China says it blocked UN ban on JeM chief Masood Azhar because of 'different views'

India must show patience on its counter-terrorism concerns, says the U.N.’s senior most official on the issue of designating Jaish-e-Mohammad chief Masood Azhar and implementing U.N. sanctions against Lashkar-e-Taiba leaders Hafiz Saeed and Zaki-ur-Rahman Lakhvi based in Pakistan.

“India and all member states should understand that [the U.N. processes] take time and they must continue to cooperate,” said Jean Paul Laborde, the Executive Director of the Security Council’s counter-terrorism body, CTED, that was formed under resolution 1373 after the 9/11 attacks in the U.S. to help countries work together on prosecuting terrorists.

Mr. Laborde was in Delhi last week to address the concerns over the slow processing of India’s applications with the U.N. on terror.

Chief among those is the early ratification of the Comprehensive Convention on International Terror (CCIT) that India introduced in 1996. The CCIT has been held up at the U.N. by several countries, mainly the U.S. and France.

These countries feel that the current definition of terrorism targeting civilians could also be used against their military during international interventions. However, Mr. Laborde said he expects that the CCIT would be discussed at the UNSC in December this year when he holds an “open briefing” on international cooperation on terrorism, and is hopeful of eliciting a resolution on the issue that the Modi government has taken up strongly.

However, a more urgent issue for the government is naming Masood Azhar as a designated U.N. terrorist to be sanctioned under the UNSC’s 1267 resolution that would direct Pakistan to place restrictions on him. Despite the JeM being named in 2008, its leader has escaped designation, and earlier this year China put a “technical hold” on India’s request. That hold expires on December 31, 2016, but India has made it clear it is running out of patience.

Action delayed: envoy
Accusing the U.N. of working in a “time warp” permanent envoy Syed Akbaruddin told the General Assembly’s 71st session on November 8 in a stern statement that its workings were a “mix of ad-hocism, scrambling and political paralysis”.

“While our collective conscience is ravaged everyday by terrorists in some region or another, the Security Council gives itself 9 months to consider whether to sanction leaders of organisations it has itself designated as terrorist entities,” he said in a direct reference to the JeM leader’s case.

The National Investigation Agency (NIA) informed the Bombay High Court on Wednesday that it has “no objection” to Sadhvi Pragya Singh Thakur applying for bail in the 2008 Malegaon blasts.

Additional Solicitor General Anil Singh, appearing for the agency, made this declaration before a Division Bench of Justice Ranjit More and Justice Shalini Phansalkar Joshi.

Nisar Ahmed Sayyed Bilal, who was injured in the blast, wanted to file an intervention. She had earlier filed one before the special NIA court which was rejected. The court directed the agency to file a compilation of statements of all witnesses who had deposed before the NIA and the previous prosecuting agency, the Anti-Terrorism Squad (ATS). It adjourned the matter for hearing on November 29.

Changed circumstances
On August 22, Sadhvi had moved the High Court stating that the special NIA court had failed to take the changed circumstances between November 2015 — when her last bail plea was rejected — and June 2016 into consideration.

On June 7, the agency had told the NIA court that it had “no objection” to the bail plea. “Based on the charge sheet filed, we have stated that there is no case made out against Sadhvi,” the prosecutor had then said. “We have left it to the court to decide on the bail plea.”

However, on June 28, the NIA court rejected her bail plea.

On May 13, the central agency filed its supplementary charge sheet that dropped charges under the stringent Maharashtra Control of Organised Crime Act (MCOCA) against Pragya and 5 others. Sadhvi was charge-sheeted in 2009 by the Maharashtra ATS, which said her motorcycle was used to plant the bomb.

Home Ministry has given sanction to NIA to file a charge sheet against Jaish-e-Mohammed chief Maulana Masood Azhar and three others in the Pathankot terror strike carried out on January 2.

After receiving sanction under Unlawful Activities (Prevention) Act (UAPA), the NIA will name Azhar, his brother Rauf Asghar, and handlers of four terrorists -- Qashif Jan and Shaid Latif in the charge sheet to be filed soon, official sources said.

The four terrorists, after entering into India from Bamiyal area of Gurudaspur, had carried out the strike inside the strategic Pathankot Indian Air Force base killing eight people including seven personnel of IAF and NSG.

The fresh charge sheet will help India in building pressure on the international community to declare Azhar and his organisation a global terror group under the United Nations' anti-terror laws. The previous attempts were spurned after China exercised its veto power.

The charge sheet will name only four terrorists involved in the attack as against six claimed by the NSG.

According to the NIA, the terrorists, who were killed after two days of gunfight were identified as Nasir Hussain, Hafiz Abu Bakar, Umar Farooq and Abdul Qayum and they were residents of Vehari (Punjab), Gujranwala (Punjab), Sanghar (Sindh) and Sukkur (Sindh) districts of Pakistan respectively.

The NIA's probe will also included looking into the phone numbers and a conversation that one of the terrorists had minutes before launching the attack besides a video message of Rauf released on Jaish-affiliated website minutes after the strike.

In the video message, which was subsequently removed from the website, Rauf had claimed responsibility for the Pathankot attack.

The charge sheet will also include evidence of linking the footprints of one of the terrorists obtained from Bamiyal besides matching of DNA sample found from a soft drink can in the hijacked car of Punjab Superintendent of Police Salwinder Singh.

The Pathankot terror strike had seen a joint investigation team from Pakistan also arriving in India for carrying out a thorough probe.

However, upon their return, the Pakistani team claimed that India neither shared much of evidence nor allowed it to interrogate the personnel involved in repulsing the attack.

Don't know much about this Azhar character but on HS the case is basically closed....even the Americans have admitted they have no damning evidence implicating him in any terrorism cases. White House spokesperson Mark Toner is on the record stating this.

there is no "bounty" on HS either....a few international media outlets (including india's) didnt quite pick up on that

TTP has taken a thrashing since 2014 especially. Much of them are in Afghanistan now, a huge issue of contention between govts of Islamabad and Kabul.

Pakistan will do the needful. Assertiveness and keeping the enemy guessing is key to success.

But here its about the hijacking of plane and taking it to Afghanistan and releasing of Azhar Masood.

I am surprised that China will consent to this continued tarnishing of its name for this terrorist.
