Did I just get scammed for 400$ ?

So today I was coming home, it was raining a little bit so roads were bit slippery, At an exit I gave the indicator and a car from behind hit back of my car, and my car spin 3 times before going off road to grass, because of rain the Grass with water (I think) save me and my car from flipping over, I came out side quickly to check on other drive to make sure they are ok, a cop showed up and he ask us if we both are ok and need any medical attention, I was just panic and shocked and processing the situation cause this is the first time I was dealing with a accident and Cop, Cop asked us both to get our Registration and license, I get it but cop ask us if we don't want to file a report than we can go through insurance or settle it among us, he help push my car out of grass and he was on his way. The Guy and I was talking about and he said if I pay him cash than there is no need for insurance companies to get involved, he told me that would take my insurance go up and I had a 500 deductible which I would have to pay anyway, so he asked for money and I ended up giving him 400$ through cash app, my car was not damage just Rubbed off, his fender was damage and bumper was damage to and Rubbed as well. When I get home my room mates told me that I should not have done that, he did took Pics of my License and registration but upon transaction he did delete and he went on his way, now after talking to my friends they told me that I should've filed the report and he probably did not have insurance.

What I don't understand that I told cop that I am new here and this is first time dealing with this kind of situation and yet Cop did not seems to be helpful, he just bailout super quick. Now my friends told me that, guy can still file a claim from Insurance although there was no police report done so Is it possible ? they also told me he can try recover picture from deleted Pics but if there is no report can he do that ? I hope he do not do anything because I paid him because I thought it's easier and more reliable way as even the cop suggested that before he left.

Did I make a Mistake ?
What can I do better next time ?
If the guy try to do anything else what else I can do ?

He wont tell the insurance because it was his fault, so nothing to worry about. Yes he had you off, he is probably partying with your $400. Next time make sure take photos of both cars and one wider photo to see what happened. When you told the cop you want to settle it amongst yourself, there was nothing else he could do, he probably went to KFC.

A very long time ago, I once asked an industrialist who was down on luck if he had done MBA. He said yes, I completed MBA in 20 lacs. I said thats cool, from where did you get the MBA degree ? He laughed and said I took MBA degree from the road, I lost Rs 20 Lacs through frauds, mistakes, bad deals, trusting wrong people and my own failure to handle situations. He said people do MBA in top unis paying up to Rs 80 lacs even, but we businessmen learn and adapt everyday.

You lost $400 but you learnt a valuable lesson. Thank God you didn't pay $4000, or $40000 or $400000 to learn this lesson. Thank your parents for their prayers.

You can earn those $400 back in a few days or weeks. Have confidence in yourself.

You got jolted a bit through this experience coz you had to learn something new. what did you have to learn ?

1. Handling yourself in a situation.
2. Learning the laws of a new country
3. Negotiating with other people during a situation build up
4. Understanding paper work, insurance and the importance of gathering information through pictures.

and please don't blame God for this, He wanted you to learn something, unfortunately it was taught through this method which made you highly uncomfortable. Just learn the lesson and move on.

Last thing, all these members who are pointing fingers in this thread, they have also seen crap in their lives and haven't been able to do an iota of thing about it. At least you shared your experience here. If such a situation comes on them also, I am 99% sure they will panic and screw up too in one way or another.

Maybe he was changing lanes to get to the exit ramp. It's not clear but @Goritoes admitted that he did not see the other car while changing lanes. Normally, the fault lies with the car behind you but, as @jhungary said, the rules change when you are changing lanes

