1960 Chinese map depicted Senkakus as Japanese territory

The China bashers like to use the argument that we don't want to take the case to UN to solve the dispute. First of all Japan doesn't want to take the case to UN (China isn't forcing Japan either). Secondly you don't hear these bashers taking the Japanese side when the Japs are having disputes with South Korea and Russia regarding Dokdo and Kuril islands. They don't bash Russia or South Korea either for not taking the case to UN or that they twist historical facts and that these islands belong to Japan. I believe it was Japan who rejects taking the Dokdo case to UN and want to handle it bilaterally.

Do you even know about the so called "international laws"? Go back to learn some history articles before you slap yourself. Here are some keywords for free in case your ignorance leads you nowhere after all... “World War II”, "Cairo Declaration", "Potsdam Declaration".
India always maintained that the disputes of SCS and east sea should be solved peacefully and according to international maritime laws.

According to that position of India spratleys and parcel islands should belong to Vietnam and Phillipines respectively.

Chinese always think of some facts which are rosy in the past and forget the glorious past of others. If China can assert the claim on Senkaku with some maps of Japan at the end of 19th century why not Japan.

Fact is China is claiming those Islands from 1970 onwards and after UN found oil reserves there, But the recent evidences shown by Japan nails that Chinese are laying claims based on twisted facts.

If China wants to bully its neighbors and wants to settle the disputes on its own terms first it has to get out the UNCLOS agreement and show to the world how much respect it has for International laws.

But again doing it, will make it a bully and an aggressor.

Regarding bullying of China in Asia we might see some military alliances in future, so no worry :agree:

According to Japan's Fuji TV and other media reports, in order to avoid irritation between the two governments of China, Japan and the United States intends to cancel the military exercises scheduled for November uninhabited island of Okinawa at a joint seize the island.

Japanese media quoted government relations by saying "It is the intention of the Prime Minister Noda, once the implementation of the exercise is bound to cause strong reactions from China due to the sensitive issue of the Diaoyu Islands.

Meanwhile, the U.S. military Osprey aircraft into the Okinawa Futenma base, a few months since local anti U.S. military base emotions continue to intensify. (Reuters) - China's navy and civilian maritime patrol vessels practiced on Friday stopping "illegal entry" into Chinese waters in the East China Sea, state media said, an area where Beijing is embroiled in a territorial dispute with Japan.

State news agency Xinhua said the drill was the largest in recent years, made up of 11 vessels, eight aircraft and more than 1,000 sailors.

While the report made no mention of tensions with Japan over a group of uninhabited islands in the East China Sea, it left little doubt the maneuvers were aimed at sending a message to Tokyo.

"The drill included simulations of illegal entry, obstruction, harassment and intentional interference by foreign vessels when Chinese ships of the fishery administration and marine surveillance agency patrolled," Xinhua said.

The exercise, it said, "was aimed at improving coordination between the navy and administrative patrol vessels, as well as sharpening their response to emergencies in order to safeguard China's territorial sovereignty and maritime interests".

Japanese Defense Minister Satoshi Morimoto, quoted by his ministry's Internet site, said he would not comment on the nature or purpose of the exercises.

But he added in comments to reporters: "Regardless of their activities, we remain vigilant in the waters and airspace where our country is in charge."

Chinese fishery patrol ships and Japan's coast guard have faced off in recent weeks in the seas around what China calls the Diaoyu Islands and Japan the Senkaku islands. Taiwan also claims them.

Violent protests and calls for boycotts of Japanese products broke out across China in mid-September after Japan bought some of the islets from their private owner.

TOKYO: Five Chinese government ships were seen sailing close to Tokyo-controlled islands in the East China Sea Saturday, prodding Japanese patrol boats to chase them away from the disputed chain.

It was the first time in 10 days that state-owned Chinese ships were spotted near the islands as bad weather had prevailed due to a powerful typhoon passing through.

Japan's coastguard said its patrol boats were warning the Chinese vessels "not to violate territorial waters" and keeping them under surveillance off the island chain, known as Senkaku in Japan and Diaoyu in China.

