Get to the bottom of birthday rape case

There is no excuse for this hesitance on part of the authorities -- the case should have been accepted immediately
Certainly, we are not prejudging the guilt or innocence of the four men accused in the birthday rape case.

That is the solemn responsibility of the law courts.

It is, however, unacceptable that 48 hours after the case against four men was filed, the police were yet to make any arrests.

There have also been disturbing reports of the victims being threatened in order to get them to withdraw the case.

Indeed, it says something about our law enforcement system that the police were reluctant to even take the case initially.

There is no excuse for this hesitance on part of the authorities — the case should have been accepted immediately.

Charges should be brought forth, and a rigorous and thorough investigation needs to be conducted.

There is no other way to go about this — we need to get to the bottom of what happened.

The allegations brought forth are of the most severe nature, and need to be treated with the utmost gravity.

There should also be an investigation into the claims of intimidation and threats being made against the victims to deter them from pushing ahead with the case.

A culture of fear and shame has been fostered in Bangladesh where victims are afraid to open up about incidences of rape.

For that reason, rape and assault continue to be woefully underreported in this country.

As such, the two victims deserve praise for coming forward and reporting the incident.

Many times in the past, we have seen rapists get away, in spite of overwhelming evidence at hand, because of misogynistic attitudes prevalent among law enforcement.

It is time to be united in our condemnation of this despicable crime, and demand the perpetrators are brought to book without further delay.

Rape accused and passport missing from Gulshan home

The rape accused have been missing since the case was filed with the police.

Police on Tuesday noon raided the residence of Shafat Ahmed, who stands accused of raping two university students.

Police did not find Shafat at home. They searched the house for him and his passport from 11:30am to 12:55pm.

The home, belonging to Shafat’s father Dildar Ahmed – owner of Apan Jewelers – also could not produce Shafat’s passport.

Banani police Sub-Inspector Milton Dutta said the police will continue looking for him elsewhere.

Two private university students have reportedly been raped during a birthday celebration at a hotel in Dhaka.
The victims of this incident are two private university students who have claimed that police are not cooperating with them in arresting the two alleged youths who raped them at a hotel in March.

The students brought the allegation, claiming police have remained non co-operational as the perpetrators belong to influential families.

According to the students, they were invited to a birthday of a friend, the son of a prominent businessman, at the Rain Tree Hotel in Banani on March 28.

After the party ended at midnight, the victim alleged she had been raped by him, and that her friend had been raped by his friend, the son of another prominent businessman, in separate rooms at the hotel overnight.

The perpetrators also allegedly threatened them to not speak to police.

The victims claim they were also harassed and threatened with the release of video footage on social media.

The DMP’s Gulshan crime division additional deputy commissioner Abdul Ahad and the Women Support and Investigation Division official visited the hotel Saturday.

Rain Tree hotel general manager Frank Forget confirmed that both the alleged perpetrators booked two rooms on March 28 and stayed the night.

According to the manager, they interviewed 14 staff members to check what happened on the night, but none of them heard any screaming or found anything suspicious about the room later.

“None of the girls made any complaint at that time,” said Frank Forget. He also said the hotel authorities do not keep video footage for more than a month.

Banani police station Inspector (investigation) Md Abdul Matin said the rape allegations were brought by the female students in the presence of a former wife of one of the alleged rapists on May 5.

Inspector Matin said the girls accused two men of rape and three others for assisting the perpetrators in committing the crime.

Police had interrogated the hotel staff but had not talked to the accused the girls had mentioned, he added.

Dr Shohel Mahmud of Dhaka Medical College Hospital said a five-member committee has been formed to perform forensic tests and confirm the incident.

Women Support and Investigation Division Additional Deputy Commissioner Asma Siddika Mili said the two victims were sent to DMCH for medical tests.

DMP Deputy Commissioner (Media) Masudur Rahman said police are yet to arrest the two accused.