First of all thank you everyone, I feel much better and I did call cops last night, operator transfer my call to Highway patrol, and I had the talk with their operator, she told me there is nothing that can be done now cause its 6-7 hours passed for the accident, and you had paid already and had no other information, she told me to talk to my insurance company which today i did, the agent told me that if you report the accident than you will be considered at fault, cause you paid and if things go forward your insurance will go up for which all that happen to avoid. now I do understand people's argument that I made stupid decision and everything, but you guys needs to understand that I never been in a accident, if my car rolled over I would not be alive or at least break my neck or many other bones, I am 6'2 and my head is very close to roof when I sit , my Infinity Q50 is very low body car, As a Muslim I thank Allah that he prevent something worse and he protected me from a potential life threatening or paralyzing injury, I don't care about 400$, and no I am not rich or Jeff Bezoz, I earn my money by doing hard work so every dollar matters, I am sad about losing my 400$ which I really need at this trouble times that I am facing which I can not share here on PDF, and I most likely now have to look for personal loan and have to pay Interest on it, but from my POV, I was shocked , tired , exhausted from work, it was raining and I was in complete panic, I was shaking with fear and trying to process what just happen, I can ask cop to call Ambulance but I was more worried about other dude, I had to pull myself together but when cop left I once again feel confused and I was at mercy of someone who is born and lived here for decades against someone like me who just got here a year ago, and lived a simple life from work to home, home to work.

My whole worry was that he because he took pics of my ID/registration I hope he won't use it, so I will trust this human to keep his word just like despite his fault I was worried about his well being, I am a human being after all and I know some of you might think I am naïve and Stupid but I am just a simple person who try to avoid lies and deceit, that Is why I was honest in this thread about every small detail , Yes I agree I was changing lanes, I did give blinkers , Yes he was also driving fast, I was actually slowing down to take the ramp, so he might have hit me because of his speed, Yes I won't lie I did not see him cause If i did saw him coming that fast I would have prevented the accident. As long as this issue is done and dusted, I am ok with that conclusion, In Urdu we have a Saying " Jaan ka Sadqa Maal " we Muslims give Sadaqa for our lives and hardships anyway, I will consider that 400$ as Sadaqa for my life which was spare by Allah SWT for sure, I can't thank him much for saving my life. No I can not tell about this to my family in Pakistan, my mother get panic and she get scared quickly just like me, So I don't want to tell her and make her worry, I am here alone and my entire Family is in Pakistan , if anything happen to me there is no one to take care of me, I can't share about this accident and make my family even more worry.

Just giving a signal is not enough. It is the responsibility of the car changing lanes to make sure it is all clear before changing lanes. Every competent officer will fail you on the driving test if you don't physically turn your head to check the blind spot before changing lanes. Just glancing in the rear view or side mirrors is not enough.

P.S. I am talking about cars. Buses and trucks usually have huge side mirrors.

Sorry if I cannot be of any help for you. At least you still have your health and while the Police report can't do anything (the case closed the moment you pay the other person) but as I said this is just for the peace of mind, and now even if he come back and try to do anything illegal, at least you now have your base covered.

You need to understand, people will doall sort of thing to try to get out of responsibility, as I have already told you, I was a cop myself and I have seen probably hundreds of incident and probably attended court 200+ times to testify on what I have in my report (You handle a lot of traffic accident if you are in General Duty or Temporary duty.) People will say what they need to try to get out of having responsibility, the other guy is sure as hell dodgy, he most likely did speed (that's why I stress that numerous time)

So for you, god forbid if you get into another accident. Don't do anything other than exchange your license and insurance detail and call the police right away, remember one simple rules, nothing ever happened until you have it on a police report, everything work around that report, be it the court, insurance claim or assignment of responsibility. You can ask the other person are you alright, but never admit it is you responsibility. Let the Cop and Insurance handle the matter, that's why you pay insurance premium and your tax.

No of course not, I am learning and these lessons will help me progress in this country, maybe some day in a decade or two someone like me will get into a situation and I will be telling him about my experience etc, but learning from a COP (which I assume you are) is of course good, Again this was my first encounter with Police in America, and I did not expect it to be over a accident.

Next time if anything happens I know, first thing is to call police, and wait for them until they arrive and let them file report, exchange insurance and talk-less, let the Police do their job, let the insurance company do theirs.
