BJP MP RK Singh "If anybody helps a 'bhagoda' (fugitive), it is wrong. This is wrong legally as well as morally. If anybody meets a fugitive, it is absolutely wrong. Whosoever has helped him, I think it is completely wrong," Singh, a former Home Secretary, told reporters here.

He said Lalit Modi had been evading judicial warrants and summons and he was clearly a fugitive and any help given to him or any meeting with him was wrong.

Asked if Lalit Modi was being "saved", Singh said the departments concerned should be doing their job.

"I have given my view," he said when asked about BJP's defence of both the leaders and added that he would not like to name individuals.

Singh said the government should appeal against the Delhi High Court order which restored the former IPL commissioner's passport and demanded that his property should be attached, if needed.

"All measures should be taken to bring him back to India so that he faces the law," he said.

New Delhi: In a major development, the Special Investigating Team (SIT) probing the black money case, on Tuesday asked Enforcement Directorate (ED) to give details of its probe into a foreign exchange violation case against former Indian Premier League (IPL) boss Lalit Modi, which involves alleged illegal routing of Rs 21 crore funds from a Mauritius-based company.

Official sources said the case pertains to the routing of the amount a few years ago into a firm said to be owned by Modi which is based in Rajasthan and has a branch office in the national capital.

Congress-led UPA govt never approached Interpol to seek Lalit Modi's deportation: Reports | Zee News


Modi had fled India in 2010 after a number of cases including of corruption were registered against him. His passport was revoked and a DRI blue notice was also issued against him.

However, the central government led by then prime minister Manmohan Singh failed to approach the Interpol - the international agency mandated by the United Nations to coordinate against transnational crimes and fugitives – for Modi's deportation from the UK where he started living after fleeing India.

An English news channel yesterday quoted former Interpol Secretary General Ronald K Noble as saying that the Indian government had never approached the international police agency to issue any notice against Lalit Modi.

Experts say the UPA government could have approached Interpol to issue a red corner notice (RCN) and seek Modi's deportation.

Interpol member states have an obligation to locate, arrest and deport an accused against whom an RCN is issued. Interpol's RCN is currently valid in at least 190 countries.

Union Finance Minister and Bharatiya Janata Party leader Arun Jaitley on Wednesday defended his government, saying that the administration will play by the rulebook and make sure absolute standards of probity are maintained.

While addressing a press conference, Jaitley said that his government has done no wrong and there is no question of being on the back foot in the case.

Former IPL commissioner Lalit Modi on Sunday had trained his gun at Jaitley for his links with former BCCI chief N Srinivasan and the DDCA scam.

Despite levelling allegations against several politicians and media barons, Modi's main target, as he admitted, was Jaitley.

The controversial cricket administrator questioned Jaitley for backing the ICC chairman despite overwhelming evidence pointing towards his conflict of interest in the BCCI and IPL.

The 'Lalitgate' episode has brought the ruling BJP in the line of Opposition's fire.

New Delhi: The Enforcement Directorate (ED) has widened its probe into a foreign exchange violation case against former IPL boss Lalit Modi and others which involves alleged illegal routing of Rs 21 crore funds from a Mauritius- based company.

The agency, as part of its FEMA probe, has written to agencies like the Income Tax department, RBI and the Registrar of Companies (RoC) to obtain detailed information about the operations of the Rajasthan registered firm, said to be owned by Modi and his family members.

Sources said the agency may also get in touch with their counterparts in Mauritius to obtain details on the incorporation of a suspected firm there which allegedly sent funds to the Indian company.

At a later stage, they said, the agency may obtain a Letters Rogatory (judicial overseas request) from a court to get the records.

The case pertains to the routing of the amount a few years ago into this firm in alleged contravention of the Foreign Exchange Management Act (FEMA).

The sources said the present and past executives of the said firm would soon be called for questioning and even Modi could be served summons at a later stage for recording of his statement.

The ED had begun investigations into this case in October last year after it detected some foreign investment coming into this group which had Modi's relatives at the helm.

But in 2007, the sources said, the former cricket czar took over the directorship of the company along with his wife.

The agency has already recorded the statements of few executives of the said firm.

The sources indicated it is unlikely that the ED could file a criminal case of money laundering in this deal as there is no schedule offence committed under IPC, a basic requirement for registering an FIR under the Prevention of Money Laundering Act (PMLA).

They said the agency's probe is focused to check if RBI guidelines or the provisions of the FEMA were violated in this transaction.