The Bangla Tribune secured an interview with Dildar Ahmed, owner of Apan Jewellers and father of Shafat Ahmed, the prime accused in a rape case.

On May 6, two young women filed a case with Banani police against Shafat Ahmed, Nayeem Ashraf, Shadman Sakif, and Billal for allegedly raping them on March 28 at The Raintree Dhaka Hotel in Banani after a birthday party.

The interview was taken when the police was searching his house on Tuesday morning.

Dildar said he had last seen his son Shafat on Monday morning. He also claimed to have not heard from him since.

He also said he would have handed Shafat to the police had he known how serious the matter would become.

When asked why he now regrets not turning in his son to the police, a change in tone since Dildar earlier said there was no evidence to suggest rape, he said the medical tests would determine any guilt or innocence.

The Bangla Tribune asked Dildar if he used his wealth to influence the investigation, which he denied vehemently.

When pressed that a rumour is about of him paying Tk 25 lakh to Banani police to not press charges, Dildar said the matter is part of state affairs, and could not be diverted even with Tk 25 crore.

To end the interview, Dildar said he made a mistake not handing his son over to the police.

He said: “If I had known the legal procedure, I would have given him over to the police before he escaped.”

I can show you girls here in Uttara, you will not dare to talk to them seeing them from outside. Some studies English, Some fashion design, some BBA etc. They dress and having a lifestyle far ahead of their peers in the universities. They have friends in high places. Hotels bars and clubs are in their finger tips. But they never attend the universities neither have a certificate for SSC exam. Some of them have kids back home in the villages. Some have drug addict husbands and so on.
I dont think a regular student from a decent family will go to a private party in a hotel late at night, that again for a invitation of a stranger under the supervision of a pimp. I dont mind people having fun and have party among friends which is perfectly alright. But in this particular case is nothing but prostitution.

In this case NO case taken by the police. Within 20 minutes police got 25 lack taka. And rapist got free from the criminal act. What media highlighted there they didn't mentioned one Awami leaders name.

Although five days have passed since two private university students made a formal complaint to police regarding their alleged rape at a birthday party on March 28, police have yet to make any arrests.

When questioned, police claimed they had been successful in identifying the accused, but were not forthcoming with details.

On May 6, the two young women filed a case with Banani police against Shafaat Ahmed, 26, Nayeem Ashraf, 30, Sadman Sakif, 24, and Billal, 26, for allegedly raping them on March 28 at Raintree Hotel in Banani after a birthday party.

Shafaat’s ex-wife, who is cousin to one of the victims, was also present when the case was being filed.

The Dhaka Tribune has since been able to ascertain that Shafaat Ahmed is the son of Dildar Ahmed, one of the owners of Apan Jewellers; Nayeem Ashraf is the managing director of eMakers Bangladesh; and Shadman Sakif is one of the directors of Regnum Group.

According to the two women, police are sure of the identities and whereabouts of all of the accused but have not arrested them because they are from influential families.

The two remain afraid for their safety, claiming that their alleged rapists have repeatedly threatened them over the phone to withdraw their case.

NHRC takes birthday rape case into own hands

The National Human Rights Commission (NHRC) hit out on Monday at the delay in the police investigation into the alleged rape of two university students at a birthday party in Dhaka six weeks ago, and formed a five-member committee to probe the claims itself.

Two university students filed a case with Banani police station on May 6 accusing four youths of raping them at the Raintree Hotel in the capital on March 28.

According to the case statement, Shafaat Ahmed, the 26-year-old son of one of the owners of Apan Jewellers, and his friend Nayeem Ashraf, 30, allegedly raped the two girls while Shafat’s bodyguard, Sadman Sakif, 24, held them at gunpoint and his driver Billal, 26, recorded the incident on his phone.

“The police delayed in taking the necessary actions against the perpetrators; they should be pro-active in arresting the accused,” NHRC Chief Kazi Reazul Hoque told the Dhaka Tribune. “Since that did not happen, we have been compelled to form the high profile probe committee.”

