NEW DELHI: Global medical charity Medecins Sans Frontieres slammed on Friday a statement by Bayer's chief executive that the giant German firm only developed its cancer drug Nexavar for people who could afford the medicine, not "for Indians".

India's controller general of patents angered Bayer in March 2012 when he authorized a local drugmaker to produce a generic copy of Nexavar, saying the German company charged a price that was too costly for most Indians.

"We did not develop this medicine (Nexavar) for Indians," Marijn Dekkers said at a little reported pharmaceutical forum last month, according to the January 21st edition of Businessweek.

"We developed it for western patients who can afford it," Dekkers said, and called the Indian regulator's action "essentially theft".

Bayer said the statements attributed to Dekkers were accurate and forwarded written comments made later by the German chief executive seeking to explain his remarks.

Dekkers said the comment had been a "quick response" at the industry forum to the Nexavar issue and added Bayer wants "all people to share the fruits of medical progress regardless of their origins or income".

But Dekkers added in the written comments he had been "particularly frustrated" by the Indian regulator's decision, which marked the first time a so-called compulsory licence of a patented drug had been awarded in India.

Medecins Sans Frontieres (MSF) said on Friday that the Bayer chief's remarks summed up "everything that is wrong" with the multinational pharmaceutical industry.

"Bayer is effectively admitting the drugs they develop are deliberately going to be rationed to the wealthiest patients," Manica Balasegaram, executive director of MSF's Access Campaign, said.

The medical charity said big pharmaceutical companies believe "research and development (R&D) can only be rewarded by a patent and through high prices to recoup the R&D costs.

"Those who can't afford to pay are basically cut out of the system," Balasegaram said.

The Indian government gave local pharmaceutical house Natco Pharma a licence to produce a copy of Nexavar, used to treat liver and kidney cancer, at a 97% discount to the original selling price of the Bayer product in India.

Global drugmakers say India's powerhouse generics industry and strict patent filtering reduce commercial incentives to produce cutting-edge medicines.

I think India govt should ask these pharma companies either decrease the cost according to the income of the patients or ask the companies to leave India. I know these monoclonal antibodies takes a lot of money to develop, but not in the range of 2-3 lakh. this is simply robbing the patient.pharma companies have a mean profit range of 500-600 percent.

Dekker's whining is wrong here.

If Bayer specifically made the drug so that Indians couldn't afford it, then Indians were already out of their profit margin. What is so wrong if someone who was never a prospective client, got saved by the drug? The low price of Nitco does not even play a role because the drug was 'not developed' for the Indians, and Nitco's market (India) is where Bayer wasn't even supposed venture.

Instead, Dekker is crying that people got saved by a drug that didn't even hurt Bayer's books.

i don't know what to say.....ya its wrong of the pharma companies to overprice drugs,,,but these newer drugs do take a lot of R&D...n companies r here to make profits....
not everyone is Jonas salk.......not sure if this right...i mean wht govt is doing....1000 crore ke ghaple hote rehte hai...in pharma companies ko bhi kuch de do yaar....there shud be some agreement between govt n the company....like in defence deals......

Thats the exact reason they are pissed. Many countries use a lot of generic drugs which are made in india and low cost.

And about your R&D comment. The cost of R&D is recovered in early sale where prices are high. Then the the cost per unit is decreased by mass production. But some companies are not willing to let go their profit even after they recover their investment and made huge profits.

About the ethics the prima function of medical field is to save the human life thats why they need to issue a explanation where IP rights are not bigger than saving human life.

So screw this German and sell this drug to all the countries which are poor and need the medicine.

that is the point... there can be no patent thing for these life saving drugs....
if im not wrong mercedes invented ABS but they decided not to patent or offered the design to all the automobile companies....bcos it's life saving feature...people cannot try to make money out of it...
if these pharma companies would've offered these drugs at affordable prices or asked other companies to pay less premium for the patents...this confrontations would not have occurred... but saying that they make drugs only for wealthy...is nonsense....
i like wat indian courts are doing...and hope they keep doing it...

at best their should be a time bound patent for a max. of 5 years...to recover their r&d money...

How about you people do some research and help the world....instead of waiting for your betters to do it and stealing.
