What's new

Tamil cannot be Madras HC's Official language : India rejects Tamilnadu request -

Why bro what is the logic or justification behind this ? and currently what are the official languages at the madras high court ?

For that matter what abt all the other courts in different states ?

Logic ?
CJI rejected the proposal in 2012

The Union Ministry of Law and Justice on Friday told the Rajya Sabha that no further action was taken on the issue of making Tamil the official language of the Madras High Court since the Full Court (a body comprising all judges) of the Supreme Court decided not to accept a proposal forwarded by the State Government in 2006.

Minister of State for Law and Justice P.P. Chaudhary made the statement in reply to queries raised by Member of Parliament Sasikala Pushpa, who wanted to know the action taken by the Centre pursuant to a resolution passed by Tamil Nadu Legislative Assembly in 2006 to get Presidential assent for making Tamil as the official language of the High Court.

Replying to it, Mr. Chaudhary said: “The Government of India had received a proposal from the State government of Tamil Nadu in 2006 requesting permission to use Tamil language in the proceedings of the High Court of Madras. This proposal was referred to the Chief Justice of India for advice.

The Chief Justice of India through his letter dated October 16, 2012 intimated that the Supreme Court, after due deliberations held on October 11, 2012 decided not to accept the proposal.

The Full Court of Supreme Court had adopted similar resolutions earlier on May 7, 1997 and October 15, 1999. In view of the Full Court decision of the Supreme Court, no further action has been taken in the matter.”

all states - Hindi and English only

"You need to get out of the anti hindi sentiments bro its foolish to assume everything as done against Tamil by Hindi"

Similar thing happen in Karnataka.
The Karnataka High Court itself rejected the PIL to make Kannada an official language.

reason -- "The language in all high courts of India is English although use of local language is permitted, where there is no other alternative .Even oath of office is being taken in Kannada or English as per the wish of the persons is concerned. Passing any direction that Kannada should be the 'court language ' in the high court would run counter to Article 348 of the constitution of India "

"In Hindi belt, similar requests have been rejected.Having a common language is not only the constitutional mandate but also enables advocates to travel throughout the country and practice their profession in any court in India "

The bench noted that as per March 29,2003 order of the high court, in all the sub-ordinate courts including Family Courts, Labour courts and Industrial Tribunals , the proceedings including recording of evidence are being conducted in Kannada.
Lower courts are already using regional languages in every state

Logic of rejection is that only English is the official language across India

manlion is not Indian.

Telugu and Tamil are separate, they are not derived from each other. Tamilnadu is Indian as such should follow the common rules agreed and accepted by majority. Their identity should be Indian first not Tamil first. If everyone start relating themselves as separate, there won't be a country called India.

Also nobody cares if southeast asians perceives Indians as Tamilians. India provides for individual choice w.r.t to their vocal communication but written records in courts should be either in Hindi or English as both are recognised as official languages.

If Tamilians are treated differently, there'll equal protest from all other language champions, given there are other languages spoken more widely than Tamil in the country for example Telugu.

Get your facts right - they were Tamil first before they were made Indians in 1947 , hence their unchangeable ethnicity cames before their subject to change nationality. BTW, stop speaking for Tamil starting from 30s. 50s and 60s they have fought against Hindi imposition and demanded succession from Indian union.

really ?

So time ago somebody said he is a Srilankan Tamil, you know the extreme type. I believe so too, how many Tamilians you know would talk against India and Hindus coming from the land of temples(tamilnadu)? I have known many, but none would.

Then there were 70s, 80s, 90s,00s,10s. Noone cares about this nonsense anymore. They are all happy to be Indian, enjoy Indian nationality like the rest of us. Now STFU, because nobody in Tamilnadu is demanding seccession from India. I would like someone dare try. Tamilians would kill him first.

