A top Indian diplomat has been arrested in New York after she paid her house-keeper only $3.13 an hour and lied to get her into the country, federal prosecutors said Thursday.

Deputy Consul General Devyani Khobragade, 39, has publicly campaigned for women's rights and gender equality.

But the woman she hired to clean her house and look after he two young daughters says Khobragade paid her less than $600 a month - $3.31 an hour - despite telling U.S. immigration officials the staffer would be paid $4,500 a month.

Khobragade is a prominent diplomat who has been posted in Pakistan, Italy and Germany before being given an assignment in Manhattan

Khobragade's lawyer on Thursday said that his client enjoys diplomatic immunity and said he would moved to have the charges dismissed on those grounds.

But U.S. Attorney for Manhattan Preet Bharara was adamant.

'Foreign nationals brought to the United States to serve as domestic workers are entitled to the same protections against exploitation as those afforded to United States citizens,' he told the New York Daily News.

'The false statements and fraud were designed to circumvent those protections.'

Prosecutors allege that Khobragade falsely signed visa documents for the worker saying that she would be paid $4,500 a month.

Then, when the housekeeper came to the United States, Khobragade told her that she would be making only 30,000 rupees a month - less than $600, according to prosecutors.

Khobragade works at the Indian Consulate General in Manhattan. She was arrested Thursday and released on $250,000 bail

Khobragade faces one count of visa fraud and one count of making false statements. If convicted, the charges carry a total maximum penalty of 15 years in prison

Khobragade had the worker sign the second contract, which she kept, the charges state.

She was arrested Thursday and released on $250,000 bail after surrendering her passport so she can't flee the country.

However, the Indian embassy is already fighting the charges, asking the American government to have the case dropped on the grounds of diplomatic immunity.

'The US side have been urged to resolve the matter with due sensitivity, taking into account... the diplomatic status of the officer concerned,' said a statement from the Indian embassy in Washington DC.

Further, when the allegations against Khobragade first surfaced, an Indian court issued an order against the housekeeper, ordering her not to take legal action against the diplomat, according to the Hindustan Times.

When it became apparent that the woman was cooperating with American authorities, the court issued an arrest warrant for the housekeeper and requested the U.S. officials have her detained and extradited back to India.

Before being posted in New York, Khobragade service with the Foreign Service in Germany, Italy and Pakistan.

Wow...women rights campaigns and when the time comes to give rights couldnt even live up to it!

This is BS charge as clearly the envoy has diplomatic immunity. When Raymond Davis was arrested for Murder of the two Pakistanis, the US claimed diplomatic immunity. Why would this case be different ?

Come on,that wad a VERY different case you have to admit. This woman isn't going to face murder charges nor is she a RAW agent who has just killed Pakistani citizens and whose presence in this nation raises serious questions with embarrassing answers for all parties.
 
This is absolutely unacceptable to run slave shop by none other than indian diplomat. When indians jump up and down on labor condition in Singapore or other countries they need to look inward even withing their educated class how less fortunate are being treated. This is basic human rights and value.

Second, such public arrest and detention for hours just after indian foreign secretary consultation in Washington, gives out message that "strategic relation" with US is not going according to indian wish.

I would hold off any other analysis until later.

because diplomatic immunity in the US does not mean immunity to break all laws... fraud is fraud. Whether she gets off or not--- it is the height of irony that someone who shrills women's rights did what she did.

throw her out back to India and India should throw her out of any govt representation.

NEW YORK, Dec. 13 (UPI) -- Indian officials said Friday the United States publicly humiliated a diplomat when New York police arrested her for alleged visa fraud.
New York police Thursday arrested Devyani Khobragade, 39, India's deputy consul general, and charged her with one count of visa fraud and one county of making false statements, the Hindustan Times reported.

Khobragade was accused of exploiting her housekeeper.

"India is shocked and appalled by what the U.S. has done to its diplomat in New York," said Syed Akbaruddin, spokesperson for the external affairs ministry in Delhi.

"India is forcefully taking up with the U.S. the treatment meted out to arrested diplomat which is not acceptable," he added. "You cannot humiliate a mother of two publicly."

Police arrested Khobragade while she was dropping her daughter off at school, the Times reported. She pleaded not guilty to the charges in Manhattan Federal Court and was released on $250,000 bail.

No No No - little man. Fact is Chinese are known fraudsters, caught up in welfare scams, part of criminals entities in Chinatown , are ring leaders of prostitution rings in the US and are far far second to indian immigrants in every success measure. The no1 jobs held by chinese community is wait staff at restaurants in the US.

I won't say that all Indians in the US are fraudster and scammer. But if this Jayatl whiner represents all of India here, than you cannot be more right.
