My real ‘crime’: Standing up for U.S.-Pakistan relations

Husain Haqqani, a professor of international relations at Boston University and a senior fellow at the Hudson Institute, served as Pakistan’s ambassador to the United States from 2008 to 2011.

I am saddened but not surprised that a Pakistani judicial inquiry commission has accused me of being disloyal while serving as my country’s ambassador to the United States. The tide of anti-Americanism has been rising in Pakistan for almost a decade. An overwhelming majority of Pakistanis consider the United States an enemy, notwithstanding the nominal alliance that has existed between our countries for six decades. Americans, frustrated by what they see as Pakistani intransigence in fighting terrorism in Afghanistan, are becoming less willing to accept Pakistani demands even though Pakistan has suffered heavily at the hands of terrorists.

This is a difficult time to openly advocate friendly relations between the United States and Pakistan. I am proud that I did so as ambassador. During my tenure, the United States agreed to initiate a strategic dialogue with Pakistani civil and military leaders. The idea was to overcome the episodic nature of bilateral relations: Our countries had a pattern of working together for a few years and then falling out amid complaints about each other. The strategic dialogue sought to reconcile Pakistan’s regional concerns about Afghanistan and India with U.S. global concerns about nuclear proliferation and terrorism. But the dialogue stalled last year, and a series of unfortunate incidents, culminating in Osama bin Laden being found in Pakistan last year, has brought our countries to the brink of an adversarial relationship.

My sincere efforts to transcend the parallel narratives that have shaped U.S.-Pakistani relations were not always appreciated in Pakistan, where conspiracy theories and hatred for the United States have become a daily staple of the national discourse. My detractors in Pakistan’s security services and among pro-Jihadi groups have long accused me of being pro-American; they condescendingly described me as the U.S. ambassador to Pakistan based in Washington. Falsehoods were circulated in Pakistani media about my issuing thousands of visas to “CIA spies” who would allegedly act with impunity against my country. Few considered that Pakistan was pledged record amounts of U.S. aid and that Pakistani views were being heard on a range of issues. The expectation that Washington should simply do whatever the Pakistani hyper-nationalists desire remains unrealistic.

I resigned last November after a U.S. businessman of Pakistani origin — now residing in Monaco — claimed that I had asked him to deliver a secret memo to Adm. Michael Mullen, then chairman of the Joint Chiefs of Staff, seeking U.S. help in thwarting a military coup right after the U.S. operation that killed bin Laden. The affair was dubbed “Memogate” by the Pakistani media. Our Supreme Court, pursuing a populist ideological agenda without regard to legal or constitutional niceties, intervened directly. Without any trial, it created a Commission of Inquiry and barred me from leaving Pakistan, though it later relented.

This week the commission presented its findings. It alleged that I had acted against Pakistan’s interests and had authorized the controversial memo. The report’s release has been timed to distract attention from serious allegations by a Pakistani businessman that he paid millions to the son of Pakistan’s chief justice as part of efforts to buy favors.

How ironic that Pakistani hard-liners claim I was an American agent of influence with access in Washington’s power corridors. Were that true, there would have been no reason for me to seek help, certainly not from a businessman of dubious credentials, to deliver a message to the U.S. government. The one-sided “evidence” has failed to prove my connection to the memo. I have not been charged or tried — though the report could lead to charges, and a treason conviction carries the death penalty. No, I was simply labeled guilty by a “fact-finding” commission that bent over backward to accommodate my discredited accuser.

The commission’s bias was clear in its refusal to hear from me via videoconference — a request I made in light of security threats — and its lack of interest in seeking the testimony of U.S. officials who received the controversial memo, Mullen and Gen. Jim Jones. Notably, Jones said in a sworn affidavit that I had nothing to do with the document that had been transmitted to him and that the memo reflected the ideas of its author, the American businessman Mansoor Ijaz.

The commission’s findings are motivated by politics, not law. I served Pakistan sincerely. Most people in Washington saw and know that. Branding me a traitor will not solve any of Pakistan’s myriad problems, not least of which is the prospect of international isolation. The 2012 BBC Globescan poll found that the international perception of Pakistan is as bad as that of Iran and North Korea.

It is tragic that anti-Americanism is being exploited to push ideological agendas, but I stand by my view that positive U.S.-Pakistan relations under a civilian-led Pakistani government are necessary for international peace and Pakistan’s stability. My real “crime” is standing up for U.S.-Pakistan relations for Pakistan’s sake. I had nothing to do with writing and sending that memo. But many people around the world would recognize that its contents suggesting changes in Pakistan’s counterterrorism and nuclear policies reflect reasonable views that are not treasonous and are, in fact, in line with global thinking.

I believe the Supreme Court with its honourable judges is in a better position to pass judgment than you are.

will you give same comments about poor taxi drivers and vendors accused of terrorism and locked up for life without any proof without and court hearing, or you logic only flows one way

The fact is that this man was handing over our while security apparatus to the US and a lot more.