Sorry about that confusion from me.
I cannot agree with you that the majority should force themselves upon their minorities.
Minority rights must be RESPECTED.
India is a recent British construct and as such should not be used as an excuse to obliterate an ancient and proud culture that the Tamils represent.
This dictatorial behavior of the majority Indians are increasingly alienating all their neighboring countries and soon even their constituent states.

Do you know that high school text books sponsored by Indian gov for CBSE schools do not discuss Chola kings? They want to hide the Tamil history.
The History of both Chola and Pandya dynasties are taught to us in grade 7 of CBSE.

I believe Telugu is derived from Tamil so maybe the pride of having your own language is not as strong. Its not about inferiority complex but rather the pride of their identity and the contribution of their ancestors.
Telugu isn't derived from Tamil but Telugu is derived from Sanskrit. A simple google search would give you enough results to prove the same. Also, Telugu is distinctly different from Tamil. Telugu and Kannada are closer to each other even when it comes to written scripts while Tamil and Malayalam are pretty close

Its good and convenient to communicate in only 1 common language but it should not be forced onto others especially onto a proud people who can boast of world wide recognition of a rich and glorious past and present.
And English is still available as a communication medium.
While I'm not saying imposing Hindi is the rightful thing to do, it has been like that for quite sometime now and it is illogical for Tamils to use their own language as that would mean such demands would erupt in every state and it would be a nightmare to coordinate and translate when they are to be used by others. Tamils could refrain using Hindi and use English

In that case, no state would call themselves Indians as the concept of India never existed before. The moment a state is included in the Union of India, they should identify themselves as Indians first and anything only after that. Moreover, you ill informed pakistani naysayers and false flaggers feel our Tamil brothers want to secede from India but I myself am a South Indian with 4 years of my bachelors education in Chennai and my fellow Tamilians are as much Indians as any of us are

Who is obliterating Tamil? You are making as if we are killing Tamils for speaking Tamil. And for clarification we are all proud of our own languages as well. I don't think Tamil is superior to Telugu, and by some accounts Telugu is older is than Tamil itself and spoken by more. That doesn't mean in a country of 1.3 billion, some 60 million could dictate their divisive politics. Hindi is spoken by over half the population and except Tamilians, other states are comfortable to speak the language. A Gujarathi is our prime minister, did he try to impose Gujarathi on us. Our 80% population is comfortable with Hindi, when Tamil achieves that status, then sure ask away.

This is not a matter of pride but rather of convenience.

Well its too early to tell what drastic measures Modi will do further.
Why would the Tamils wanting to preserve their proud language and tradition affect India adversly ?

The Tamils want to preserve their language at the highest possible state, that is have it written in their law.
Hong Kong of only 7 million population having their own law and court system and a different version of written Chinese, Traditional, is thriving and contributing immensely to the progress of the mainland.
And here in Tamil Nadu we have a state of 67 million with a rich history and world wide representation being oppressed in the name of nationalism.

no body is supressing Tamil, they are free to use it as they wish in their daily life. But state communications are to be done in official languages. If they feel Hindi is not one for them then use English. Nation comes first, everything else later. If someone has problem with that, then tough luck.

I find it troubling if Indian attitude towards their minorities of 67 million strong is as what you manifest.
Well I will have to let the Tamils themselves express their thoughts on this.

So when is the Tamil Nadu secession coming?

Afterall,

India is the world's most fragmented state outside of Africa and the volatile Middle east.

Its a new breed of young Tamilians carried away by fiery speeches of seeman. They are few but i have seen quiet a few of them at work :) (They are just feeding on seemans excreta and believing rubbish)

Mistakes in your assumption:

1. "only Hindi or English can be used in Tamilnadu HC" - English is the only official language in High courts across India.

2. "water from neighboring states of Karnataka and Kerala is denied by Indian govt" - Indian govt has nothing to do with it. There is no water atleast here in Karnataka you can visit Mysore ill bare your expenses also please come and see for yourself.

