China approves SCO anti-terror convention

  BEIJING, December 29 (ChinaMil) – At the ongoing bimonthly session, the 12th National People's Congress (NPC) standing committee members voted and approved the Anti-terrorism Convention of the Shanghai Cooperation Organization (SCO) on December 28, 2014.

  Apart from the prologue and epilogue, the Convention consists of 37 articles.

  The Convention defines related terminologies, including the connotation and denotation of "terrorism" and “terrorist activity", and makes clear and definite basic standards to identify "terrorist organization".

  The Convention sets down its scope of application and determines the judicial jurisdiction on the principle of combining the dependency jurisdiction with personal jurisdiction. The Convention lays down relevant measures to be on guard against terrorism.

  It stipulates that all parties shall make domestic legislations that hold the following activities as criminal offenses - terrorist activities, establishing legal entities engaged in terrorism, publicly instigating terrorism, recruiting and training personnel for terrorist purposes, participating in terrorist organizations, sponsoring terrorism, and assisting in terrorist activities.

  The Convention stipulates that all parties, according to their domestic law principles and through making laws, should monitor financial transactions and prevent and crack down on terrorist financing.

  The Convention provides the legal liabilities of legal persons as the entity of terrorist crimes and the applicability and procedures of extradition, transfer of jurisdiction and judicial assistance.

  The Convention sets down dispute settlement procedures and indemnifying measures of the Convention.

  The procedures concerning the Convention's validation, joining and amending the Convention, and denunciation of the Convention by constracting parties are also provided.

  Hu Jintao, the then Chinese President, and leaders of other SCO member states signed the Convention in Yekaterinburg, Russia, on June 16, 2009.

  So far, Russia, Kazakhstan, Kyrgyzstan, Tajikistan and Uzbekistan have completed their domestic approval procedures, and the Convention took effect since January 14, 2012.