Despite the warnings, one of the surveillance ships responded by radio in Chinese, "This ocean area is integral part of China and we are carrying out legitimate operations," according to a coastguard official.

Such vessels have been spotted loitering in waters off the islands as the dispute has escalated over the last two months, with boats at times entering a 12-nautical mile territorial zone.

Tensions peaked in mid-September after Tokyo nationalised a number of the islands.

The coastguard said it had spotted four Chinese maritime surveillance vessels sailing 24 to 35 kilometres off Uotsurijima -- the largest island in the chain -- in the morning.

It added that a Chinese fisheries patrol boat was also spotted about 42 kilometres off another island, Kubajima.

The five ships were located within the so-called 44-kilometre "contiguous zone" where the coastal state may exercise the controls necessary to prevent and punish infringement of its customs, fiscal, immigration or sanitary laws and regulations within its territory or territorial sea.

i was watching the whole thing unfold in Sweden........
I remember i was thinking, man, why don't anyone of them resolve it using International court? Do you really think who had a bigger mouth would win the Island on the back of their throat?

The problem, as i see is, the relationship between China and the Island and between Japan and the Island were not clear.

Someone (I forgot who, if you want yo ucan check previous post) said if you only claim historicality, then you can get the "Winner takes all" Situation and China can claim west up to turkey and north up to southern Russia and east up to the whole korea as they were all ont time or another governed by the Chinese. But International Law does not work that way.

On the Law of Sovereignty lay out by the United Nation (or officially know as United Nation's Public International Law Forum) to claim a sovereign of a land mass there are 4 step one entity have to fulfill. Those 4 points are.

1.) The land must be originally uninhibited (Casus Terra nullius - Case of land belong to no one)
2.) Must be within 200 nm of EEZ (except ceded by treaties)
3.) Must establish settlement
4.) Must establish physical occupation (By direct governing or annexation)

The problem with, if we follow this law (Which we should as this is a UN Law Forum) China or People Republic of China actually do not have the right to claim the Island, as it violate the rules number 2, the island does not lie within 200 nm of Mainland China. It does, hoever, lie within 200 nm of Formosa, which is current day Taiwan. If you look at all the dispute document, you can see that PRC was actually contesting the island "On behalf of Taiwan" as it claim the local governance to Toucheng, Yilan County, Taiwan Province (You can serach the article of claim on any public forum as i cannot use link under 15 post i can't post them.........)

What it said is, even if Chinese have won the case, the control to the island will go to Toucheng, Yilan County, Taiwan. And well, what i currently know is, unless China move on to control Taiwan otherwise China will never control the island as we speak. And that is, if they won the case.

According to the UN international Law, one must administrate control on a landmass when first spotted it to claim or own the sovereign, the problem is, no one on either side (China or Japan) have made any survey to the island before the actual occupation happened to the Japanese in 1895. You cannot just call dips on the island. Unless Chinese can show they have a effective government on the Island before the Japanese have them on 1895, the rightful owner will be theirs.

What China need to do is, petition to the UN (Which they did) and then have the UN Send an Archaeological team to survey the island, if they found any effective settlement that can be dated back to BEFORE JAPANESE ADMINISTATION in 1895, then the island is there, very simple. It's not worth yelling and punching and firing water cannon to each other while all of them do nothing to settle the claim.

China on Friday said it will take forceful measures in response to any moves that challenge the country's bottom line on sovereignty.

"We want to live in friendship with all countries including Japan, but we have to uphold our principles and bottom line," Chinese Vice Foreign Minister Zhang Zhijun told reporters Friday night.

Zhang said China pursues a policy of friendship and partnership with its neighboring countries and stays committed to the path of peaceful development.

"However, should anyone want to challenge China's bottom line on the issue of sovereignty, China will have no alternative but to respond forcefully so as to remove disturbance and obstacles and move steadily on the path of peaceful development," he said.

Zhang said Japanese government's "purchase" of the Diaoyu Islands, which was announced on September 10, constituted a grave violation of China's territorial sovereignty.

