should be put in jail for being in a relationship with a consenting adult.

But maulvis who have underage wives should have a free run

This "Teacher cannot romance a student" idea is modern Western morality one, more inspired by feminism than anything good.

Agree strongly.

I've seen it too many times up close to be delusional or hypocritically moralistic about it.

As long as both are adults and there is no coercion or implied influence/reprisal angle involved.