The authorities in the central probe agency are already going through the record sheets and bank documents of the firm and the one located in Mauritius in order to take forward the probe.

The ED, the sources said, had told the Delhi High Court early this year that they were probing the case under FEMA and not under the criminal charges of the anti-money laundering Act.

New Delhi: Former Indian Premier League (IPL) chief Lalit Modi on Wednesday said he signed the Kochi franchise bid under pressure.

"I signed the Kochi bid under pressure minutes," Modi tweeted on Wednesday.

Along with the tweet he attached a letter where details of the insights of the meeting during the Kochi bid on April 11, 2010 at 12 a.m. were mentioned.

According tho the letter, the persons present at the meeting were, Lalit Modi (Chairman IPL), Akhila Kaushik (Legal Advisor, BCCI), Sundar Raman (COO,IPL), Shailendra Gaikwad (Rendevouz Sports world Pvt Ltd), Mehul Shah (Anchor Earth Pvt Ltd), Chintan Vora (Anchor Earth Pvt Ltd), Vipul Shah (Parinee Developers & Properties Pvt Ltd), Saket Mehta (Anand Shyam Estates & Developers Pvt Ltd), Kailash Singhal (Filmwaves Combines Pvt Ltd), Vivek Venugopal and Keshav P T (Filmwaves Combines Pvt Ltd).

The minutes of the meeting with bidder of Kochi Franchise as given by Modi are as follows.

The meeting was called to validate and authenticate the bid documents related to the Kochi Franchise (unincorporated JV) bid. The documents submitted on the day of tender opening in Chennai was found to restrict the liability of the owners in the shareholders agreement and the chairman had asked for submission of all valid documents in the presence of all owners.

The Chairman stated to the consortia of owners present that he had received a call from Shashi Tharoor, union minister of state for external affairs, asking him not to probe into the identity of Sunanda Pushkar, one owners listed in the shareholders agreement.

The Chairman stated it is the responsibility of the BCCI-IPL to ascertain the identity of all the owners in order to maintain the integrity of the league and that of BCCI. He went on to ask the following to Gaikwad, one of the owners of the consortia

Declare the identity of the owners listed - Puja Gulati, Sandeep Aggarwal, Vishnu Mohan Prasad and Sunanda Pushkar. Gaikwad replied Sunanda Pushkar was a family friend living in the state of Jammu and Kashmir. She is a housewife and that her husband is in the auto industry. He also said one of the others was a friend from Silicon Valley and also mentioned Puja has done her MBA. However he did not know any more details and assured he will send an e-mail with the details within 24 hours.

The Chairman further probed if there were any direct or indirect ownerships or connection for any of the owner members with any politicians, current or past sportsmen. Gaikwad in reply called his father on the phone to clarify the same and responded stating that his father said he would call him back with the details.

Within a couple of minutes, the Chairman received a call from Shashi Tharoor on his mobile phone asking why he was asking the connection link of the owner related to Pushkar.

The chairman though did not have to respond, informed Tharoor that it is BCCI-IPL`s regulations to check the credibility of all investors and will further investigate if there was any linkages with any unidentified investors. He said if any of the owners were found to have any linkages, the BCCI-IPL will have the absolute rights to terminate the agreement under the clauses as applicable in the ITT.

The chairman further advised the consortia members that the details related to player regulation, retention and home ground for the Kochi franchise will be briefed at a later time

The chairman signed the agreement reserving all rights to exercise as per the ITT and franchise agreement.

Lalit Modi row: Is game over for Vasundhara Raje following fresh exposé? | Zee News
On Wednesday, the Congress released a signed statement that was submitted in a UK court in 2011 and in which Raje supports any immigration application by Modi.

As per the documents released by Congress leader Jairam Ramesh yesterday, Raje - in the witness statement submitted in the UK court in 2011 - had backed the immigration plea of Lalit Modi contending she had no doubt that the frontal attack he was facing in India then was "politically motivated".

"Given my close understanding of, and involvement in Indian politics, I have absolutely no doubt that the broad, full frontal attack that Lalit is currently facing in India is politically motivated," she had said in her witness statement before the British authorities.

She insisted that the Congress party was "destroying" and "discrediting" Modi.

"In the course of doing so by virtue of my association with him, they hope to politically discredit me as well," she said in the witness statement given on August 18, 2011.

The Rajasthan Chief Minister said the information contained in the statement was "true, correct and accurate" to the best of her knowledge and belief.

