Indian deputy consul general arrested in US on visa fraud charges

It's quite obvious from this that US govt's consent is necessary to prosecute diplomats from other countries.

According to Preet Bharara, the Indian-American US Attorney for the Southern District of New York, 25 current and former Russian diplomats and 24 of their spouses allegedly participated in a scheme to illegally obtain Medicaid benefits for prenatal care and related costs by underreporting their income or falsely claiming that their children were citizens of the US.

Why Preet Bharara is not initiating any action here on his own?

Unfortunately you wouldn't hear a peep from here or in India on this "representative" of India who had misused her position with full diplomatic immunity and had indulged in the abuse of a teenager. And the salary here is $100 per month - less than a two days' salary for a maid here in US on a minimum wage basis.

I just read about a US diplomat who got away with abusing his domestic helper in Japan 20 years ago.
We should not let these people abuse diplomatic immunity to take advantage of the poor.

I am researching the subject and I will try and find out more.
 
The legal question is that since the charges were pressed when she didn't have it , what does U.S. court do ?

Nothing. Immunity attaches to the person. Doesn't matter when the charges were pressed. It is not clear how immunity isn't retroactive(earlier U.S. court decisions agree that it is as does the state department guide) but even if that were the case, she can never be touched unless she came back as a private citizen & the charges were still active.

A whole lot of diplomats gets away with a whole lot of nasty things 99% of the time . Its a nasty world, every one has to act Nasty or you are viewed as a weak nation...


Trust me, that woman would rather be in American prison than in Indian prison , she's probably secretly hoping she's found guilty there ...

I wrote the below in another thread few hours before when I mentioned what would happen if the diplomatic immunity is extended indirectly to even the sundry of Indian Foreign Service officials as demanded here by many.

Some psycho of an IFS official will torture and injure the maid and even if the maid wants to go back, if he/she withholds the passport, the uneducated maid will not be able to do anything nor the local law enforcement officials. And the IFS official will continue any mistreatment of that maid with impunity, paying less than even the $3 and change what the indirect contract would say and the Indians would have indirectly condoned and underwritten their support for that IFS official.
 
New Delhi: India has withdrawn all identity cards for American consular officers as part of its "firm reciprocal measures" after the arrest and humiliation of its diplomat Devyani Khobragade in the US.

Sources said the immunity of US consular officials in India is now at par with Indian officials in the US.

"New cards which are exact replicas of cards provided to Indian Consulate officials in the US are being given in lieu of cards withdrawn from the American consular staff," sources said.

Family members of US consular officials will also no longer get the ID cards, which come with special privileges, since family members of Indian Consulate officials in the US are also not provided such cards, sources said.

India had announced a slew of retaliatory measures after Devyani Khobragade was arrested for alleged visa fraud on December 12 and strip-searched.

Because this idiot wanted to win political favors by attacking his own national , Now he has to sulk quiet bad as the diplomat will be coming home .

It is a waste of time bothering about motives. We simply will never know. For all we know, Bharara may have had the very best of motives. He did go after the Russian diplomats too, it was the state department which put a spoke in the wheel there. It is they who will here too. Bharara's comments about the Indian system were both unbecoming & bordering on the dangerous but I see no real issue otherwise. Conspiracy theories will have no end but lawyers would have figured this one out (the diplomat going back)as a possibility, I don't think Bharara would be completely taken aback(maybe by the Indian reaction, not by the final outcome), this was probably factored in.

If she is granted the full immunity by State Dept signing to allow her to transfer to UN Mission , she's free to leave the States at any desired time . The legal question is that since the charges were pressed when she didn't have it , what does U.S. court do ?

Because we want to formalize the immunity....and after that it won't matter what the courts want to do. This is a POLITICAL fight, she is only an issue.

Yes , you want to , so she can escape from the U.S . Isn't that what I said before ? This is a way to escape , because there's no other way she can get out with the charges . She needs the full immunity by being with UN , its not a formality .

Well this isn't clear to be honest actually . What is known is that immunity attaches with the person who already has it , sure , but does it too when he/she faces charges when under partial or none and later his/her status is changed to full by any means ? I think it does , but this isn't quite simple as it appears . You see the State Dept by agreeing to transfer her to the U.N. will be found by the U.S. court to be in direct obstruction of justice . That puts them in a complicated situation too . Because once she gets the full immunity , she's free to leave , since the Americans do not have jurisdiction anymore . This is the case .

@Solomon2 Tell me about the U.S. State Dept . Can they sign the papers without legal complications knowing well that she cant be prosecuted under the law any longer ?

Kiddo , this wasn't no rant . If you have no idea of what that sort of " escaping from law " can do to her career and do not even want to understand , then its not my fault . We will see when you get her out untouched , do not start counting eggs .
