A court in Delhi decriminalizes homosexuality.

"Where the mind is without fear, and the head is held high ..." begins a prayer the poet Rabindranath Tagore published in 1910, invoking the almighty to awaken India's collective consciousness into a "heaven of freedom."

With a radical decision last week, the Delhi High Court decriminalized consensual sex between homosexual adults and swept away a threat that hangs over every Indian who, in the privacy of his or her own bedroom, might engage in sexual activity "against the order of nature."
And by linking its ruling to each citizen's fundamental right to freedom and protection from discrimination, the court's verdict rose above the fray of the culture wars around the issue of sexuality in this predominantly orthodox and religiously conservative country.

Over the 149 years of its existence, the infamous (if rarely enforced) Section 377 of the Indian Penal Code has remained a psychological threat to India's sexual minorities. It has resulted in countless instances of misery and harassment, and spawned a thriving blackmail industry.

The psychology of fear that the law begat, by its mere existence, has been lifted with the court's ruling that it is unconstitutional. In that alone, a great wrong has been righted. For the millions of gays, lesbians and other sexual minorities in India--and with the country's population of 1.3 billion, we are talking many, many millions--to be able to hold their head high and be who they are, equal before the law, is both a huge psychological boost and an affirmation of their human dignity.

For urban, middle-class homosexuals, being gay in India is akin to being gay in the U.S. in the 1950s. The condition of homosexuals in small towns and rural India is far worse. Most gays in India remain in the closet for cultural and social reasons, irrespective of the law; many still feel that the Delhi court's ruling will not really impact their day-to-day lives as long as social stigmas remain.

I don't know the non-pejorative word for homosexual in Hindi, but "gandu"--the equivalent of bugger--and the word "homo" are routinely used colloquially as put downs and abuse. Many families have "the gay uncle" who "nobody talks about," a semi-visible personage in the family pantheon.

This "don't ask, don't tell" kind of blindness has only further emasculated the image of the gay person by making him invisible. It is not surprising that the law has remained untouched all these years after independence, undisturbed by any political will, cocooned by a culture that turned a blind eye.

A noisy debate is underway, and the media is revving up to cover a grand culture war. The religious groups have been vocal, but recent statements from an archbishop and a senior mullah have restricted themselves to morality and sin--underlining an appropriate separation between church and state. Predictably, they reiterate that homosexuality is a sin in the eyes of God, but also that every sin is not a crime. However, the media storm has brought a number of anti-gay prejudices and beliefs from ordinary people to the fore--revealing the warped images people have of what it means to be gay, fed largely by stereotypical Bollywood portrayals of them as effeminate objects of ridicule.
Coupled with religious orthodoxy, the risk of a prejudiced majority bullying a minority out of its rights runs high when emotions and feelings are aroused from moral outrage. Gay activist groups, which have been at the forefront of the fight for repeal of the law, are being careful not to fall into the trap.

It is critical that they keep the framework of the debate where the court has pegged it--as an issue of fundamental rights--and thereby address our changing consciousness and society.

The real opportunity for the gay community in India now, after a favorable court ruling, is to concertedly address these social stigmas. It must also strive to make itself more visible--not in any stereotypical way, but by presenting itself to the public eye as it is, or rather, as it emerges.

As more people come out of the closet, if only to strengthen the court's ruling by standing up and being counted, we also will be acknowledging a reality we have always known. Deep-rooted cultural prejudices do take time to transform, but in this increasingly networked world, ideas--and the dreams they inspire--can move across countries, castes and creeds.

Let us not forget that 60% of India's population is under the age of 25. The decriminalization of homosexuality is going to impact them as they come of age, develop their increasingly individualistic identities and make choices about how they wish to live. This newly empowered generation of citizens is concerned with securing economic prosperity by engaging with each other, and the rest of the world, in a culture of tolerance and respect.Is this heaven? Far from it. But India, surely, has taken a giant step away from hell.

I have some doubts about what consequesnces an amendment in article 377 can have.
Help me clear some of them.


