Inciting violence is not protected by hate speech. more over, Indian freedom of speech is not as absolute as the western ones, for the right reasons.
India's freedon of speech right is not absolute. This is the section Varun Gandhi was booked and was taken into custody. The MLA should be dealth with under this code as well.
Section 505(2) in The Indian Penal Code, 1860
(2) 2[ Statements creating or promoting enmity, hatred or ill- will between classes.-- Whoever makes, publishes or circulates any statement or report containing rumour or alarming news with intent to create or promote, or which is likely to create or promote, on grounds of religion, race, place of birth, residence, language, caste or community or any other ground whatsoever, feelings of enmity, hatred or ill- will between different religious, racial, language or regional groups or castes or communities, shall be punished with imprisonment which may extend to three years, or with fine, or with both.
Of course, you are both right. I was just referring to some inane posts made by certain members here on the forum. And although the MLA's hate speech can be 'defended' under Freedom of Speech rights, under the IPC, instigating violence or insulting 'religious feelings' of any people is an offence, as you both rightly pointed out.
Sometimes I wonder whether people so strongly influenced by religion, those that go to any extent and condone abuse of people following other faiths, should ever enjoy certain freedoms - including freedom of speech?
