Yes he should face trail.

However, since he has surrendered, he cannot be put to death. At this point, the government would want to encourage further defection in order to try and put down the movement as fast and as painlessly as they can. For that, they need to keep surrender available as a viable option. If the terrorists see that they face certain death if they surrender and they may just scrape by if they continue fighting, that will unnecessarily prolong the conflict.

In summary thus, he should be prosecuted to the full extent of the law but should not be executed. Surrender must be incentivized at this point.
