Twitter Trend #DeportAllRefugees started by SIndhis aims at deporting All Afghan Refugees

#deportallafgonis back to Germany of Asia the Afgonistan!

these creatures have caused nothing but trouble in pakistan. once they are gone half of law and order will be reduced.

I don't hate them, I consider them (Afghans) my brother except the ethnic terrorists , but I can't ignore just demand of Sindhis. Sindh should not be treated as international hub for refugees.

Punjab should take some responsibility, take half Afghan, Bengali, Burmese from Sindh at least.

why should pakistan be dumping ground of these creatures?

.
While the merit of deportations may be debated - I feel this strategy is being coordinated by those formerly in the power corridors of Sindh in conjunction with PTM to create further destabilization of Pakistan and hence removal of the current government which still has backchannel military nods despite its recent blunders.

We Pakistanis still have a bit growing up to do. We are too easily misled by our corrupt media and our corrupt politicians. Alhamdulilah our military and our present government are not subject the whims of the changing winds.

Having spend the past 40 years hosting the Afghan refugees in Pakistan, and on the verge of an end to the Afghan wars, it would be counterproductive to say the least to expel the Refugees.

The deep connections formed by the bulk of the refugees will incentivize Afghans to view Pakistan as an Ally, once a more representative government comes to power in Kabul. These 40 years have bonded the two countries and now is the time to focus on economic development so that what many view as a burden can be viewed as a major plus.

Goodwill should not be squandered, and a plan for Afghan reconstruction with FDI (which could responsibly allow Afghans to return home if they so chose) can benefit both nations.

With peace, Afghan Mining and modernized Agriculture that gets processed and exported via Pakistan is a major opportunity that can pay to rebuild the Afghan nation and help build up both nation’s economies. Karachi as a city with a major Pashtun population and a port city would have an incentive to do business for Afghan minerals over any other city in the region.

Iran’s hostility and recent murderous actions have tarnished their trade potential, we should not do the same by expelling the refugees.

Great post brother, I agree with everything you have stated.

Stop the hate. After 40+ years in the country they don’t have any other country that they can call home. Many of them were born in Pakistan and are eligible for Pakistani citizenship.

People claiming that the Ummah is dead (she is dead unfortunately) but nobody wants to stop the cycle of hate to revive her. If an Afghan is part of an criminal enterprise punish him and not the entire ethnicity!

It’s easy to hate the poor and common people and blame them for everything bad happening. Sindh is a mess because of PPP and friends not because of the afghan constructing worker in Karachi trying to make a living for him and his family!
It has nothing to do with Ummah. Understand the problem first.
When we call the name "Afghani" it means those people who are not Pakistani Citizens even after living decades in Pakistan. According to Pakistani law any child that is born in Pakistan can get Pakistani Citizenship by default. Any child of Afghan Refugee will have Pakistani form-B and Will get Pakistani CNIC like you and me irrespective of his parents. and even the Afghan born People can get Pakistani Citizenship by Denouncing their Afghan Nationality.
IF some one still doesn't want to become a Pakistani Citizen, he/she should go back to where they came from. As we are a poor country and we have so many Poor people here to take care of.
As for Hate for Afghan goes. Afghanistan is the only Country in the World that claim Sovereign Pakistani Land that is undisputed and accepted by international Community. Not even India Does this.
Read about what these Afghans were doing with Pakistan before 80s when they were destroyed by their own stupidity.(Murdering their own president with the help of Foreign Army and then inviting the bloody Soviets).
We welcome any Afghan who wants to become a Pakistani Citizen and Denounce the Afghan state. Because Afghanistan state policy is against Pakistan from the date Pakistan was formed.

this is nothing to do with Muslim Ummah. We Always send aid and Food to Afghan People for years now. even our country is poor. Every Muslim in the world is Muslim Ummah. But Anyone who is against our state is our enemy.

All these so called refugees should get Pakistani CNIC and Settle here. BTW Pakistani Pashtuns hate these Afghans the most.
I personally have no problem with Afghani People doing routine Business in My city. They are very hard working, Down to earth and Polite folk. Laborers, Roadside Food cart owners, Shop owners, Stall sellers. But most of them i know of have Pakistani CNIC holders and have no connection left with Afghanistan (Most are even born here).

India is killing and raping our people in J&K, here you want to open another front with a friendly country.

Keep your racism in check, it does not befit Pakistan nor Muslims.

Afghans should be treated like any other person, if they break the law, they should be deported as that abuses the hospitality of the host country. If they are law abiding citizens, there is no reason to target them and their families.