The statement had a 'confidentiality notice', insisting that it is provided on the "strict understanding that its contents and the identity of its maker are treated confidentially and that it is used only for the purposes stated in it".

"I make this statement in support of any immigration application that Lalit Modi makes, but do on a strict condition that my assistance will not become known to the Indian authorities," Raje, who gave this undertaking as the then Opposition Leader of Rajasthan Legislative Assembly, said.

In the statement, Raje said she was also aware that Modi, in the context of his role as IPL founder and chairman, had major run-ins with prominent Central government ministers.

"I will not comment upon those conflicts as they have never involved me directly. What is clear, however, is that they have only served to exacerbate Lalit's difficulties with the ruling Congress party," she said in her witness statement.

After releasing the document, the Congress yesterday said that Raje stood "exposed completely" while batting for a "fugitive".

It further accused Raje of "repeatedly lying" and demanded her immediate resignation.

"The curtains are off, the secret is out. The document signed by Vasundhara Raje dated August 18, 2011 supporting his immigration case before the British government is out. When the issue came out first, she feigned ignorance and then said she does not remember," Ramesh told reporters at an AICC briefing.

"BJP has always maintained that if papers are produced with her signature, then she is culpable. There is no need of any more evidence, Vasundhara Raje stands thoroughly exposed," Ramesh said.

Ramesh said the Congress seeks her immediate resignation as she has broken four laws - Indian Penal Code, Prevention of Corruption Act, PMLA, Passport Act, while batting for a "bhagora" (fugitive).

Displaying the seven-page document having 21 points, he said, "This has never happened in independent India before where a former Chief Minister and Leader of Opposition has batted for a fugitive".

Hitting out at Prime Minister Narendra Modi, Ramesh said, "The government which advocates propriety and zero tolerence to corruption should immediately seek her resignation. The Prime Minister who used to speak so much on these issues one year back has been silent and has gone into a shell".

With the Lalit Modi controversy snowballing into a bigger row by the day, Ramesh also demanded the resignation of External Affairs Minister Sushma Swaraj, who had helped Modi secure travel documents for him in the UK.

The BJP reacted with caution, with its spokesperson Sambit Patra saying the party "will not run away" from the issue and look into the new disclosure.

"We will not run away... The party will do whatever is necessary to see to it that truth comes out in the open," Patra said.

Sources meanwhile said the BJP has given Raje an ultimatum of 24 hours to explain he rolw following the fresh expose.

New Delhi: Rajasthan Chief Minister Vasundhara Raje on Thursday reportedly admitted to the top Bharatiya Janata Party (BJP) leadership that she supported former IPL chief Lalit Modi's immigration application in the UK along with a condition that the same should not be revealed before the Indian authorities, sources told Zee Media.

As per sources, Raje admitted that she signed a statement submitted in the UK court in 2011, which said she backed any immigration plea of the former IPL commissioner.

Meanwhile, Raje, who is scheduled to visit Delhi on June 27 for a meeting of the Niti Aayog, has not been asked to resign so far, IANS reported BJP sources as saying.

According to agency reports, Raje is digging in her heels and has signalled that she would not resign on her own. The Rajasthan CM has also indicated that she had support of the vast majority of BJP legislators in the state as well as MPs.

Also, the BJP leadership has decided to back Raje for now even after she reportedly conveyed to party leaders that she had testified on Lalit Modi's immigration application document in the UK.

Raje met some party legislators yesterday, while her office accused some TV channels of "constantly running" baseless and false news on her alleged links with Lalit Modi.

I think PM Modi Government will work to bring back Lalit Modi back to India and press for his extradition.

As per British rules, Modi's Tier 1 (Investor) visa entitles him to stay in the UK for an initial period of three years with a possible two further years if he continues to meet the requirements of a minimum investment of 1 million pounds. Based on his qualification of two years continuous residence in the UK and an investment of 10 million pounds, would have qualified Modi to make an application under what's called the accelerated route to settlement for "ndefinite leave to remain" in the UK. In fact, Modi did try to take advantage of this scheme but it was rejected by the UK Home Office. Modi had appealed against this and at the same time applied for the Black Certificate of Travel with a little bit of a nudge from the Indian Foreign Minister.

Lalit Modi passport was revoked but it was reinstated after he got British travel document.

Technicalities seemed to be the UPA specialty, they hid behind that even as their image was being torn to shreds & they continued their long march to the electoral graveyard. Now the BJP.....

