So yes it is first established in courts that one is a thief or not

Those who caught him "red handed" had no authority to kill him or to lynch him or to ask him to chant "jai shree ram"

And yes that is how things work in any civilized society

Thieves are routinely beaten in India when they are caught by the public.

Its part of their job description and job hazard.

I bet same is true for pakistan and china too. Its true for most ancient civilized nations.
