How will this help when our system isn't remotely competent enough to catch, prosecute, and convict them? This does not feel more than a gimmick.

Dear members,

With due respect, I do not agree with your assertion on this topic of rape.

These offenders were groomed in our society. They must have been exposed to some harsh and unjust realities of life.

But offenders are offenders. They cannot be left unpunished.

We must also realize that we are not barbarians or pugilist society. We belong to Muslim nation - a nation who believes in Allah and seeks Allah's divine guidance, blessings and pleasure.

Allah is most merciful...

Islamic society must follow the Islamic laws as these laws ensure betterment of Islamic society. Some punishment look very harsh such as stoning to death for married offenders of Zina. but actually these punishments help in decreasing such crimes. Lesser crimes means lesser chaos, and hence a peaceful society.

Zina offence done willingly by married men and women, is the most cruel act in our society. The result of this act if exposed to the family, it may result in multiple murders. This heinous act may create chaos, therefore, the punishment of stoning to death is given to such offenders. This is the only punishment when public is allowed to carry out the punishment by throwing stones, till the offenders die.

Zina offence done willingly by unmarried men and women are punished by flogging in presence of public.

Rape (forced penetration) and molestation offenders are also punished by flogging in presence of public.

Instead of listening these so called incompetent human rights organizations, it is a better option to implement the punishments IAW Islamic Sharia in presence of public. The event of punishing offenders though look cruel must be exposed in every nook and corner of the country so that individuals before committing any offense may think million times. Fear of punishment is necessary to minimize or eliminate crimes from the society.

A simple innocent question for you since you sound pretty educated in Islamic teachings.

What are the requirements in Sharia to prove guilt of rape?

he mentioned both, first he mentioned chemical castration which is being implemented also in many countries and then he talked about surgical one, although it seems like focus was much on the later...
If it comes to pass..i think the chemical one would be the one..since the liberal brigade mafia will see surgical as too "inhumane" or "painful" or whatever..

First of all I did not claim or stated that I did my education in Islamic fiqh or Islamic laws.

This is a specialist field and various Islamic scholars are dedicated to it and teach Islamic Laws to their students.

Furthermore, various Islamic sects have some differences in understanding of Islamic Laws.

However, the answer to your question lies in Surah Yousuf (12) - a woman tries to molest a man - hardest problem to prove woman's act of molestation.

Further discussion require complete definition of zina.

ISLAMABAD: Pakistan Tehreek e Insaf (PTI) government decided on Monday that it will bring to parliament a bill to penalize sex offenders; rapists with castration, ARY News reported, citing sources.

Prime Minister Imran Khan has approved of the legislation, to castrate rapists once proven guilty, and the government bodies will now introduce it to the parliament soon, the sources have confirmed.

Water Resources Federal Minister Faisal Vawda is delegated with the task of furnishing the draft bill which proposes neutering of sex offenders, sources told ARY News.
Vawda said that after the castration bill, his government will also table a bill for the hanging of such criminals. “If the hanging bill is not approved, we will get the castration bill approved, at least,” Vawda claimed.

If human rights champions do not hinder the legislation, we will get the death penalty bill for sex offenders approved.

Earlier Vawda tweeted that after meeting the parents of Marwah, a minor girl who fell victim of sex offenders last week and was found dead and dumped in Essa Nagri area of Karachi, he will even “kneel down if must, to get the legislation approved for castration.” He stressed that his “ego does not supersede the daughters of this nation”.

Senator Faisal Javed of PTI took to twitter as well, following Vawda’s bid to legalize the penalty of castration and/or hanging for sex offenders and rapists. He said severe punishments must be introduced for deterrence of such crimes. He, too, confirmed that the PTI government has embarked on this legislation and will soon table the bill in the National Assembly.

He said that the PM is now onboard for these proposals and the government will soon legislate in favour of “harsher” sentences for the heinous crimes.

let me tell you, there are 2 requirements to prove Zina as per Sharia

1. You need 4 eyewitnesses who are Muslims and are of good moral standing.
2. The committer of Zina confesses his crime

If we go by this Sharia law, all rapist are gona go free, because where are you going to bring 4 eye-witnesses and how will you prove the moral standing of those witnesses if there were any. Also 99% of these rapists will never confess their crimes.

There is also another dilemma. Now in this particular case, its been reported that someone actually told these guys about this woman stuck on the side of the road. Does that guy or guys also deserve any punishment as they are ones that actually caused this issue in the first place?

So what do i think, personally i would like to see all rapist including pedophiles that groom children to have consensual Zina be hanged publicly and then their bodies burnt and their ashes spread in Thar desert. Also ban their namaz-e-janaza so they suffer even till the day of judgement.

Punishment and proof of committing a crime are two different legal terms.

The conditions you mentioned earlier if met than proof of committing zina is very obvious.

Witnesses can also verify whether the intercourse was with consent of two partners in crime or one was forcing the other.

In absence of these two conditions it will be very difficult for the judge to determine innocence and guilt.

However, modern forensic methods may help to investigate the proof of the crime.

A thorough investigation may reveal the truth.

The second part is punishment.

Punishment to the offenders are given in presence of public, so that others should take lesson from it.

Sharia clearly spells out what punishment be given to the offender. Severity of punishment is always depends on type of crime.

The most serious crime in Zina category, is married man and married women committing zina. The punishment for which is public stoning till death.

Members of our society gets very emotional when we hear about such crime. Public must not take law in to their hands. At times an innocent person may loose life just because of malicious lie. A thorough investigation must be carried out before determining whether the person is guilty or innocent.

Justice should not be delayed but thorough investigation is very important.

We are humans not animals. Killing, beating and inflicting pain to another human without ensuring whether the person is guilty or otherwise is unacceptable.
