If you can put aside your worse than toilet brain and think for some time than you will realize that law should decide the punishment and not the family of victim. The lady attacked the man to save herself from rape. Court leave the punishment to the family of victim. This is hilarious.
for the first and LAST time I want to explain the logic behind Islamic law of QISAS... I hope you be enough scientific, rational and no blind to decide if it is JUSTICE or new versions of law regarding killing others...
Let,s suppose you have lent 1000 rupees to a friend... after a while he refuses to get your LOAN back... what you expect in front? you expect him to pay you at least the SAME AMOUNT of money you lent him in first place (based on Islamic Economy) or the original AMOUNT + interest based on capitalism and yehowas doctrine... IF he pay you 999 rupees you will say and claim that it is in now way, JUSTICE...
so Justice as acknowledged by any system or religion is to have what ever you lost in PAR to PAR basis.
Now, somebody comes and OUT OF PURPOSE kills you... In this case, you are the RIGHT HOLDER to ask for compensation...but you are already DEAD..let,s see.. After you , who has the most close right to claim you... You are of Spiritual, existential and monetary value to your family... Family is who enjoyed the most out of your existence....Who, has the closest bonds to YOU, of course your parents that suffered tens of years to make you whatever you are now... Government has also spent a lot for you to be whatever you are now..so Gov has also a right to claim your loss...But as the RULE is THE MOST CLOSEST PERSONS to you,.,then gov only comes claiming only when you have no parents or family...
Ok, somebody kills you on purpose...he made you loose whatever you have... from spiritual benefits up to the material benefits... you made his beneficiaries to LOOSE , their beloved probably feeder of family...
Let,s be honest.... Islam says..eye for eye... hand for hand... this si the absolute JUSTICE ever can any system bring ... We have the same rules when somebody pours ACID on a girl's face... Islam says..don,t kill the guy... it is not fair..only pour acid on his face..this is closest to fair..although still the GIRL has lost more than the guy as Girls face is all they own when it comes to marrying....
So, killing the murdurer is the most fair and justice one can ask for the loss they suffered...
now, how the judging system should perform this FAIR, EQUAL punishment..it is pretty sensitive issue so it must not be held in hands of rulers to decide what is the most fair WAY of killing one person.. In Shia FIQH... Islam says... you can,t let this to be all individual based...so they made it all in a uniformed procedure... although, Imams have the right to stop one way or keep one recommended way... exactly as it is now in Iran that judges don,t order the Stoning anymore (although it is something common in both jews and chritians too but they are not practicing Jews or Christians..so why expect more!! did u know even COVERING Women s HAIR and BODY is a basic religious rule in Christianity?? )
The interesting point about execution of a murderer is that in Shia Islam, Islam says, after execution of a murdurer, the executed person will be as pure as baby when it comes to judging him in other world... as he is free of the murdering accusations...becoz he already paid the EQUAL to its right owners
I had a friend one in Europe, he used to tell me that he HATES his boss who is a jewish woman...she is not fair and suffers him a lot... he once said in a serious tone that he might eventualy kill her..and then take 15 years in jail... he said, it is nothing and worth it comparing to the joy of getting rid of that lady... so how dangerous it is???
some in Iran saying, killing the murderers or mass scale drug producers or traffickers if not the solution and won,t change a thing.. there will new murderers tomorrow!! I should say to this friends..that You can't ignore the justice just becoz others might not afraid of the consequence and commit murdering again!!... what a baseless claim!!
so, to my eyes, every deed should have a FAIR and EQUAL consequence... you can,t execute a small thief by hanging...coz it has no proportional dimension... it is not fair becoz it is not equal.... so, I see this hanging murdurers as fair as when I expect somebody who crashed my car to the wall to compensate the EXACT amount of loss I have had.
There are some cultural aspects in each and every religion and I might personally don,t even like some of the rules...but what I must acceot is that as long as it is a fair and equal punishment and for all members of society.. I have no choise but to accept it...

RIGHT comes out of FAIR and EQUALITY and not out of giving a 15 year prison to one who made someone and his family lose everything..it is not fair...They see and focus on punishment but never ask about if those people who lost their beloved ask only for an EQUAL math...