The committee, which includes three NHRC members, a director and an assistant director of the rights watchdog, has been tasked with investigating the incident and asked to submit their report within the next 15 days.

The Detective Branch (DB) is also currently looking into the birthday party rape case and has stated that the perpetrators will be brought under the law, “irrespective of how influential they are.”

On Monday, DB Deputy Commissioner (North) Sheikh Nazmul Alam said they were conducting a shadow investigation into the case and that the Banani police station was responsible for the regular investigation.

“If, in the course of our investigations, we find that the accused were involved in this matter, then they will be brought under the law,” he said.

When asked if the accused had fled the country, the DB officer said he was not sure but added that the law enforcers were looking for them.

On Sunday, the plaintiffs said they were afraid for their safety since the accused had repeatedly threatened them over the phone to withdraw the case.

Claim local hotelier, staff; NHRC boss blasts police for negligence

Police were yet to arrest any of the five accused in the Banani double rape case but an owner and employees of a hotel claimed they saw prime suspect Ahmed Shafat in Sylhet city on Monday.

“Five youths came to our hotel and looked for a room around 2:00pm. But we didn't give them that as they refused to show us their national ID cards,” Mobarak Hossain, who works at Regent Park Resort, told The Daily Star over phone yesterday.

After the five left, the hotel employees checked newspapers and discovered that one of the youths was Shafat, he said.

Meanwhile, Kazi Reazul Hoque, chairman of the National Human Rights Commission, yesterday alleged that police showed negligence in taking timely action against the accused.

Shafat, son of one of the owners of Apan Jewellers, is the main accused in the case filed for raping two private university students in a posh hotel in the capital's Banani on March 28.

His friend Nayem Ashraf, victims' friend Shadman Sakif, who introduced the girls to the “rapists” early March, Shafat's driver Billal and body guard Azad are the other accused in the case filed with Banani Police Station.

Asked, a top police official, preferring anonymity, told The Daily Star they had information that some of the accused visited Sylhet after the case was filed. A team from Dhaka along with the local police was trying to arrest them, he said.

Mobarak said the five youths, who were wearing pants and shirts, went to the hotel in a microbus. They had no luggage. They walked straight to the reception and inquired about room for rent.

When the receptionists told them the daily rent ranged between Tk 5,000 and Tk 20,000, one of the youths said, “Money is not an issue. Arrange a good room for us.”

Asked, none of the youths gave ID cards or any other relevant documents. As the hotel authorities refused to give them any room, they were locked into an altercation, said Mobarak and other hotel staff.

A few minutes later, the youths left the hotel. Mobarak said their behaviour was suspicious and some of the hotel staff had the feeling that they had seen Shafat somewhere. It led them to check newspapers and discover that one of the youths was the prime accused.

The incident came to the fore after some online news portals reported it.

It is not clear whether the four other youths were the rest of the accused in the case.

Helal Uddin Ahmed, owner of the hotel, said the under-construction building did not have any CCTV camera.

Contacted, Rafiqul Islam, assistant commissioner of police (Gulshan zone), told The Daily Star that several police teams were working in several districts to arrest the accused.

Mehedi Hasan, caretaker of Shafat's house in Gulshan, said the alleged rapist, aged around 25, went there last on Sunday, a day after the case was filed. Later, he left in a car.

Meanwhile, BM Farman Ali, officer-in-charge of Banani Police Station, went on a five-day leave yesterday amid allegation from the girls that there was an underhand dealing between some officials of the police station and the accused.

Police denied the allegation.

Abdul Ahad, additional deputy commissioner of police (Gulshan division), said the OC took the leave citing family reasons. He, however, could not say when Farman applied for that.

One of the girls also alleged that the police officials tried to brand them as bad girls when she went to the police station for filing the case in the afternoon of May 4. After dilly-dallying, police recorded the case on May 6.

Meanwhile, a team from Banani police raided Shafat's home yesterday afternoon. After the raid, Sub-inspector Milton Dutta said they were looking for the passport of the accused, which was not there.

