Lalit Modi fled India in 2010 and in July 2014, he was given British travel document as per as British laws and regulations to travel to Portugal to see his wife who was suffering from Cancer and in August 2014 , his Indian passport was given back to him by the Delhi court.

Modi has been living in exile in United Kingdom after his passport was revoked by the Mumbai Regional Passport Office in March 2011, five months after he was sacked from IPL on charges of financial irregularities. Allowing him to stay in UK without a passport, the British government had earlier told the Ministry of External Affairs of India that they don't want to involve in legal constraints regarding his deportation.



Delhi Court asked to restore his passport after British travel document has issued to him.

Former Indian Premier League (IPL) commissioner, Lalit Modi can finally return to India. In a landmark judgment, a division bench of Delhi High Court, comprising Badar Durrez Ahmed and Vibhu Bakhru, on Wednesday restored his passport. Besides, the ruling also set aside the previous orders on the 48-year-old cricket administrator.

Former external affairs minister and Congress leader Salman Khurshid on Sunday asked incumbent Sushma Swaraj to take responsibility of the ongoing controversy surrounding the travel documents issued to former IPL chairman Lalit Modi.

"Well it is the ministry's prerogative. It is really an internal matter for the Ministry of External Affairs and for the Ministry of Home Affairs. Whenever there is some question mark, then the Ministry of Home Affairs has to give clearance...If the minister feels that they have good reason to override any issue then they can do so, but the only thing is that whatever happens you got to take responsibility for it. It is the minister's authority," he told ANI.

Khurshid further asked the government to make its position clear on the issue.

"I do not know enough in this matter, what is the help given, are they asking him to come back to India or are they clearing the passport that was taken.....The point is he doesn't need a visa, he is an Indian, he can come back if he has a passport. I don't know what the details are, what is the facility that they are now providing," he said.

"The passport itself was cancelled in the previous government, therefore, it was not clear if he could stay on without an Indian passport. The British Government had cleared him to continue to stay, despite the Indian passport being cancelled, now it is for the government to explain their position," he added.

Swaraj had earlier in the day said that she had taken a humanitarian view of Modi's case since his wife was suffering from cancer.

She further said that British MP Keith Vaz had spoken to her on the same, adding she believes that giving an Indian citizen 'emergency travel documents' cannot spoil relations between India and the UK.

Vaz, who is facing an inquiry in the UK over the role he played in Modi receiving his travel papers, said that he had checked with the Indian Government before taking any action and added that he had received a 'no objection' from New Delhi.

Clarifying her stand on Lalit Modi's UK visa row, External Affairs Minister Sushma Swaraj has said that she had only taken humanitarian view.

In a series of tweets on Sunday, External Affairs Minister Sushma Swaraj said that In July 2014, Lalit Modi had informed her that his wife was suffering from Cancer and her surgery was fixed for 4th August in Portugal.

He also informed that he had to be present in the Hospital to sign the consent papers.

Lalit Modi also had informed that he had applied for travel documents in London.

However, they were restrained by a UPA Government communication that this will spoil Indo-UK relations.

Taking a humanitarian view, she conveyed to the British High Commissioner that "British Government should examine the request of Lalit Modi as per British rules and regulations.

If the British Government chooses to give travel documents to Lalit Modi, that will not spoil our bilateral relations.

In her tweet, Sushma Swaraj also said that, only a few days later, Delhi High Court had quashed UPA Government's order impounding Lalit Modi's Passport on the ground that the said order was unconstitutional being violative of fundamental rights and Lalit Modi got his Passport back.

Meanwhile, Union Home Minister Rajnath Singh and BJP President Amit Shah have backed Sushma Swaraj.

Criticizing political parties for unnecessarily creating hype on this issue, Samajwadi Party leader Ram Gopal Yadav noted that Sushma Swaraj has done nothing wrong.

Earlier Congress and some other opposition parties criticized Sushma Swaraj on the issue.

The genesis of the controversy was disclosure of emails showing that she had spoken to Indian-origin British MP Keith Vaz and its High Commissioner here James Bevan favouring the grant of travel documents to Lalit Modi to go to Portugal, purportedly for his wife's cancer treatment in June last year.

Modi, who is wanted in India, has made London his home since 2010 to avoid a probe for alleged foreign exchange regulation violations in the T20 cricket tournament held in South Africa in 2009. The previous UPA government had revoked his passport and had pressed for his extradition.

According to British media which quoted leaked emails, Vaz cited Swaraj's name to put pressure on UK's top immigration official to grant British travel papers to Lalit Modi, who subsequently got the documents in less than 24 hours.

Vaz also offered to help Swaraj's nephew Jyotirmay Kaushal to apply for a British law degree course, the report said.

Opposition parties demanded her resignation, alleging grave impropriety on her part in helping a fugitive from law. Congress questioned even the role of the Prime Minister as to whether her action had his "tacit" endorsement.

Contending that the Prime Minister's role was under a "cloud of suspicion", Congress posed 11 questions to him, including "what happens to transparency and non-corruption" promise made by him, as per PTI.

After the reports surfaced, 63-year-old Swaraj said in a series of tweets that she had taken a "humanitarian view" and conveyed to the British High Commissioner that they should examine Modi's request as per their rules and "if the British government chooses to give travel documents to Lalit Modi that will not spoil our bilateral relations".

Facing opposition attack, Swaraj said, "What benefit did I pass on to Lalit Modi - that he could sign consent papers for surgery of his wife suffering from Cancer?... He was in London. After his wife's surgery, he came back to London. What is it that I changed?"

She also reportedly spoke to Prime Minister Narendra Modi explaining her position on the issue.

On the other hand, BJP president Amit Shah backed the External Affairs Minister saying that Sushma had already given her clarification on Twitter earlier today.

"Sushma has already clarified her stand on Twitter. She helped Modi on humanitarian grounds and had asked British MP Keith Vaz to assist as per UK laws," Shah said.

While slamming the Opposition for demanding the Union Minister's resignation, Shah said that the issue of visa for Lalit Modi should not be politicised.

Union Home Minister Rajnath Singh, too, came to Sushma's defence saying what she did was right and that the government stands by her.

Anyone else who had officially fled the country to escape prosecution would have been hounded and extradition requests would have been made. Here, all facilities provided instead on 'humanitarian' grounds. And why so much concern for one person? Obviously the billionaire has pulled some strings somewhere. @SrNair you think you will get a break on 'humanitarian' grounds?