Our real enemies are India and Iran, not Afghanistan. Those are the countries promoting terror against us.

Kabul regime's days are numbers. We have a friendly Taliban government there now.

Doesn't apply.

Sometime ago an Afghan refugee petitioned the Supreme Court of Pakistan claiming that they should be given the rights guaranteed to citizens under the 1973 Constitution of Pakistan.

The argument from the refugee applicant was that Afghan refugees be treated the same as refugees coming to Pakistan at the time of partition in 1947 and refugees from disputed territory of Kashmir, both of whom are categorized Pakistani citizens.

Supreme Court of Pakistan dismissed the case and categorically distinguished the case of Afghan refugees from both the 1947 partition refugees and the Kashmiri refugees. In its verdict, the court emphasized that statutory exceptions were carved out in the citizenship laws of Pakistan for the refugees arriving from India at the time of partition and for refugees from disputed territory of Kashmir.

On the contrary, Afghan refugees were granted refugee cards and under the terms of the Geneva Accords, their stay in the territory of Pakistan is allowed for a temporary period as long as the foreign troops have occupied Afghanistan. Now that foreign troops are leaving Afghanistan, the question of Afghan refugees is being raised once again.

I stand corrected. Thank you.

It is their birth-right under the constitution and should be afforded to them asap.

Wrong.

As I've explained to @Iltutmish earlier, Afghan refugees have petitioned the Supreme Court several times on the question of citizenship and the court has repeatedly ruled that this constitutional stipulation does not apply to them. A similar case was made by a Somali refugee petitioner, the court ruling once again reaffirmed that refugees fall under the Foreigners Act of 1946 regardless of the length of their stay.

When Pakistan signed Geneva Accords in 1988, the parties being Afghanistan, Pakistan, Soviet Union and United States of America, we specifically signed a bilateral agreement with the Republic of Afghanistan on the Voluntary Return of Refugees.

I can track down the exact cases however these cases have been discussed on this forum before. People can search for them.

Does that not exclude the Refugees born in Pakistan? The citizenship act of 1951 does not seem to exclude them. Would not the Voluntary Return of Refugees stipulation only apply to those refugees who were not born in Pakistan?

It does not.

The petitioner in one of the cases was an 18yr old Afghan refugee born and raised in Pakistan. His parents had acquired citizenship through fake documents while residing in a small town. The refugee boy petitioned the court for citizenship rights.

The Supreme Court recognized previous rulings and upheld his refugee status. The opinion stressed in the ruling was that the length of one's stay in Pakistan cannot automatically convert their refugee status to citizen unless the citizenship was acquired legally by process of law.

Therefore, the children born to aliens, as in foreigners, in Pakistan are not accorded the privilege of citizenship. This is why Afghan refugees fall under Foreigners Act of 1946 and the bilateral agreement signed between Pakistan and Afghanistan in 1988 on the Voluntary Return of Refugees.

There seems to be confusion with the language of the Act. Apparently everyone is confused.

Most of the sources I've read state that Pakistan honours Jus Soli and only excludes the "Children of foreign diplomats and children of enemy alien born in Pakistan", as stated word for word in the act itself. However this report on Pakistani citizenship law states that,

"The law denies citizenship to a person born in the country, if his father enjoys diplomatic immunity in Pakistan or if his father was an enemy or alien in Pakistan. Therefore, the children born to aliens in Pakistan are not accorded the privilege of citizenship."

This is in compliance with the court ruling you mentioned. Did they just write it wrong? Would not be surprised.

Please read the full post instead of nit picking and replying.
and What Racism? Afghan is not a race. Its a Country and Nationality. Pashtun, Uzbek, Tajik, Hazara Are Races that like in the region called Afghanistan. State Policy of Afghanistan have nothing to do with races that reside there. Calling Afghan Government and its supporters out is not racism.
BTW Racists rants are thrown towards us Pakistanis by them not the other way around. We even celebrate historical Figures from that land as our own. Try to find any reference from Afghanistan where our local figures are celebrated and talked about.
Plus who am i to open any front. That Front is already open for 70 Off years against us. Starting from Ippi Faqir, Bacha Khan to PTM. And Will never close unless Afghanistan As a state is dissolved and divided into different regions like Pashtun region, Uzbek/Tajik Regions etc. Only Dissolution and Division of Afghan State will bring peace to that region, Its people and Also Pakistan Else it will remain the chaos it is and burden us as well

Regards