Invited to Shafat's birthday party on March 28, the girls went to the Banani hotel around 9:00pm. After the rooftop party ended around midnight, the accused raped the girls in two hotel rooms at gunpoint, alleges one of the girls.

NHRC BLASTS POLICE
National Human Rights Commission chief Kazi Reazul Hoque yesterday said the Banani rape case was a shocking incident but police taking two days to register the case was even more shocking.

“Police dilly-dallied [for filing the case] for 48 hours. It's not acceptable,” he told a programme in Khulna, reports our correspondent there.

Before fleeing Dhaka following a rape accusation, Shafaat Ahmed, son of Apan Jewellers owner Dildar Ahmed, moved around guarded by armed bodyguards all the time.

A photo of Shafaat surrounded by his bodyguards became viral on the social media platform, Facebook, on Wednesday.

In the photo, Shafaat is seen wearing panjabi and posing with his friend Nayeem Ashraf, who is also an accused in the same rape case, with the bodyguards in the back.

It is not however unusual for wealthy businessmen and their family to have round-the-clock personal security in Dhaka after police clearance.

On Saturday, a case was filed with Banani police against Shafaat Ahmed, 26, Nayeem Ashraf, 30, Sadman Sakif, 24, and Billal, 26, for the alleged rape of two young women at the Raintree Hotel in Banani after a birthday party on March 28.

According to the case file, Shafaat, the son of Dildar Ahmed, one of the owners of Apan Jewellers, and his friend Nayeem allegedly raped the two university students while Shafaat’s bodyguard held the girls at gunpoint and Shafaat’s driver Billal, 26, videotaped the incident.

It has been more than 72 hours since the rape case had been filed against the four, but police have yet to arrest anyone.

Police on Tuesday finally went to the house of Shafaat Ahmed to find that he and his passport were missing, three days after the rape case was filed with Banani police.

On Monday Shafaat and three other men – presumably Nayeem, Shadman and driver Billal – were spotted at the Regent Park Resort in Thakurbari Thillapara in Sylhet.

They were denied a room at the resort that they tried to rent for Tk20,000 as they had no forms of identification on them and were not carrying any overnight bags.

They quickly left the resort when the on-duty officials at the resort recongnised them.

In the meantime, Victim Support Centre received the documents of the case on Wednesday morning.

Although six days have passed since the case was filed, no arrests have been made.
Home Minister Asaduzzaman Khan Kamal on Tuesday evening told Dhaka Tribune: “Each and every single accused of the Banani rape case will be arrested very quickly.

“No external forces are at work to hinder the law enforcement agencies,” the minister said.

The home minister also said: “We have arrested many notorious criminals, even militants. Likewise, we will also arrest the accused in the rape case. Be patient. Nobody gets away after committing a crime.”

“There is no external influence at play here. Nobody is powerful enough to influence these matters. Neither I nor the police do someone else’s bidding. Prime Minister Sheikh Hasina is the only person with power and influence in the country,” Minister Kamal said, noting that two Awami League MPs are currently in prison.

According to the testimonies of the victims, police are aware of the identities and whereabouts of all the accused but have not arrested them because they are from influential families.

Shafaat is the son of Apan Jewellers’ owner Dildar Ahmed. Nayeem is the managing director of eMakers Bangladesh and Shadman Sakif is one of the directors of Regnum Group. Shafaat’s driver Billal, unnamed bodyguard, and Sadman were also accused of assisting Shafaat and Nayeem.

Two protest rallies will convene at Shahbagh on Wednesday afternoon to condemn the recent Banani rape
Several citizen platforms will meet at Shahbagh intersection today at 5pm to protest the recent Banani rape and demand immediate arrest of the accused.
The protesters are also demanding exemplary punishment of the rapists.

Gonojagoron Moncho Spokesman Imran H Sarker told the Dhaka Tribune: “Our activists will protest the rape by holding a human chain and a protest rally. We will hold a bigger protest on Friday to express our condemnation to rape and sexual violence.”

