LAHORE - Chief Justice Lahore High Court Khawaja Muhammad Sharif on Tuesday took Suo Moto notice of inordinate delay in PIA flights and summoned the Director General Civil Aviation Authority, Karachi, Airport Manager, CAA, Lahore and Managing Director, PIA, Capt (r) Ijaz Haroon for July 9.

The CJ also sought the assistance of Deputy Attorney General and Advocate General, Punjab.

The CJ observed that the most pathetic thing is that the passengers are never informed about the reason for delay. During the period of last one month, I had the opportunity to travel by PIA but all the six times, the plane neither took off at the stipulated time nor reached at its destination on its arrival time.

It is observed that the court time is a public time and cannot be allowed to waste just because of lethargic attitude of the State functionaries as the corporate bodies who are paid from public exchequer.

The Chief Justice further observed that it is a matter of great concern that the slogan of Pakistan International Airlines “Great people fly with PIA” has become “Great people to cry with PIA”.

Further narrating his story Chief Justice said, to attend the meeting of National Judicial Policy Making Committee at Islamabad, I got my seat booked in the flight, which was to leave Lahore at 8:30 pm on May 14, but it was late for 90 minutes.

My return to Lahore was on PK-687 on May 17 with departure time as 6:30 pm but it was also late for 25 minutes, the Chief Justice added.

Again to attend the same meeting, I was to reach Islamabad at 9:00 am. Accordingly, I got my seat booked in the flight, which was to reach Islamabad at 08:50 am on June 6 but to my misfortune, the plane reached Islamabad at 10:30 am.

ISLAMABAD - Consequent upon interim order of the Supreme Court of Pakistan, the government on Tuesday revised the prices of petroleum products downward deducting carbon tax out of it.
As directed by the Supreme Court, the Oil and Gas Regulatory Authority late Tuesday night issued a notification to be effective from July 8 (today). According to the latest notification, the price of premium motor gasoline went down from Rs 62.13 to Rs 50.58 by Rs 11.55 per litre or 18.59 per cent. Similarly, the HOBC went down by 16.24 from Rs 78.78 to 62.54 with a decrease of almost 21 per cent. Kerosene oil having least amount of the carbon tax at the rate of Rs 6 per litre had the least advantage as compared to other products. Kerosene was slashed by Rs 6.36 from Rs 59.35 to Rs 52.99 per litre. Although, the diesel was not part of the OGRA notification, the officials said its price has also gone down by roughly Rs 9 per litre.
According to notification of the OGRA dated June 30, 2009, the carbon tax was imposed at premium motor gasoline @ Rs 10 per litre, Rs 8 per litre on diesel, and Rs 6 per litre on Kerosene. Since the apex court has suspended the imposition of the carbon tax till the final judgment in this case, the government was bound to withdraw carbon tax immediately, an official said.
The government was in a fix after the interim order of the court as it had already abolished petroleum development levy, the predecessor of the carbon tax. According to the official who requested anonymity, there was a panic situation in the Ministry of Petroleum and Natural Resources after the interim order as the Advisor to Prime Minister on Finance Shaukat Tarin and Finance Secretary were abroad to attend IMF meeting in Turkey. Since it is the issue of taxation, the Finance Ministry was supposed to find a way out.
According to the official, this immediate implementation of the court’s interim order would definitely provide relief to the public but would also pile up the price differential claim of the Oil Marketing Companies (OMCs).
The official said that the government was determined to fight the case of carbon tax in the apex court. He said that the government was having no fiscal space to pay the price differential claim to the OMCs. He also pointed out that the carbon tax was to generate Rs 122 billion or more depending upon the volume of sale during the year. The official however admitted that the petroleum products were being subjected to double taxation as the General Sales Tax was being levied after including the carbon tax in the taxable sale price.

well i don't mind who is the CJ and don't care about the lawyers movement but one thing is confirmed....... Judiciary is the most corrupt organisation in Pakistan

and why is he taking suo moto for every single thing, This should be the job of the Government and not the Judiciary, CJ should bring improvements in the Rule of Law and not become the Politician or over-ruling the decisions of the parliaments.

Focus on Judiciary and bring postive changings to provide security to the common peoples of Pakistan rather than decreasing the prices of the petrol or revoking other decisions. Try to make the Judiciary stronger instead of decreasing the prices of products

Well, i think that "if 'they' dont do it, 'someone' has to do it for them," is somewhat acceptable, but at the same time suo motos should also be taken on the 1000s of pending cases which are hanging in abeyance for decades!!

we are already payin tax on petrol. y add a second tax with a different name. y dont they go and tax those are not payin any??? glad action has been taken against carbon tax. atleast ppl will get some relief though of only few days

Spokesperson to the President former Senator Farhatullah Babar Thursday said issuing of presidential ordinance to impose petroleum development levy on petroleum products “shows respect to the independence of judiciary by upholding its verdicts.” Talking to newsmen after hearing in the Supreme Court in the case today, he said the ordinance achieved two objectives, “To show respect to the independence of judiciary by upholding its verdicts and to demonstrate that law making is to be done in accordance with the Constitution and that Parliament is supreme.” He said the apex court had opined that the levy of 120 billion rupees under the name of Carbon tax appeared questionable and pending a decision on it had stayed the levy. The government accepted the interim order of the court with an open heart. It issued an Ordinance levying petroleum development levy (PDL), as allowed under the Constitution and there is no contradiction between the two, he added. The spokesman mentioned that the President has not suspended the Carbon tax but it was already suspended by the court verdict. “It is not important at what time the Ordinance was issued. What is impartant is whether the issuance of Ordinance was within the ambit of the Constitution and the law,” he said. “Levy of PDL is a difficult political decision but at the same time critical for long term economic viability. Those who wish to challenge the Ordiance, may do so. There is complete freedom to everyone and the judiciary is free and independent.”

PoL prices hiked through president ordinance - GEO.tv

ISLAMABAD: The petroleum product prices have been inflated again through president ordinance as the Petroleum Development Levy has been imposed on petroleum products with immediate effect, Geo news said early on Thursday.

Now, Rs.10 on petrol and Rs.8 have been raised on diesel.

The ordinance has been named as Petroleum Development Levy Ordinance 2009 which president signed early in the morning.

The president signed the written advice from Prime Minister to raise petroleum prices through president ordinance while their copies have been sent to Ministry of Petroleum and Oil and Gas Regulatory Authority (OGRA).

It is pertinent to mention that Supreme Court (SC) suspended the carbon tax surcharge on petroleum products through its ruling on Tuesday.


Moving on from that thousands of people will benefit if PIA is beasted by the courts.

ISLAMABAD: The Petroleum Development Levy Ordinance 2009 has been challenged in Supreme Court.

Chaudhry Ikram, the lawyer of PML-N secretary general Iqbal Zafar Jaghra has field a petition challenging the presidential ordinance stated that president have no right to impose tax under constitution article number 77.

A separate petition also filed pleading Supreme Court to issue stay order for the withdrawal of POL price hike to give masses interim relief.

According to Geo News correspondent Abdul Qayyum, the hearing of petition will likely started from Monday.

The president had signed the advice from Prime Minister to raise petroleum prices through president ordinance that restored the POL prices to July 7 position.
