Alabama woman who joined Islamic State seeks return to US

This trend seems pretty popular these days.UK,Bosnian and now US females who went to marry terrorists wanting to come back to civilization. In my opinion they are a potential threat to a normal society and as such should be left right where they are, after all they chose to go there themselves.

Interesting Take from Pompeo

Secretary of State Mike Pompeo says Hoda Muthana, the young woman who is trying to come home after she fled Alabama for ISIS, is not a U.S. Citizen, according to a report from ABC News.

Pompeo said Muthana has no “legal basis” to claim American citizenship, the AP reported.

“Ms. Hoda Muthana is not a U.S. citizen and will not be admitted into the United States,” Pompeo said. “She does not have any legal basis, no valid U.S. passport, no right to a passport nor any visa to travel to the United States.”

An attorney for the woman's family, Hassan Shibly, said the administration's position is based on a "complicated" interpretation of the law involving her father.

“The Trump administration continues its attempts to wrongfully strip citizens of their citizenship,” Shibly told AL.com. “Hoda Muthana had a valid US passport and is a citizen. She was born in Hackensack, NJ in October 1994, months after her father stopped being a diplomat.”

Most people born in the United States are accorded so-called birthright citizenship but there are exceptions.

Under the Immigration and Nationality Act, a person born in the U.S. to a foreign diplomatic officer is not subject to U.S. law and is not automatically considered a U.S. citizen at birth.

He is simply wrong. She has been issued with US passports previously. Her father had left diplomatic status about a month before she was born.

. . .
in that case she gets to rot in maximum security prison for rest of her life
If prison is the result, most likely it will be minimum security because she will have a lot -- and make no mistake about it -- of support for her case. Nevertheless, a US prison life will still be better than wherever she is now. Three squares and a cot. Shelter from the weather. Maybe an occasional prison catfight but essentially she will be safe. She will be a celeb, even if just a minor one. A book deal along with an accomplished ghost writer are practically inevitable. No, in many respects, she will have a better life than you and at your tax dollars.

Best to deny her return.

Trump does not have the legal authority to strip her of citizenship. He can however void her current passport without which she may not be able to travel.

Her pleading for return and getting stuck in Syria is good enough.
If her US citizenship is valid, she is legally entitled to return. Of course, her return must conform to all appropriate legal procedures. Unfortunately, we do have some incompetent bureaucrats in government. Paperwork can be misrouted or even (gasp) lost. Missed phone calls. People overworked and tired. Printers out of ink and the technicians are on strike. Anything and many things could happen. :enjoy:

Right now the situation is limited to the middle east. The return of Ex-ISIS participants to their countries of origin could spread this evil globally. Everyone needs to take extreme caution while allowing these miscreants back.

That's what the father says but according to State Dept. they were not notified of change of status until months after the daughter was born. So she's not a U.S. citizen and may have been issued a U.S. passport by mistake.

Obama's administration actually filed the first court brief claiming that her citizenship was invalid on these grounds but the matter was not tested by due process, which seems likely now.
