European powers reject China's South China Sea claims

Hague tribunal in 2016 South China Sea tribunal is unacceptable for for every SCS nations, not just China.

Vietnam and Philippines will never accept it because it means a loss of sovereignty.

The main problem is her ruling defined all SCS islets as reef, that has lots of legal implication favoring no one accept outsiders, especially white man.

That is the reason, all SCS states are putting the China Sea tribunal one side, and move on with China.

In colonial time, only Mekong Delta is under colonial regime, the rest Vietnam is still independence state, headed by Bao Dai emperor. France made protectorate for Annam Imperial.

In WWII, Viet Minh under leading of Ho Chi Minh, Vietnam fought counter occupation of Japan in Vietnam.

After WW II In San Francisco conference, Vietnam delegate was participated on, so Vietnam under Bao Dai has protested claim KMT ROC. The voting in following is rejected claim of KMT on East Sea of Vietnam.

Note that Vietnam warlord Nguen has been controlled Paracel and Spratly after 1600s when he had taken control over south Vietnam.
So what does the Treaty between China and France have to do with the Vietnamese?

The International Arbitration Tribunal is NOT a part of UN or UN PAC hence it is neither recognize nor enforceable today.
It is fully funded and its judges are selected with the approval of Philippines Ministry.
There is only one participant and it is Philippines.
It ruled on UNCLOS a maritime law ans not land.
What it ruled is that all these islands of this status do not have 200 NM EEZ.
Meaning it affects all nations including Japan, Australia, India UK, etc.
Then why is Indonesia claiming that Natuna Island has a 200 NM EEz and sinking Vietnamese fishing vessels?
That is the confusion that is created by this IAT ruling that is used conveniently by detractors.

Paracel and Spratly islands does belong to Vietnam from long time in the past. Before WW II, there was no dispute between Vietnam and China.

He solemnly said: "according to Vietnamese information, Paracel Islands and Spratly Islands should belong to China's territory in the history." Li Lu, director of the Asian Affairs Division of Vietnam's Ministry of foreign affairs, further introduced the Vietnamese materials, pointing out: "historically, Paracel Islands and Spratly Islands have belonged to China as early as Song Zhaoshi."



In September 4, 1958, the Chinese government issued a statement declaring that the width of China's territorial sea was 12 nautical miles, and clearly stated: "this provision applies to China, including Paracel Islands. All the territory of the people's Republic of China. On September 6, the people's daily of the central organ of the Vietnamese Labor Party published the Chinese government's statement on territorial waters in its first page. On September 14, Prime Minister Fan Wen Tong of the Vietnamese government sent a note to Chinese Premier Zhou Enlai, solemnly stating: "the government of the Vietnamese Democratic Republic recognizes and agrees with the statement of the government of the people's Republic of China on the territorial sea decision of September 4, 1958" and "the government of the Democratic Republic of Vietnam respects this decision.".

The letter written by Vietnamese PM Phan Van Dong was in romancised Vietnamese.
Originally it was a 11 dash lines.
In his letter on behalf of Vietnam he recognized China claim in the South China Sea.
Following that the 11 dash lines was altered to 9 dash lines accordingly so that Vietnam can retain its territories within 12NM sea borders.

The earlier historical documents were all written in Chinese proving Annam was a Province of the Middle Kingdom as recorded. :coffee:

After 1954 North Vietnam and China PRC signed in to Geneva Acoord, it had divided Vietnam in th two state. Paracel and Spratly belong to south Vietnam of King Bao Dai. The letter of Pham Van Dong mentioned only about 12 mile coast line of North VN and China, not mentioned about Spratly and Paracel.

The Cairo Declaration, the Potsdam Proclamation and other international documents clearly stipulate that the Chinese territory stolen by Japan should be returned to China. In December 1946, the government of the Republic of China appointed senior officials to the Spratly Islands to receive a reception ceremony on the island to send troops to garrison. In 1951, the Chinese government stated in the Declaration on the United States, Britain and Japan on the peace treaty and the San Francisco conference, "the sovereignty of Paracel Islands and Spratly Islands is the same as the entire Dongsha Islands and the China Sand Islands, and has been China's territory since ancient times." It has been publicly recognized by a large number of governments including the Vietnamese government and the resolutions of international conferences. Therefore, there was no so-called "South China Sea issue" in the long period after the war, and no country in the South China Sea region had raised any objection to China's exercise of sovereignty over the Spratly Islands and its adjacent waters. The Japanese government formally stated in 1952 that it "gave up all rights, names and demands on Taiwan, Penghu islands, Spratly Islands and Paracel Islands" and handed over the South China Sea to China.

Before the Second World War, China had sovereignty over the South China Sea. In the Second World War, Japan occupied the sea and islands. After Japan's defeat, China regained sovereignty over the sea and islands as part of the Allied forces.

That time has passed and water and reefs is not the same as land such as the former Qing territory currently being Russian territory.

If China as the biggest country in the region wants to earn the cooperation of its neighbors, then China should compromise with neighbors in the South China Sea.

If China wants to go on a quest to retake land that was once part of the Qing, then Russia is prime target.

China has been the first in the world for a long time. We have excellent historiographers to write credible history. Today's people and government will learn wisdom from these history books and deal with international affairs in combination with the current situation of modern society. You don't need to worry.