Also, a students-teachers-writers-artists-journalists-cultural activists’ platform will meet at Shahbagh for the same cause at 5pm. This protest has been convened by prominent activist and academician Gitiara Nasreen

Whats wrong with personal security? His father is a gold businessman. Abduction is not something new in Bangladesh for ransom.

To be honest, there is nothing wrong about employing authorized armed security escorts. However, a comprehensive policy framework needs to be formulated from hiring from a legitimate Security Agency, be it Private or a Government one. At present this is not the case, any person holding a valid shotgun licence can be hired,and acts more like as a loyal goon. For a handgun i.e, pistol/revolvers, these rules are not applicable. Handgun licences are issued for political thugs, while Officers below a full SECRETARY are barred. Strange Laws.

Who is Nayeem Ashraf?

Nayeem Ashraf, along with Shafat Ahmed, Shadman Sakif and two others are on the run since they were accused of raping two women at a Banani hotel on March 28.
Nayeem Ashraf, one of the key suspects in the notorious Banani rape case, is not who he makes himself out to be.

Two women have filed rape charges against Nayeem and four others. According to the case statement, the women were raped on March 28 in a hotel in Banani.

Reports from his uncle Moazzem Hossain, distant in-law and local UP Chairman Ashraful Alam, and ex-wife, paint a picture that shows him to be a man comfortable playing a long con.

Moazzem said: “His real name is Abdul Halim. He is the son of my brother Amzad Hossain and his wife Saleha Khatun from the village of Gandail, Kazipara, Sirajganj. Amzad is a humble farmer and Saleha a day labour.”

“I believe Halim first started using the pseudonym Nayeem after he moved to Dhaka in 2004,” added Ashraful Alam.

What led to his relocation?
Nayeem alias Halim had struck up a whirlwind romance with a girl from Bogra Polytechnic Institute after passing his SSC exams. Chairman Ashraful said Nayeem had lied to the girl and identified himself as belonging to the Bogra mayor’s family.

When the girl found out, her family charged Halim for deception and assaulted him, driving him out of town.

Halim came to Dhaka beaten, but not broken. His cunning mind conjured up a plan which could rival a criminal mastermind.

The Ashraf Connection
Halim assumed the name Nayeem Ashraf, who in reality is the son of Ashraful Alam – the upazila parishad chairman of Halim’s native village.

UP Chairman Ashraful Alam said: “His family did not have much. But over the past few months, he set up new houses in the village, which we found to be unusual.

“I was horrified when we found out he raped two girls. He is a liar, a cheat and a fraud. I demand he is given an exemplary punishment. It baffled me why he has not been arrested yet.”

The chairman paused, and added: “I am related to him through my in-laws, I am ashamed to admit it. But he has to be brought to justice.”

Playing the long con
From 2004 to 2017, his swagger and demeanour helped set up hundreds, if not thousands of connections with influential people. Businessmen, politicians, media personalities, athletes, models and police officers became his trusted contacts.

He also began working at Ekushey Television. His actual designation at the channel remains unconfirmed, but he claimed to be a broadcast manager, according to his ex-wife.

Halim passed himself off as Nayeem, the son of UP Chairman Ashraf Ali whom he described to be a wealthy landowner from Sirajganj. He claimed to be BSc graduate, a wealthy entrepreneur and at times the son of an industrialist, according to his former mother-in-law.

Sometimes, he also introduced himself as the vice president of Awami Swechhasebak League’s Kazipara unit. And on various instances, he would say he was close friends with the son of Health Minister Mohammad Nasim, said Ashraful Alam.

He managed to acquire stakes in sheesha lounges, restaurants, event management firms.
eMakers Bangladesh, an event management firm headed by Halim under his pseudonym was responsible for bringing to Bangladesh Indian artists like Arijit Singh and Neha Kakkar.

