Why would you think that ? Its a stepwise process to merge FATA with KP. I think thats what we all wanted.

And if army can conduct operations in SWAT (already under both courts jurisdiction) then why would they not be able to work freely in "current fata" territory ?

Army is present and deployed in FATA and will remain so , as Afghan cross border attacks are becoming more frequent , we always need heavy army Presence in FATA . Judiciary has no say in Military matters
