Court hearing begins today

LAHORE: A court is to begin proceedings today (Friday) at a hearing into double murder charges against Raymond Davis, a CIA contractor who shot dead two men in Lahore last month, lawyers said.

Washington is pushing hard for Pakistan to free Davis, arguing that he has diplomatic immunity and is backing his claim that he acted in self-defence when he shot the men in a busy city street nearly four weeks ago. Revelations that Davis was a CIA contractor have heaped pressure on the fragile government and further ramped up burning public mistrust of Washington.

The court where police filed double murder charges against Davis this month is to sit on Friday inside the Kot Lakhpat Jail, Lahore, where Davis is being held, ahead of the Lahore High Court hearing to determine the diplomatic immunity issue, set for March 14.

“The hearing will be held inside Kot Lakhpat Jail and notices have been served to all concerned,” public prosecutor Abdul Samad told AFP. “The immunity case before the LHC will not affect the proceedings of this court until the high court bars it from doing so,” Samad said.

“We have framed double-murder charges against him and the copies of the final report will be provided to all parties,” he added. Asad Manzoor Butt, the lawyer for the families of the men who were shot dead by Davis, said he had also received a notice telling him to appear in court.

“We hope to get the copy of formal charges tomorrow. It depends on the judge if he starts the hearing or adjourns it after giving of copies,” Butt said.

Police have said they recovered a Glock pistol, four loaded magazines, a GPS navigation system and a small telescope from Davis’ car, after the shooting on a busy street in Lahore on January 27. afp

LAHORE: US official Raymond Davis insisted in court Friday that he should be set free because he has diplomatic immunity, an attorney involved in the case said.

During Friday’s hearing, which was held in the Kot Lakhpat jail and closed to the public, prosecutors tried to present Davis, accused of killing two youths – Faizan and Faheem — at Qartaba Chowk on January 27, with a charge-sheet.

Reports said Davis refused to sign the charge-sheet. He refused to accept the documents and said he did not want to participate in the case because he has immunity from prosecution under international agreements covering diplomats, said Asad Manzoor Butt, a lawyer for Ibadur Rehman, a Pakistani bystander who was killed when struck by an American car rushing to assist Davis after the shootings.

The judge also asked whether Davis had engaged a defence attorney, Butt said.

Judge Mohammed Yousaf Ojla instructed authorities to determine whether the immunity claim was legitimate and set a hearing for March 3, Butt said.

The US Embassy declined to immediately comment. Prosecutors could not immediately be reached after the hearing.

US consul general in Lahore, Carmela Conroy, and other consulate officials met Davis in prison on Friday before the hearing began.

Carmela Conroy attended the trial.

“Complicated” case

The murder trial is the first of two legal cases involving Davis.

On March 14, a Lahore court will decide whether he enjoys diplomatic immunity, another contentious issue that Pakistan’s government has said must be decided legally.

“Davis case is not so simple as it is sometimes portrayed by some. It is a complex case involving issues in national and international law as well as grave sensitivities that cannot be wished away,” presidential spokesman Farhatullah Babar said.

“The court has not only taken cognisance of it but also declared that it will decide on the immunity issue. We respect the court and will wait for its verdict.”

The United States says it holds Pakistan responsible for Davis’ safety, and prison sources say his cell is an area isolated from other prisoners and under constant surveillance and heavy guard.

The detained US national and alleged CIA contractor, Raymond Davis was produced before the additional session judge Yousuf Aujla at Kot Lakhpat prison here on Friday.

The accused insisted, during the hearing, he enjoyed diplomatic immunity and refused to sign the Challan against him.

Raymond Davis, who fatally shot dead two Pakistani citizens in a broad daylight last month, requested the court to grant him diplomatic immunity.

The western media say the detained US national was a CIA contractor in Pakistan.

The court, later, adjourned the hearing till March 3.

Meanwhile, the White House, once again, said the accused national was a diplomat and the issue could not be compromised upon.

As the diplomatic tussle between the United States and Pakistan over US demands for the release of Raymond Davis continues, it is interesting to note that their are varying reports of what Davis had in his possession (photos here) at the time he was arrested after shooting dead two Pakistanis on the streets of Lahore on January 27. Varying reports mention a GPS tracker, a GPS navigation system or a phone tracker, along with a telescope and digital cameras said to have photos of “sensitive” locations. In a very interesting development, we learn from multiple sources that on Thursday Pakistan successfully test-fired its Hatf VII cruise missile, which it also calls “Babur”. When the Express Tribune first reported that Davis’ victims were from the intelligence community (which ISI has since denied and threatened the paper with legal action), the Washington Post followed up by mentioning that Davis was trailed and confronted because he had “crossed a red line“. Was gathering information on the impending test firing of the Babur missile that red line?

