This is such a stupid piece. If there is an agreement that Indian & Italians will serve their sentences in their respective countries, it would apply to all, numbers be damned. Any other Italians in an Indian prison will get the same benefit. This is not about trading prisoners by numbers.

They can be exchanged only if they were arrested for non-serious crimes, otherwise Italian marines should be sent to jail......No exchange whatsoever.

The problem appears to be something else.

When those 109 prisoners come to India, they will invoke their fundamental rights and Indian law cannot touch them on the basis that they did not commit any crime in India. The same goes for the Italians in their home country.

That's not how it works. You need to take responsibility of the people of your origin in as many situations as possible. Chinese have a policy of not extraditing any citizen under any circumstances ever- if they commit a crime and end up in chinese soil, it's chinese courts that try and sentence them. 'Tax Payer Money' doesn't count much in these circumstances.

It does not work the way you describe it, it might not.
Have you seen the treaty text between the two?

The Indians should be repatriated to Indian prisons only if they were convicted for non serious offences. Otherwise they should remain in jail in Italy.
