Another PML-N MP faces land grabbing charge in Islamabad

After causing political demise of Anjum Aqeel Khan, land grabbing allegations are haunting another PML-N legislator from the federal capital.



He is accused of re-selling a huge swath of prime land worth around Rs1 billion to the Naval Housing Scheme without buying the land from the original owners.



The affectees of the village Maira Begwal near Bhara Kahu in Islamabad have moved a local court alleging that the ruling party MNA Dr Tariq Fazal Chaudhry had deprived them of 350 kanals land and sold it to a posh housings scheme run by the Pakistan Navy.



The court of Civil Judge Sanam Bokhari has already issued restraining orders against the illegal dispossession of the affectees by the MNA and Pakistan Navy.



However Dr Tariq claims he has legally purchased 1056 Kanal lands in the area and only defaulted on the payment for 330 kanals of land as sellers had failed to provide him with the possession of the same.



When contacted, a spokesman of Pakistan Navy told ‘The News’ that the land was purchased from the MNA after ascertaining documents and usually the land under litigation is not bought by the Pak Navy.



“If it is proven that the MNA had sold us a contentious land without legal right, our deal will be cancelled automatically under the agreement signed between the MNA and Pak Navy,” the spokesman further added.



The land is now being developed for Naval farms and the average price of a 5-kanal farm is Rs15 million while a 7-kanal farm is being sold for around Rs 21 million.



Documents available with The News show that Dr Tariq signed three agreements with the owners of the land but he failed to fulfill all the terms of these agreements. The former MNA signed the first agreement with the owner Sardar Mohammad Azhar for the purchase of 800-Kanal land on 5th September 2003 but only managed to pay for 400 kanals within the stipulated time. Subsequently another agreement was signed between the two parties on May 6, 2004 but that too could not fully materialised.



Finally yet another agreement was signed between the MNA and Sardar Mohammad Azhar on September 22, 2006 for the sale of remaining 350 kanals of land. The agreement also mentioned Raja Subeh Sadiq, Raza Ahmad, and Ghulam Hussain, Sardar Ikhraj Abbasi as co-owners of the land along with Azhar. Dr Tariq was supposed to pay Rs165,000 for each kanal of the land. He agreed to pay Rs3 million in advance.



However two of the cheques issued by the MNA for this purpose bounced. Dr Tariq issued cheque No 2820489 in favour of Azhar amounting to Rs1.1million drawn at Union Bank, Awan Arcade Islamabad but the same was returned by the bank on 11 December 2006 with the remarks ‘Insufficient Balance’. Another cheque No 2821805 issued by the MNA in favour of Raza Ahmad Abbasi was also returned by the same bank with same remarks.



Meanwhile, Chaudhry got elected on a national assembly seat from Islamabad in 2007 elections and things started to change. According to affectees, the newly elected legislator refused to make any payments for their 330-kanal land as per agreement. The owners of the land cancelled the deal and inform the MNA through legal notice about the cancellation but he did not bother to respond. Later the affectees got the information that Dr Tariq is trying to sell the land to Pakistan Navy for its housing scheme. They published advertisements in national dailies to forewarn the buyers but could not stop the illegal sale of the land. Some of the affectees who are living abroad have written letters to the President, the Prime Minister, CM Punjab and the Chief of Naval Staff but to no avail. Finally they moved the local court and got the stay order.



When contacted, Dr Tariq said he is doing the real-estate business in the area for over a decade. “I have established a company along with some partners and the company purchased around 1056 kanal land in Maira Begwal after payment of price,” he said



The MNA said he had documents proving the ownership of the said land. “We are not land grabbers! We do business. We did sign the agreement with Azhar and other for purchase of 350-kanal land in 2006 but the other party could not provide us the possession of the land,” he said.



His cousin and partner Riffat Chaudhry said the cheques paid by Dr Tariq bounced because the other party could not prove their ownership on the land.



Both Tariq and Riffat said they will abide by the court’s final decision on the dispute.