Sometimes, the more things change, the more they remain the same..... (not suggesting the scandals are the same but the reaction undoubtedly is....)

Surviving the Lalit Modi storm: PM Modi can pull up Sushma Swaraj, but not Raje

  • Narendra Modi's political opponents and even the media are dealing with the fallout of the Lalit Modi affair. As things stand now, Lalit is a fugitive and all those who helped him can be said to have aided someone whom the law enforcement agencies are probing.

    That Lalit Modi is linked to politicians in every major party is something no one wants to discuss - since it does not help put the BJP and Narendra Modi is the dock. The unstated goal is to use Lalit Modi to embarrass the PM, and this is why no one wants to talk about all of Lalit Modi's other linkages. The simple fact that no help was sought from Interpol for his arrest and extradition should put us out of any doubt. The only thing the UPA actually did was to warn the UK government that helping Lalit Modi would be seen as an unfriendly act.

    This may merely mean that the BCCI bosses who ousted Lalit from the IPL were in cahoots with the Congress so that their control of the world's most cash-rich cricket club can be consolidated by keeping Lalit's hands out of the cookie jar. The chances are the UPA merely wanted Lalit out of India, and not back here to face the music since it would incriminate many others. It is worth noting that the current IPL boss is the Congress' Rajiv Shukla.

    The brouhaha about Lalit Modi is thus a godsend for those who want to bring Narendra Modi down several notches - both rivals outside the party and inside it.

    But this does not mean all criticism of the Prime Minister is motivated. There are genuine reasons for him to take a stand after the facts are ascertained.

    There are three basic things the PM is being pilloried for.

    One, he has chosen silence over action so far in the Lalit Modi affair, even though it involves a cabinet colleague (Sushma Swaraj), who facilitated the issue of travel documents by the UK government.

    Two, he has not acted against Rajasthan CM Vasundhara Raje - especially after a document surfaced bearing her signature backing Lalit Modi's residency in the UK - and there is some evidence that Lalit Modi invested in the shares of Raje's son's company at inflated prices.

    Three, more recently, Smriti Irani has also got into hot water over her claims in an election affidavit in 2004 that she had completed her BCom, when she had only completed part I - something she seems to have corrected in two later affidavits in 2011 and 2014.

    The English language media, which has never asked Sonia or Rahul to speak up on various improprieties and illegalities they are indirectly or directly responsible for, now wants the Prime Minister to speak up everyday.

    Sure, Narendra Modi must make his views clear, but premature statements at a time when the facts were far from clear would have been politically foolish. In a 24x7 media news cycle, statements made in the morning can look foolish in the night. So I would certainly not fault the PM for not rushing to make statements. The only statement that could have been made was something that ran like this: "We are ascertaining the facts, but I will assure you that the law will be upheld without question." No one would have been happy with that, and so Modi was right to not speak up earlier.

    The time to break the silence is at hand, and Modi should now speak up - and act.

    But here nuance is important. The PM can speak and act when it involves his own cabinet colleagues - Sushma Swaraj and Smriti Irani - but not the Rajasthan CM. In a federal polity, it is not the job of the PM to act against Chief ministers, who are independently elected and accountable to the electorate and the law separately. The fact that Raje belongs to his own party does not over-rule federalism. Just as the PM cannot act against Akhilesh Yadav for the unspeakable things happening in UP, or against Mamata Banerjee for the violence and scams in her state, he cannot do so against Vasundhara Raje either.

    Amit Shah as BJP president can ask her to resign, but even he cannot tell the Rajasthan legislature party what to do. It is Rajasthan's BJP MLAs who have to act, if that is what they want to do. The fact that Amit Shah is close to Narendra Modi should not blind us to the reality that the PM cannot be the one to question Raje's actions. His only job is to ensure that the law is followed by his enforcement officials. The battle for Raje's ouster has to be fought in Jaipur, not Delhi.

    Prima facie, putting the allegations in perspective, this is what seems plausible: Sushma Swaraj seems to be guilty of an impropriety in helping Lalit Modi; Smriti Irani told the Election Commission a lie about her BCom degree in 2004 but has now corrected herself; and Raje seems likely to be in the dock for questionable dealings involving her son, not to speak of helping Lalit Modi in the UK.

    The PM can publicly reprimand Sushma for her eagerness to help Lalit by flouting established norms; he can ask Smriti to stay out of the cabinet till she clears her name with the court. What he cannot do is act against Vasundhara. It is not his job to do that.

    The PM is responsible for what happens at the centre, not the states.
