I have long pointed here on PDF out the adverse effects of the Objectives Resolution on Pakistan, and it would be heartening to to see the Supreme Court take steps to eliminate this shackle from the legal system. Finally. However, there is still a long process that will need to be followed to achieve this important goal.
I am somewhat with you on that.
The objectives resolution gives room for ignorant hypocrites like Fazl-ur-Rehman (Whose on father vehemently opposed the creation of Pakistan) to take credit for a lot of things....
But that's a debate for another thread.
The ruling also saw the court clear cut say that parliament is supreme and courts are under it putting an end to a tussle between parliament and courts for superiority over each other which was ignited by Iftikhar chaudhry....
But then again, this has set a precedent. Any amendment can now be challenged in court...
So in effect, those people who make laws will have the laws they make challenged.
For example, if the Assembly one fine day decides to removes some 150 articles of the constitution and replace them, and it has the majority to do it....and it does and also it gives protection to those new laws, then what will the SC do if it is challenged? Since the new laws do not give the court authority to challenge the new laws.
This is a hypothetical and far fetched scenario, but you get the point.
Kurd was not making a single sensible point in that show.
Agreed. He was just going on a million other issues (which I agree with in another context) but he wasn't making any sensible point regarding the issue at hand.