He said the move has caused "the most severe repercussions" on China-Japan relations since the two countries normalized diplomatic relations in 1972.

The Diaoyu Islands are part of China's territory in accordance with historical fact and law, Zhang said.

Japan has no right to buy or sell Chinese territory in any way and no transaction is allowed over even one inch of the Diaoyu Islands or anything on it, he said.

Zhang said the "purchase" farce had been orchestrated by Japan's right-wing forces. The Japanese government, instead of doing anything to stop the right-wing forces from violating China's sovereignty and sabotaging China-Japan relations, has stepped in and "purchased" the islands itself.

"What the right-wing forces had wanted to do and achieve was finally accomplished by the Japanese government," he said.

The dangerous political tendency of the Japanese right-wing forces had once plunged Asia into a major disaster. Such forces, if not stopped but used, if encouraged and indulged out of domestic political needs, will become further emboldened and lead Japan further down a dangerous path, Zhang said.

Some Japanese political figures have swaggered into the Yasukuni Shrine which honored WWII war criminals and paid tribute there without feeling guilty or ashamed, dismissing the feelings of the people in other Asian countries, which were victims of Japan's past aggression, he said.

If Japan cannot face up to history, cannot examine its conscience and sincerely correct its mistakes, no matter how developed its economy is, it will never stand up morally or psychologically, he said.

Zhang said China has expressed its adamant opposition to the illegal "purchase" of the islands from the very beginning. "Yet the Japanese government has turned a deaf ear to China's warning."

The Chinese government has taken a series of forceful measures to safeguard its territorial sovereignty. No external threat or pressure could weaken, not even in the slightest way, the resolve of the Chinese government and people to uphold China's territorial sovereignty, he said.

China and Japan have maintained contact and consultations on the issue of Diaoyu Islands through various channels and in different forms. The two sides started vice foreign ministerial-level consultations on Diaoyu Islands in Beijing on September 25.

In the contact and consultations at all levels, China has stated its government's solemn position on the issue and strong determination to safeguard territorial integrity, Zhang said.

China has urged Japan to have a correct reading of the situation, abandon any illusion and face up to reality. Japan should correct its mistake with credible steps and make real efforts so that the current problem will be handled properly, he said.

"We do not want to see the situation spin out of control. But this, however, is not to be decided by the Chinese side," Zhang said.

He demanded Japan take seriously China's solemn position and major concerns, and stop all actions that undermine China's territorial sovereignty.

But you can be "friendly with anyone if you keep saying "prepare for the sound of music (cannons)" All the time to anyone threatening people with war is not being friendly its being a bully so why not use the UN to solve the problem it is the proper forum do you find it odd that you are have disputes with almost all of your neighbors?

Japanese Foreign Minister Koichiro Gemba on Wednesday rebutted Chinese claims to the Japanese-administered Senkaku Islands in the East China Sea, noting that a Chinese map published in 1960 depicted the islet group as Japanese territory.

The territorial dispute, which has intensified since the Japanese government purchased three of the five main islands in the group from a Japanese owner roughly a month ago, has shown no sign of abating as neither side appears willing to shift its position.

At a news conference, Gemba reiterated that China, which calls the group Diaoyu, began asserting its territorial sovereignty over the islands in the 1970s, suggesting that China previously had not viewed the group as part of its territory.

As further proof, Gemba cited a letter of appreciation sent to a Japanese individual from the then consul of the Republic of China in Nagasaki in 1920 that described the islands as the "Senkaku Islands, Yaeyama District, Okinawa Prefecture."

The Chinese map of the world showed the disputed islands as part of Japan, naming them as the "Senkaku Islands" and the largest of the five main islands as "Uotsuri Island," according to information on the Japanese Foreign Ministry's website.

At the news conference, Gemba also said Tokyo's position over the dispute is unwavering, adding, "We can't concede what we can't concede."

But he expressed readiness to explore "what is possible," noting the importance of calming the tensions between the two countries in a peaceful manner.

China claims that the islands have been part of its territory since ancient times and that Japan "stole" the islands from China in 1895 at the end of the Sino-Japanese War.