3. Jallikattu people here blame the central govt for this but why was the Tamil Nadu state govt sleeping when the law was passed in the center ? Similar thing happen in Karnataka but the state govt immediately passed the law excluding such festivals where buffalo's are used for racing.

Point no 1

Lawmakers can allow another language in a High Court, but so far only four High Courts—in the states of Rajasthan, Bihar, Uttar Pradesh, and Madhya Pradesh—have done so, in each case with Hindi.

The unique allowance made for Hindi in some High Courts smarts for the country’s Tamil-speakers, who have long resented Hindi encroachment from the north. On Sunday, the chief minister of Tamil Nadu called upon national lawmakers to allow Tamil to be introduced as an official language in the Madras High Court. She argued that “If we are to take the administration of justice genuinely closer to people, then it is absolutely imperative that the local language is used in the High Court, as is already being done by the state government and legislature."

Tamil, India’s fifth most-spoken language, is a Dravidian language with few links to Hindi, an Indo-European language. Unlike other Dravidian languages, Tamil has largely resisted borrowings from Sanskrit, the ancestor of modern north Indian languages. This makes Tamil particularly different from India’s other major languages. These differences are a source of pride. In some ways, the country’s north-south divide is sharpest in Tamil Nadu. Between 1937 and 1986, Tamil-speakers repeatedly protested against the broad adoption of Hindi in India’s central government. Indian states were largely reorganised in 1956 to take account of language. National leaders had planned to keep Hindi and phase out English soon after independence. But pro-Tamil protests catalysed the adoption of the Official Languages (Amendment) Act of 1967, which ensured the survival of the central government’s official bilingualism, a practical recognition that English remained the only workable lingua franca for central government.

Point no 2

for its Kannadiga vote bank, Indian central govt (Congress or BJP) will not implement the SC directive instructing Karnataka to release water to Tamilnadu. Neither will India prosecute Sri Lanka for Killing Tamilandu fishermen nor bother to save them during the Ochi cyclone

Point no 3

Hindián /Brahmanist/RSS/BJP/Hindutva/Anti Tamil forces used PETA, AWBI, a statutory body under the Ministry of Environment and Forests and the SC to ban Jallikattu

“Jallikattu tradition is western culture and BJP is against it. The Supreme Court’s decision to ban it is a welcome step,”
said Ms. Maneka.

MUMBAI: On behalf of People for the Ethical Treatment of Animals (PETA) India, veteran actor Hema Malini has sent a letter to minister of environment and forests, Jairam Ramesh, urging him to take immediate steps to end the cruel tradition of jallikattu. The letter comes just days before the Supreme Court hearing regarding PETA India's petition calling for the Tamil Nadu Regulation of Jallikattu Act No 27 of 2009, a state law that permits jallikattu, to be struck down.

SC to hear Animal Welfare Board’s petition challenging jallikattu order

Besides the AWBI through its counsel and senior advocate Aryama Sundaram, the other petitioners include the Federation of Indian Animal Protection Organisations (FIAPO) represented by senior advocate K.K. Venugopal, People for the Ethical Treatment of Animals (PETA) by senior advocate Anand Grover, Compassion Unlimited Plus Action (CUPA) by senior advocate Siddharth Luthra.

The battery of petitions include those seeking contempt of court proceedings against the government for issuing the notification in violation of the Supreme Court judgment. Individual petitioners include members of the AWBI like Sowmya Reddy, Radha Rajan and Gauri Maulekhi.

you are stretching your imagination too far, its only Tamilnadu that has fought against Hindi since 1930, hence put your imaginative eruption worry to rest. The constitution of India recognizes India as ‘Union of States’ and not as a singular entity. It has recognized the ‘diversity’ of Indian Union and therefore the concept of ‘one county one language’ is not applicable to India.

* We in India are proud of our democracy and diversity. For a society with diverse religions, cultures, languages, attires and cuisines, democracy is not just a political system but a way of living: PM Modi at the World Economic Forum.
Modi words are nothing but a political farce