Birds of a feather
It remains to be known exactly how or when Halim met Shafat Ahmed, another key suspect in the rape case. But they struck up a relationship whose extent was easily gauged.

Halim and Shafat became fast friends. Abundant photographic evidence of them together confirm they were as close as best friends could be. Halim and Shafat would party together, dine together, and engage in business ventures together.

Halim referred to Shafat as “king” for his wealth that would frequently benefit his schemes. Several of Shafat’s classmates from ISD also confirmed he was a person who could be exploited.

His media initiatives
A reporter confided to the Dhaka Tribune that Nayeem had set up News71.com in Mirpur DOHS, a local online news media.

Nayeem offered the reporter to join his staff and proposed an illicit offer. He told the reporter to investigate superstores in Dhaka and discover their irregularities and malpractices. Instead of publishing, Nayeem said he would blackmail the shops to extort money.

As of 2:50am, the district of Sirajganj is well-aware of Halim’s ventures as Nayeem Ashraf. Health Minister Mohammad Nasim himself asked the police to track him down and arrest him. Minister Nasim reiterated that Halim had never been part of any Awami League organisation, in spite of the many posters in the area which bear Halim’s name and face with Swechhasebak League credentials.

Nayeem Ashraf, along with Shafat Ahmed, Shadman Sakif and two others allegedly raped two women at The Raintree Dhaka hotel on the night of March 28. The two women filed a case on May 6. The accused have been on the run since.

Banani rape victims post images of pain and despair on Facebook

The victims suffered in silence for a month after the crime. Their pain was reflected in their social media posts
A girl is standing under a shower, her face drenched in water, the eye liner dripping down her face. A look of despair is in the woman’s eyes.

This symbolic photo was posted on the Facebook profile of a rape victim on March 30, two days after the crime. The rape took place at the Rain Tree hotel in Dhaka on March 28.

Two young women, both university students, were allegedly raped by Shafaat Ahmed, his friends Nayeem Ashraf and Sadman Sakif while Shafat’s driver Billal and his bodyguard Azad helped them subdue the victims and filmed the entire incident.

The victims in their first police complaint said they had completely broken down and that it took a long time for them to muster the courage to speak up. For a month, they did not even tell their family members what atrocities were committed in the hotel.

The victims said that they did not know how they spent the night after losing all hope to live. Later, a victim on March 30 posted the depressed girl’s symbolic snap. Her sorrow can be realised by the comment-conversation with one of her friends.

A friend’s inquiries about her mental condition in the comments section of the image were met with non-commital replies.

The victim again on April 1 posted another image of fear on her Facebook ID.

The other victim of the Banani rape also expressed her despair through similar posts. An image of a woman putting her hands together in a gesture of pleading was posted as her cover photo on March 30.

On April 1, the second victim posted an image of a girl child with tears in her eyes, her mouth taped shut and on it, written: “If you tell anyone.”

The rapists had allegedly been threatening the victims not to approach law enforcement.

Dildar Hossain, father of the prime accused Shafat, has claimed that the entire incident was fabricated to blackmail his son.

The victims said they had initially feared the social stigma associated with rape and did not want to go to the police, but the rapists were continuously threatening to post the videos online if the victims did not comply with their order to meet them again.

The two victims’ physical examinations were held at Dhaka Medical College Hospital 40 days after the incident. The hospital said a report would be issued 15-20 days later. Due to the delay, concerns have been raised whether evidence would be found in the report.

On Tuesday night, the case was handed over to Dhaka Metropolitan Police’s Victim Support Centre and Investigation Unit. All documents of the case were provided to the unit’s Inspector Emi, the investigation officer.

Victims said that police were sure of the identities and whereabouts of all the accused but had not arrested them because they were from influential families. The two also alleged that rapists had repeatedly been threatening them over phone and social media to withdraw their case.

The prime accused was last seen in Sylhet on Monday evening. Police did not find his passport after a raid in his residence in Gulshan on Tuesday.
