‘Don’t expect relief from courts if you do this’ IHC CJ irked by Imran’s latest statement

Islamabad High Court (IHC) Chief Justice Athar Minallah has expressed his displeasure over Imran Khan’s latest controversial statement about the appointment of the next chief of army staff (COAS) and said that the PTI chief must not expect relief from the courts if he was hell-bent on doing “all this.”

On Monday, Justice Minallah heard a petition against a PEMRA ban on the live broadcast of Imran Khan’s speeches.

The court suspended the PEMRA order at the last hearing and Justice Minallah today disposed of the petition.

However, during the hearing, the IHC chief justice addressed the lawyers from the PTI and came down hard on them for Imran Khan’s latest statement about the army. The statement was condemned by prime minister Shehbaz Sharif as one of “Imran Niazi’s despicable utterances to malign institutions.”

Justice Minallah said that no one had the right to declare who was a patriot and who was not.

“The armed forces are sacrificing their lives and you are trying to demoralize them,” he said.

The IHC top judge also lamented that Pakistan was drowning in floods and “such things” were being discussed at this time.

“Is this leadership? Have you put every thing at stake for a game of thrones,” he said.

“Can you raise question on the patrioticism of a military general?” the judge asked.

Do you want to utter such things and then desire the PEMRA to not play its regulatory role, Justice Minallah said adding that the PTI leader must decide for himself what he wanted and that he should not expect relief from courts after “doing all this.”

“Are you suggesting that the Constitution could be violated?”

The judge advised Imran Khan to exercise “self accountability” as well.

Justice Minallah said that allegations hurled by a political leader with a following have a deeper impact.

If such a leader makes a provocative statement in violation of the Constitution, it could not be seen as freedom of expression, he said.

You will create problems for yourself by making such statements, he said.

“What message are you sending to the enemies. Do you mean all generals are not patriots?”

Meanwhile, officials from the PEMRA explained before the court their instructions sent to TV channels last month on the live broadcast of Imran Khan’s speeches.

The officials told the court that they only wanted to ensure implementation of the delay mechanism.

The court disposed of the petition ordering PEMRA to follow the Supreme Court of Pakistan ruling while regulating live broadcasts.

Imran Khan also faces a contempt of court case for issuing threats to Islamabad’s Additional Sessions Judge Zeba Chaudhry.

A larger bench headed by Justice Minallah heard the case last week and granted Imran Khan a week’s time to revise his reply submitted to the court.

Where was this banana judge when maryam and bonga sharif abused these property dealers??? Courts are nothing more than a puppet of these property dealers. IK needs to bring out ppl and burn this whole rotten banana state to the ground.

So these GHQ batmen judges will make decisions not on the merits of the case but plaintiff's statements on unrelated matters...

Wah ji wah, nothing less can be expected from 130th ranked kangaroo courts of Pakistan.

What a joke the court system has become.
No judge should express any views about any political speech. It should only focus and pass judgement on the merits of the case in front of it.

If IK's speech is litigated on, then only does a judge have the right to pass judgement based upon the merits of the case. For a judge to try and throttle speech through such side bar comments speaks yet again to the weakness of the judicial system.

Also can someone help me understand what IK said that was so wrong. He said corrupt people will give air to corrupt cohorts. And that we should not expect that the corrupt group of imported will keep the sanctity of the COAS appointment process clear of their personal interests. Why is that wrong to express? You can disagree with and argue that the import corrupt lot is not corrupt, you can argue that all Generals and the officer corp of the Pak Army is Sadiq and Ameen. But you cannot stop any person from expressing that the sun rises in the East and sets in the West.

As long we we allow sacred cows to be developed in this nation we'll stay a banana republic.
Everyone is a special interest group. The bureaucrats have their housing schemes and their means of fleecing the public through corrupt methods without giving us our due rights and civic services.

The judges are sacred and cannot be questioned - and have a special clause that their incomes are not taxable.
The Maulvis can rape and plunder literally and figuratively and with their zoombiefied followers cannot be questioned.
The feudals/politicians cannot be questioned as they control the SHO/Thanna, and can release the Thanna culture on the poor public.
The Army is scared and cannot be questioned in terms of policy, procedure and leadership, as that institution builds an entirely separate system of society with their own hospitals, schools, universities, clubs, businesses etc. No one to question them. And they talk about dividing the military solider and command. When the CMH now have an officer ward and a soldier ward (separated - which was not the case years go) - that divides the army, not a speech from a politician. This discrimination exists in all aspects of the military culture and system. Help me understand the house staff concept. Though the Batman in the past was meant only to keep the officer of a certain level primed for all tasks, morphed into a house servant, and then morphed into something else. The sacred culture of the army degenerated into a third class civilian culture, with the army subsidizing the kitchen of all officers, through staff etc. Why? And why is that not divisive to the culture when a soldier sees his officer corp operating with different standards than himself. The sad reality is that good people in the military don't even see this gapping issue. They have become so tone deaf.

Only people who can be strung on the rack are the people. Pakistani people have no rights - the rest of the entire system are a bunch of termites eating away at the nation and through the bones of the public.

Looks like judge sb has also received call …. Never liked the judiciary in Pakistan as they churn out judgments per personal likings and phone calls….
Read some if the judgments from this judge against militar leadership especially missing person case

The bigger joke is that everyone and their dog has already said this previously openly in TV shows, news articles, and press conferences. That the Sharifs always choose an Army Chief who they think will be subservient to them. Why has it suddenly become gunah-e-kabeera to say the same?

The US senate defence committee has a hearing with the incoming Army Chief and cross questions him. They ask him for his plan of action, past events, thoughts on different world issues. Idhr aik chota sa sawal pooch lo to phir qayamat toot parti hai and the office of the COAS is being brought into disrepute. Yeh na ho to phir 'national security' kay maslay ajatay hain. Is the office of the COAS so fargile that they cannot stand up to a few questions? Hamari NA committee to Mashallah waisay hi bari qabil hai, to I won't say he get confirmed by it (yet), but still...this isn't a hush hush appointment.

ISPR says not to discuss the COAS appointment? Why not? The guy heads arguably the most powerful position in the country, which almost takes up the largest executive share of our budget (from tax money) apart from loan repayments....to the public should not discuss it?

I won't go into the details, but have heard plenty of things regarding Minallah sahab and his relationship with the military (especially after becoming CJ IHC). Koi waja hi hai har case fauj ka inhi kay bench par lagta hai. Upar say lip service poori ho jati hai, magr asal substance kuch nhn hoti.

Ab sachayi kia hai, time will tell.

When PDM were saying very damaging remarks about state institutions, this judge has been sleeping only to be told by Neutrals not to air IK speech live.

I am at a loss for words. IK says next COAS should be meritocratic pick, completely benign statement, and this judge has to intervene? What about penile electrocution of chief of staff of most popular party with “massive following” what about journalist crying on tv he was violated by these “establishment folks”? Cat got your cowardly tongue? Only words were blaming IK about Baloch abuse? Shouldn’t our army be Uber offended by the judge claiming our army tortures baloch youth? Isn’t that statement attacking IK much more painful to morale of my army than IK saying next general should be based on merit? What land is this?

Banana republic of Pakistan. even banana republics takes an offense when pakistan is called banana republic, they vehemently say that Pakistan is worse than that. What a joke of a country has it become.

We don't expect it anyway Mr cheap justice.
The real Justice will be done on streets, and we are all just waiting for IK's call.
