No I just shared my opinion. Like you lot do in India related threads. In both threads we get the abuse. Specifically in these threads, we are not even allowed to have an opinion. If we do, mods check, not whether I broke any rules, but whether they like my opinion or not. So I keep it to a minimum.

Well thanks for the opinion. No the military is not running Pakistan. It is being run by a psychotic manchild and trust me that can only mean bad for India in the long run and the short run.

The extension of the chief's tenure is something that's more of a structural requirement than a political move as it is wont to be seen by most people because they are unaware of the technical requirements for it.

Pakistan has potentially 4 active fronts to look at. It needs its military force to be flexible enough to deal with a multi-front situation. Therefore, her law needs to empower the forces to do so. There are many occasions in which an inept or outdated law has placed bureaucratic hurdles for us. This step in needed to address that lapse.

Secondly, please, read up on what the military doctrine says about change of command. It should be avoided when there is a potentially active threat present, such as what happened when IAF came to strike and had to be dealt with. It is not simply the change of one man, it is the change of an entire team; handing over command, restructuring the organization and all of this takes time. The military is a huge organization and absorbs change slowly, this is true everywhere and especially so in third world countries where we cannot always afford to have the luxury of replacements ready.

Thirdly, these powers were already existent in the law, age relaxation and extension but with the President (due to Pakistan's history of swinging between a Presidential and Parliamentary de facto rule). They have just been granted to the Prime Minister's office (even though there is an understanding that the President would not veto the PM's nomination but it isn't explicit and has been used before as a threat especially in the 90s).

Fourthly, PML-N and other opposition parties are not doing anything new. They realize this move is necessary and , in fact, even empowers them because when they take power through elections which they can win, if they perform right or campaign right, then they'd have their say in such matters. However, it is not in Pakistan political life's tradition to admit compromises and cooperation in order to strengthen the system, instead, we would much rather focus on political point scoring and bending the narrative to fit political power struggles.

Interestingly enough, the new law, itself, has started to generate juristic controversy. While it retains the prime minister’s constitutional right to appoint the army chief, it allows a degree of discretion to the President of Pakistan in according re-appointment or extension conditional to requirements of “national security” or similar “exigencies”. Some eminent legal eagles claim this Presidential discretion is unconstitutional and the law can therefore be struck down by the superior courts, unless the constitution is appropriately amended. This possibility might help explain why the government has simultaneously appealed the original SC decision that compelled it to amend the law relating to this issue. It fears that if the new law is examined under the spotlight and context of that decision and the various remarks of the judges, it could be found to be wanting or misplaced in more ways than one. Therefore, fearing the new law’s vulnerability, the government has sought a “stay” from the SC whilst requesting a bigger bench to hear the appeal.

So, if writs begin to fly, the “crisis” of the army chief’s extension could linger on.

These are the two most important take aways from the article. Judiciary can still insist on a conditional amendment rather than a bill, and that too it could take issue with the nature of the existing bill.

And IK is in power right now but that can change. If he goes before the next election, everyone should understand, it won’t be the opposition who’ll be responsible for having him removed, it’ll be the selectors.
