Black is oversea Chinese, Dragon !!!

You mean like Bruce Lee?

No, I am not an oversea Chinese dragon!!!

1. About UNCLOS and international laws ... well, we're all know that PRC play their trick in every way to gain their advantage in dispute case, in case with Philippines, PRC 're simply don't care because her neighbour too weak.
With Vietnam (HY-981 oil rig), they used more muscle and media propaganda, cause they know we will not back off like Philippines.

My friend, I don't think the PRC has any advantage in the Philippines arbitration case.

Right now, the PRC can only depend on an additional UNCLOS clause made in 2006 to protect them. PRC said that 2006 clause can save them, Philippines said that clause can't. But it is entirely up to the tribunal to decide.

If the tribunal decides that that 2006 clause can't protect the PRC, then the tribunal and the Philippines will carry on with the arbitration case. In this stage, the PRC will be at a big disadvantage because they have rejected to participate in the case. Only the Philippines will be there to argue for their own case, the PRC can't make any case or defence at all. Unless, the PRC changes its mind and beg the tribunal to allow them to participate.

But if the PRC ask the Philippines and tribunal to allow them to participate, it will be like they have informally admitted that the tribunal has jurisdiction over the dispute and that the 2006 clause does not protect the PRC from the arbitration case.

So the PRC is in a very difficult situation.

And any arbitration ruling made by the tribunal will be legally binding, even if the PRC refuses to participate.

They have realised that they are now in a very disadvantage position against the Philippines' arbitration case. My speculation is that they are now desperately working on land reclamation works so that if the tribunal decides to carry on with the arbitration case, their artificial islands will help make the Philippines'argument weaker.

But if you read the article I linked in the OP, the law professor from Singapore said the PRC's land reclamation work will not legally help the PRC at all. In fact, the professor said the land reclamation works can help the Philippines case because they are breaking international conventions.

My friend, there is no need to show any historical data. The PRC has refused to participate in any UNCLOS backed tribunal. If the Philippines can convince the tribunal that it has jurisdiction, then China can't be there to argue about any historical evidence at all. In fact, they can't make any defense at all, unless they change their mind and beg the tribunal to allow them to participate.

How very entertaining ! And yes, that noodle dish looks appetizing. I admit, i haven't experimented in Vietnamese noodles aside from Pho. Perhaps i need to try more Vietnamese flavors next time. :)
