Supreme Court has issued 43 page detailed verdict in COAS extention case. Details are still coming in.

پارلیمنٹ آرمی چیف کی توسیع کے معاملے کا ہمیشہ کیلئے حل نکالے: سپریم کورٹ

اسلام آباد: (دنیا نیوز) سپریم کورٹ آف پاکستان کی طرف سے آرمی چیف جنرل قمر جاوید باجوہ کی توسیع کا تفصیلی فیصلہ جاری کر دیا گیا۔

آرمی چیف کی مدت ملازمت میں توسیع کے معاملے پر سپریم کورٹ نے تفصیلی فیصلہ جاری کر دیا ہے۔ 43 صفحات پر مشتمل یہ فیصلہ جسٹس منصور علی شاہ نے تحریر کیا جبکہ چیف جسٹس آف پاکستان جسٹس آصف سعید کھوسہ نے 2 صفحات پر مشتمل اضافی نوٹ تحریر کیا۔

چیف جسٹس آصف سعید کھوسہ نے اضافی نوٹ میں لکھا کہ میں جسٹس منصور علی شاہ کے لکھے فیصلے سے اتفاق کرتا ہوں۔ تاریخ بتاتی ہے کہ چیف آف آرمی سٹاف کاعہدہ طاقتور ہے۔

سپریم کورٹ کی جانب سے جاری تفصیلی فیصلے میں کہا گیا ہے کہ جنرل کی مدت ملازمت اور ریٹائرمنٹ قانون میں متعین نہیں، آرمی چیف کی مدت ملازمت کا معاملہ مستقل بنیادوں پر حل کیا جائے

فیصلے میں کہا گیا ہے کہ قانون میں جنرل کی مدت ملازمت سے متعلق کوئی شق موجود نہیں ہے۔ منتخب نمائندوں کی ذمہ داری ہے کہ وہ معاملے پر قانون سازی کریں۔

تفصیلی فیصلے کے مطابق وزارت دفاع کی صدر، وزیراعظم اور کابینہ سے منظوری قانون کے بغیر بے معنی ہے۔ آرمی ریگولیشن کا سیکشن 255 جنرل کی مدت ملازمت میں توسیع کا اختیار نہیں دیتا۔ سیکشن 255 صرف عارضی مدت ملازمت کیلئےاستعمال ہو سکتا ہے۔

سپریم کورٹ نے اپنے فیصلے میں کہا ہے کہ پارلیمنٹ کو اختیار ہے کہ معاملے کا ہمیشہ کیلئے حل نکالے۔ آرمی چیف کی تنخواہ اور الاؤنس آرٹیکل 243 کی ذیلی شق 4 کےتحت واضح ہونے ہیں۔

عدالت عالیہ کی جانب سے آرمی چیف کی مدت ملازمت میں توسیع کے معاملے پر جاری تفصیلی فیصلے میں کہا گیا کہ حکومت نے 6 ماہ میں قانون سازی کی یقین دہانی کرائی۔ اگر چھ ماہ میں قانون سازی نہ ہوئی تو حاضر سروس جنرل کو نیا آرمی چیف مقرر کریں گے۔ نیا آرمی چیف صدر اور وزیراعظم کی سفارش پر مقرر کیا جائے گا۔

Some analyst says it requires just an Act of Law. If that is so then its no problem

nope ..... Law passed by simple majority in National Assembly and Senate is more than enough as SCP asked for legislation [law] not the amendment in constitution ..... so If PTI wait till senate election which I think would be held in March next year and PTI would get majority in Senate of Pakistan as well therefore they can pass it without the support of any opposition party ....

BTW I am not a legal expert .....

That is exactly what people in favor of extension were saying , its the duty of Parliament to make law or amend it , SC is there to make sure the rules are been followed . The thing is back to Parliament where it all started, PM did it by taking Parliament in to full confidence .

He did the thing in worst possible manner + with incredibly bad timing + with no understanding of geo-political consequences.

It was nothing but dick measuring contest. And TBH , I sincere doubt his intention behind all of this fiasco.

I think he took the bait, though not with some ill intentions ....

Don't know why but I have a feeling that there was someone from within PTI who was part of this 'designed' fiasco

Most of the bureaucracy and some elements in the establishment don't like Imran's strong personality. They don't like him at all and want to undermine him at every occasion and if possible , throw him out.

If Imran completes his 5 year term, they know very well that their chances to do whatever they like would be gone ( if not reduced to minimum)

And I also wouldn't be surprised if some elements in military want him out as well. They see him as a threat because after so many years , a strong man has come.

Army chief appointed by elected Govt and is a employ of Govt....To give extension to your employ its up to Govt no legislation required....

There are some other reasons "Only God Knows" who is behind this drama and why CJP wants to legislation for that.....

As per my personal view and assumptions that Govt itself want to put army chief under pressure to get some favorable decisions regarding what....I don't know....

He shud resign and let next guy in... Instead of giving favorible decisions