He does not have more than 1.5 lac in assets in pakistan( that too only bank deposit). He has siphoned off more than 20 million $ in US.

So a person who has not even come to Pakistan, made up 3 different lies for hiding a mobile phone, and not even come to the commission even after promising them, does not really have any right to say that he is a patriot.

First he should come to Pakistan then talk.

Did you read the detailed report provided by the honourable judges? He was found to be a traitor based on other factors as well which thou art deliberately ignoring in thine attempt to malign the Supreme Court of Pakistan. Your contempt of the court is clearly visible

Meaning he has no formal opportunity to make his case and completely clear his name.

- this more so is already proved the intention of criminal haqqani by his escape to america, he will never come to pakistan to face the verdict, even try to appeal.

Mr Haqqani sought American help; he also wanted to create a niche for himself making himself forever indispensable to the Americans. He lost sight of the fact that he is a Pakistani citizen and Pakistan's Ambassador to the United States of America, and therefore his loyalty could only be to Pakistan," the report's findings said.

Its findings also said: "Mr Haqqani by offering his services as part of a proposed 'national security team' to a foreign government, voicing the 'great fears' that 'Pakistan's nuclear assets are now legitimate targets' and thus seeking to bring 'Pakistan's nuclear assets under a more verifiable, transparent regime,' stating that ISI maintains 'relations to the Taliban' and offering to 'eliminate Section S of the ISI and to help ' pigeon - hole the forces lined up against your interests' created fissures in the body politic and were acts of disloyalty to Pakistan, that contravened the Constitution of Pakistan.
This should clear up things even more, for those who are interested. For those who just want to insult Pakistan, it will doubtless prove very unimportant

Contents of the memo:
The memo then makes certain explicit offers to the United States government in exchange for its support. These include the following quoted directly from the memo:
"In the event Washington's direct intervention behind the scenes can be secured through your personal communication with Kayani (he will likely listen only to you at this moment) to stand down the Pakistani military-intelligence establishment, the new national security team is prepared, with full backing of the civilian apparatus, to do the following:
1. President of Pakistan will order an independent inquiry into the allegations that Pakistan harbored and offered assistance to UBL and other senior Qaeda operatives. The White House can suggest names of independent investigators to populate the panel, along the lines of the bipartisan 9-11 Commission, for example.
2. The inquiry will be accountable and independent, and result in findings of tangible value to the US government and the American people that identify with exacting detail those elements responsible for harboring and aiding UBL inside and close to the inner ring of influence in Pakistan s Government (civilian, intelligence directorates and military). It is certain that the UBL Commission will result in immediate termination of active service officers in the appropriate government offices and agencies found responsible for complicity in assisting UBL.
3. The new national security team will implement a policy of either handing over those left in the leadership of Al Qaeda or other affiliated terrorist groups who are still on Pakistani soil, including Ayman Al Zawahiri, Mullah Omar and Sirajuddin Haqqani, or giving US military forces a “green light” to conduct the necessary operations to capture or kill them on Pakistani soil. This “carte blanche” guarantee is not without political risks, but should demonstrate the new group's commitment to rooting out bad elements on our soil. This commitment has the backing of the top echelon on the civilian side of our house, and we will insure necessary collateral support.
4. One of the great fears of the military-intelligence establishment is that with your stealth capabilities to enter and exit Pakistani airspace at will, Pakistan's nuclear assets are now legitimate targets. The new national security team is prepared, with full backing of the Pakistani government – initially civilian but eventually all three power centers – to develop an acceptable framework of discipline for the nuclear program. This effort was begun under the previous military regime, with acceptable results. We are prepared to reactivate those ideas and build on them in a way that brings Pakistan's nuclear assets under a more verifiable, transparent regime.
5. The new national security team will eliminate Section S of the ISI charged with maintaining relations to the Taliban, Haqqani network, etc. This will dramatically improve relations with Afghanistan.
6. We are prepared to cooperate fully under the new national security team s guidance with the Indian government on bringing all perpetrators of Pakistani origin to account for the 2008 Mumbai attacks, whether outside government or inside any part of the government, including its intelligence agencies. This includes handing over those against whom sufficient evidence exists of guilt to the Indian security services." [13]

I believe that agreeing to give a foreign government the green light to conduct any and as many operations as it wants is being a traitor and a scoundrel

They do have a difficult job. I class Pakistan as a military junta with a near-useless smear of democracy, checked only by an independent judiciary. In the absence of independent executive and legislative power the Court is thus compelled to assume a political role, rather than serve as a judicial balance.

If you want that to change you're going to have to work at it.

The role of the judiciary is to implement the laws of the lands, whether they be devised by a civilian or dictatorial government. This renders your entire point moot

The judicial commission conducted forensic examination on Mansour Ijaz's phone. So I think Haqqani indeed had sent the message to Mullen. He just chose the wrong messenger.

I held all pakistani political parties in high regard. I was not being contenptuous your honour. :)
