Attorney asks to bar Jews from Taliban trial jury

Lawyer for Muslim-American accused of lying about trying to join Pakistani jihadists does not want client’s anti-Zionism to sway jury

A Jewish attorney representing a suspected would-be terrorist in New York Federal Court has asked the judge to bar Jews from sitting on the jury, saying his client’s anti-Israel rhetoric may sway opinion.

Frederick Cohn, representing Abdel Hameed Shehadeh over charges that he lied to authorities about attempting to join the Taliban, is set to begin jury selection this week.

On Monday, Cohn was quoted in the New York Post as saying, “Given that there’s going to be inflammatory testimony about Jews and Zionism, I think it would be hard for Jews to cast aside any innate antipathy.”

In February, Cohn told federal Judge Eric Vitaliano that he was “not wild about having Jews on the jury in this case.” At the time, his request was blasted by federal prosecutors William Sarratt and James Loonam.

Sarratt told the judge at the time that he does not believe magistrate Judge Robert Levy, who will hear the case, “will be ready to violate the Constitution and exclude people from the jury on the basis of their religious beliefs.”

Ironically, both Cohn and Levy are Jewish.

Cohn acknowledged that his motion is unlikely to be accepted, but said that “sometimes you have to wield a meat ax.”

Cohn said that “the American Jewish community is heavily aligned with Israel and Zionism. Here is a guy who is a Muslim, who is opposed to those things.”

A 2011 poll conducted by the Abu Dhabi Gallup Center found that American Jews tended to sympathize with, rather than demonize, American Muslims.

The poll found that 80% of American Jews believe that Muslim Americans are loyal to the US, while 66% of the American Jews surveyed stated that Muslims in the US faced prejudice.

The same poll found that after Muslims, Jewish Americans were the least likely religious group to believe that Muslim Americans sympathize with the terrorist group al-Qaeda.

Shehadeh, who was born and raised in New York, is charged with three counts of making false statements to the FBI regarding a trip to Pakistan during which he allegedly attempted to join the Taliban, considered a terror group by the US State Department.

The trial will take place at the US District Court for the Eastern District of New York in Brooklyn. If convicted, Shehadeh could serve up to 24 years in prison.
 
A single event over the how many of the majority? I'm guessing the American citizen Anwar Alawaki would get a trial too, no? Oh wait, he was assassinated.

a Jewish attorney asking Jewish jury members to be removed - a proof that its not the religious sentiments affecting the professional duties here but rather the principles of law and respect for the wishes of defendant with in the norms of law.
 
it's a request made the [jew] lawyer on behalf of the defendent to the court in question.....what's the need to report it here?

by the way - where is this man from? Is he Palestinian origin by any chance? He's definitely not Pakistani. If he's Palestinian origin, who knows maybe he's anti-israel but not necessarily anti jewish per se

but an often utilitarian tactic by certain lobby groups is to label anti - israel sentiment with anti-jewish sentiment (anti-semitic is used though how can Arabs be anti semitic - makes no sense)

If he has any skepticism about Jews, who are more prone to give fav judgement than local Americans. This fellow is digging his own grave. The trial can not be outsourced to Saudi anyway. On the other count, NYC is multi culti society, where Sikhs and Hindus could be a probable jurors. Shall they be struck down ?

Well that is a contempt of constitution where everybody is equal.

We are waiting for an interesting times, as the OBL's son-in-law's trial will begin too.

While the request has been made in accordance with procedure, question is, is this tenable?

Can a black man ask all whites to be removed from jury because he intends to make a speech against the white race? Can a wife killer ask women to be removed because he's going to tell the court how horrible women are? Can a Muslim tomorrow ask all non-muslims to be removed because he's going to recite his childhood indoctrination in public???

The request reeks of the kind of thinking that makes terrorists. Do not see how that deserves respect let alone legal recognition.
 
The defendant should ask for a better lawyer to represent his case. This Cohn clown sounds like an amateur; any competent defence attorney would have weeded out problematic jurors without making his hidden reasons known.

It's the difference between what things are and what they are called. You WANT to believe America is "barbaric" but you know that is not true - while you know from the headlines that Pakistan is. But that in itself doesn't necessarily make me a better or worse person than you. I'm living in a society where the justice system works pretty well; I'm not going to be faced with the issues a Pakistani has. Yet, you might want to un-deceive yourself about America. That way you'll be better prepared to make good choices for Pakistan if you ever get the opportunity to do so, yes?

Cohn doesn't sound like a clown, but he does sound a bit amateurish in his request that ALL Jews be banned. I think the British and American justice systems diverge when it comes to jury selection. Americans are much more open about claiming certain groups or individuals should be excluded for such-and-such a reason and judges often accept this.

Yes, he's of Palestinian Arab descent: link. What does that have to do with being anti-Israel or anti-Jewish here? It's Pakistanis who he was planning to victimize because "if he died as a martyr in Pakistan he would have received 72 virgins as a reward."

He has turned this into a racial issue, rather than an ideological issue.