Pakistan has a history of developing missiles intended to be used with their nuclear weapons. This report (caution, it is old and dates from 1999 and quotes material from the Rumsfeld Commision) is interesting for where it states that M-11 missiles from China were seen:

The Rumsfeld Commission confirmed that complete M-11 missiles were sent to Pakistan from China. Pakistan has reportedly received more than 30 M-11s, which have been observed in boxes at Pakistan’s Sargodha Air Force Base west of Lahore. Intelligence officials believe Chinese M11s have probably been in Pakistan since November 1992, when China was “reconsidering” its stance on missile exports after the sale of U.S. F-16 aircraft to Taiwan. Since then, Pakistan has been constructing maintenance facilities, launchers and storage sheds for the missiles, all with Chinese help. China and Pakistan deny these reports.

Pakistan calls the M-11 the Hatf-III. The missile has a range of more than 300 km and a payload of 500 kg. It is a two-stage, solid-propelled missile capable of carrying nuclear warheads. The missile was reportedly test-fired in July 1997.

Of importance is the fact that the missiles were said to be at an air base west of Lahore. Now for the description of the sensitive photos Davis took:

“During the course of investigation, police retrieved photographs of some sensitive areas and defence installations from Davis’ camera,” a source told The Express Tribune requesting anonymity. “Photos of the strategic Balahisar Fort, the headquarters of the paramilitary Frontier Corps in Peshawar and of Pakistan Army’s bunkers on the Eastern border with India were found in the camera,” the source added.

So, just a few weeks after Davis may have provoked Pakistan intelligence into a confrontation with him, perhaps over sensitive photos he may have been observed taking in the Lahore area, Pakistan test-fires a missile capable of carrying a nuclear warhead:

Pakistan Thursday successfully tested a nuclear-capable cruise missile with a range of up to 600 km, a military official said.

The Hatf-VII missile, also called Babur after the 16th-century Muslim ruler who founded the Mughal Empire, was fired from an undisclosed location, said Major General Athar Abbas, a military spokesman.

This story goes on to mention that the nuclear-capable Hatf V, with a range of 1300 km was tested in December. And the story points out that most of Pakistan’s missiles “are deployed toward India”, which means that the Lahore area, on the Indian border, is a likely site.

It will be very interesting to see if the US comments on the test-firing.

Another terrorist attack and another war brought to you by the CIA

London, Feb 20(ANI): Double murder-accused US official Raymond Davis has been found in possession of top-secret CIA documents, which point to him or the feared American Task Force 373 (TF373) operating in the region, providing Al-Qaeda terrorists with “nuclear fissile material” and “biological agents,” according to a report.

Russia’s Foreign Intelligence Service (SVR) is warning that the situation on the sub-continent has turned “grave” as it appears that open warfare is about to break out between Pakistan and the United States, The European Union Times reports.

The SVR warned in its report that the apprehension of 36-year-old Davis, who shot dead two Pakistani men in Lahore last month, had fuelled this crisis.

According to the report, the combat skills exhibited by Davis, along with documentation taken from him after his arrest, prove that he is a member of US’ TF373 black operations unit currently operating in the Afghan War Theatre and Pakistan’s tribal areas, the paper said.

While the US insists that Davis is one of their diplomats, and the two men he killed were robbers, Pakistan says that the duo were ISI agents sent to follow him after it was discovered that he had been making contact with al Qaeda, after his cell phone was tracked to the Waziristan tribal area bordering Afghanistan, the paper said.

The most ominous point in this SVR report is “Pakistan’s ISI stating that top-secret CIA documents found in Davis’s possession point to his, and/or TF373, providing to al Qaeda terrorists “nuclear fissile material” and “biological agents”, which they claim are to be used against the United States itself in order to ignite an all-out war in order to re-establish the West’s hegemony over a Global economy that is warned is just months away from collapse,” the paper added. am a bit concerned about his safety, GoP need to ensure his health and safety and be very cautious, you never know US can do anything, they can finish him off inside the prison and blame the country, you never know with these people

PESHAWAR: An American (US) national Aaron Mark Dehaven was arrested from Peshawar for overstaying illegally in the country on Friday, DawnNews reported.

According to the sources the US national from West Virginia was arrested from University Town area, as his visa had expired on October 23, 2010, he had been taken to an undisclosed location.