SUppose I pick your child and tell him:
"Dude, gay sex is awesome you should try it sometime. It is natural for some to be gay. Every human being has a infinitesimal percentage of gayness. Being gay is no different except for being gay. There is nothing wrong in trying.
I cannot be prosecuted because what I have said is true."
So then may be he tries, his friends try and so on.

SO then the world becomes full of bi s at best, gays at worst.

Is this not undesirable for human civilization? What is wrong with the scenario I mentioned above? I hope there is some flaw in it.


So we will be fighting to keep our 'sexual religion' alive?
Clearly I think having all bi s is one of the worst things possible for human civilization. But there might be some here who want to say it is just a matter of evolution.

This is what keeps me worried about gay laws.
I am just a kid. Give me your comments plzz.

I am not sure that argument would work. Most people are not attracted to people of the same sex. If your argument has to work the person who is being asked to try it once has to have a reason to try it and after trying it has to like it.

First there is the barrier of personal morality. After that is breached there is the barrier of "not enjoying it" (I'd think).

People don't try everything in the world they are asked to. I've never used Cocaine or Heroin or even codeine even though its pretty easily available and people have offered it to me. Neither have I gone to a prostitute even when I was in parts of Europe where it was perfectly legal. This is where the "morality" or religious come in to play.

Then there is the issue of not enjoying it. Incest for example is not illegal in a lot of places, but it is extremely rare because people in general are repulsed even at the thought.


An excellent example of all this is Europe. Gay sex has been legal for a while there, but not everyone in Europe is gay or bisexual. It is still the minority view.

Most men cannot be TALKED into being gay.

And suppose say in your case you were able to successfully convince a kid, if the kid tries it, and likes it, then he was pretty much gay to begin with otherwise he would never try it again...

Just the way you may be hard wired to like women, others may be hard wired to like men.

Imagine your kid seeing two gay dudes intimately hugging each other in public , your kid hardly knows anything about sexuality and ends up thinking this is also a right way of treating your friends. These things will increase gay tendencies in many people who otherwise wouldn't have been gays. Gayness is regulated by hormones and hormone levels can be stimulated by medications etc. which seems to be the case in US.

Many groups related to gay-rights are also entangled with population-reduction groups, interesting...isn't it?

Gay ppl were around long before article 377 enacted and they existed during all these yrs while this rarely used act remained in force.

Now to think that article 377 prevented gay sex or its abolishment gonna make heterosexuals join gay bandwagon is faulty thinking at best.

homosexual behaviour has always been seen among small minority section of the society not because its aganist article 377 ,but because most ppl are not gay who find it simply as unnatural, hideous and also aganist normal social behaviour .

With decriminalising article 377, we can stop harrasment in the name of moral policing of gay ppl because of their certain sexual orientation and restore the personal freedom of choice assured to all in the constitution of india.

If u are hinting at moral decay with repealment of this act and surge of gay kinkiness among heterosexuals,then its responsiblilty of the larger society to keep its moral sanity intact.

But in a true democratc coutry,Law cant discriminate ppl based on his/her sexual acts long as they are consensual and done in private without coercion just like heterosexual act.

Like Asim said in his above post most ppl are hardwired interms of their sexual orientation who they gonna prefer .

I dont know about others,i guess from own experience i could say that from age 10 onwards ur sexual compass starts giving u directions which way ur attraction lies.;)

I am talking about talking children into being gay. With the sex education in India, anything can happen.

I was a staunch Anti-gay person but after meeting a few Gay people i can say they don't harm anyone and just want to be left alone, but what really ticks me off is the way they act when they all get together, i am talking about the Gay parades dressed up in silly clothes and everything.. I mean seriously!! i know your gay but why are you trying to be ridiculous.

As long as you don't harm others i could careless what two consenting adults do but generally speaking Gay people are actually very political and educated (the ones i've met so far)

India has not legalised the practise of homosexuality. It has made the practise of consensual sex between people of the same gender legal and equal to the practise of consensual sex between heterosexuals.

It is basically a non discriminating law in line with most other nations.

Affectionate homosexual behaviour in public will get the same treatment that heterosexual lovebirds will get. A big danda from the local constabulary. Also Gays cannot marry, or be part of heraditry laws that heterosexual couples enjoy.
