Panama Leaks Proceedings at Supreme Court of Pakistan have commenced. This development is historic itself in the sense that no such precedence exists in the history of the country since its creation on Aug. 14, 1947.
Since the honourable court has decided to carry out proceeding on daily basis which is another land mark step by the judges, therefore, it is of extreme significance for the people of Pakistan. To keep the forum updated on the proceedings, I have created this thread so that the Pakistani members on pdf and discuss this issue and share info with each other.

Please avoid pessimistic statements like "There is no hope or these courts are sold out"
Because if that was true, then there would be no proceedings in the first place.
The success of the case not only depends on the impartiality and competence of the judges but also on the evidence presented and how the plaintiff pursues it.

The history is made... and would be forgotten soon both by SC and public...!!!

Last chance for PM’s family to file reply

ISLAMABAD - The Supreme Court yesterday granted the last opportunity to Prime Minister Nawaz Sharif’s sons and daughter to submit a reply in the Panama Papers case. The court said if they did not file their reply by Monday, it would be deemed “they don’t have any defence to offer”.

“If a respondent does not file a reply, it is considered that he or she has accepted the allegations,” observed Justice Asif Saeed Khan Khosa while taking up the high profile case in which all the parties involved have very high stakes.

A five-member bench headed by Chief Justice Anwar Zaheer Jamali took up the constitutional petitions of the Pakistan Tehreek-e-Insaf, the Jamaat-e-Islami, the Pakistan All Muslim League and advocate Tariq Asad.

The apex court once again made it clear that it would decide the terms of reference (ToRs) if the parties failed to reach a consensus. The court directed the parties to file ToRs today (November 3), making it clear that no individual or party should get the impression that the court will fully accept their ToRs.

“We will not be bound by the ToRs of any individual or a party. We will decide the ToRs (ourselves) for the expeditious decision of the case,” the court order said.

The court said that a single member commission consisting of the apex court judge will be formed on Monday after receiving replies from the PM family.

The court ruled on the maintainability of the petitions citing the issue of fundamental right and the matter of larger public interest under article 184(3) of the constitution. No one including the Attorney General for Pakistan (AGP) raised any objection over the maintainability of the petitions.

AGP Salam Aslam Butt submitted replies on behalf of the prime minister, Finance Minister Ishaq Dar, Captain (r) Muhammad Safdar, but sought one week time to file concise statement on behalf of PM’s children Maryam Nawaz, Hassan Nawaz and Hussain Nawaz.

According to the PM reply, Nawaz Sharif has not been the owner of any of the offshore properties and entities mentioned in Panama Papers. “The PM’s name does not appear in the Panama Papers nor have any accusations been made against him in the papers,” the reply said.

The reply also states that Nawaz is a regular tax payer and files tax returns as wealth statements. The PM’s entire income, assets and liabilities are duly declared in the tax returns and wealth tax statements.

Similarly, the entire income, assets and liabilities of the premier and his wife were duly declared in the nomination forms for the general elections 2013. “None of the children of Nawaz Sharif is his dependents nor has any of them been declared as his dependant in his tax returns and wealth tax statements. PM fulfils the requirements of articles 62 and 63 of the constitution.”

The court expressed its annoyance over not filing of replies by Maryam, Hassan and Hussain. It observed that enough time had been granted to them but they did not file replies as yet. Justice Sheikh Azmat Saeed remarked the replies, which the court wanted to see, have not been filed yet, adding the basic replies were of the PM’s sons and daughter.

Salman replied he could not contact Hassan and Hussain as they were abroad. He said once he would be in touch with them he will file their concise statements. The chief justice directed him to submit their replies by Monday. However, Hamid Khan, counsel for the PTI chairman, opposed giving further time. He questioned if the PM’s family has no answer.

The court noted that there were allegations that Maryam Nawaz was dependent on PM Nawaz. Salman said that she was not dependent (on the prime minister) until that date which was being referred by the petitioners.

The court dismissed the petition of journalist Asad Kharral, as he had no locus standi (the right of a person or a party to appear in court) in the case. Kharral argued before the bench that he had filed the documents, which could not be denied by the NAB, the FIA and FBR officials. Justice Hani remarked that the institutions have not presented any record before the court as they say they don’t have the jurisdiction.

The chief justice again blasted at the media observing “it was presenting things out of proportion, which is extremely damaging to the public at large”. He said that “if someone wanted to play a positive role, then people start talking against the one,” adding “now they use abusive language”. He said that “no one should get the impression that the court will drag the case”. The case was adjourned until Monday.

This thread is not intended for oft-repeated speculations / synicism...There is something called "first time" and that happens in the world my friend / sister :) so let's focus on the latest development and positive suggestions which may even be conveyed to the concerned parties through internet and other media...
If you just read the news article above, you will find that his highness or lowness's family has been ordered to file their reply...so something is of course happening

According to Sheikh rasheed the attorney general of Pakistan is fighting the case for sharif. Is it lega?l Can attorney general fight the personal case of PM which is nothing to do with government?
Nice question @simplestguy ...attorney general is the representative of the GOP and not a personal lawyer of PM of Pakistan especially when the latter is defending charges against himself.
Thus Sh. Rasheed's objection is valid.

I think N.S should not use government machinery here, he is out of his mind. He should learn from I.K. He is a true leader.

That is defeatist. Both the SC and high court have given just rulings even under extreme political pressure in the past.

The more trust is placed in the system ans support given, the less inclined it would be to manipulation.

Hi,

What do you mean defeatist---.

Trust cannot be given to the court system first---. It has to earn it by its decisions---. And there is no major decision by the court favoring the public in their daily lives---either in criminal or civil case.

The high court and the supreme court of pakistan are a fraud and totally corrupt.
