Polygamy is not a religious practice, government tells SC

You reasoning is scientific but based on assumption that where society has more well educated earning high income are finding it difficult to find partners. I asked for the link from where do you get this assumption or on what basis did you make this? Because polygamy in muslim world is age old practice where women never surpassed men in earnings and in education. hence want to know how is this point valid in current debate of polygamy in indian muslim society.

And that article is not related to Islam or Muslims, its a general article. However, I told you that Islam cares for humans and their problems and in times of Messenger Muhammad (Peace be upon him) the gender disparity existed because of the conflicts and wars, and hence Muslims were permitted up to 4 wives. Latter when the situation got under control, peace was restored and state was established to take care of its citizens the reason for multiple wives vanished. If you don't know already a lot has been associated with Islam and its history which never happened, latter people used that false history for their own benefits and satisfaction.

In current times if any country doesn't face a situation where the number of women exceeds men then it may stop polygamy but with proper research based facts about gender ratio. And if somehow gender disparity exists and women population is more than the men then polygamy is a logical solution.

You may have doubts I also do at times but something in me knows about God and it's him I call to automatically when I'm in need for help and in difficulty so yes I believe inshaAllah.

People got killed inside temples, mosques and churches, god doesn't save them. Even the most devout believer is not spared. Maybe it's god who decides who lives and how, but god didn't made us like any other animal, it gave us conscience. We may be robots, but it gave us sentience. And it's not blasphemy to question what god told us, its god who gave us the power to question.

On the topic, even if god itself "allowed" (not mandated) triple talaq (which I highly doubt) for whatever reasons, we are right to question its use (and abuse) in current scenario. And abolish it, unless god itself set it straight as to over-ride our will.

Triple Talaq - harms many Muslim women in India, and many scholars argue that it is not even true to the Quran. It should be banned.
Polygamy however should be allowed for Muslims. It's a very personal matter, a matter of faith- I don't see it encroaching on the rights of other Indians, or hurting other people's sentiments. So as long as the adults are consenting - they should be allowed be married under Muslim Law.

You know you are thinking exactly how Islam and Quran wants you to think. We are not robots we were given free will and choice without any interference, if there was any interference then any feral child found would automatically act human no matter where and in what environment that child grew up, but this is not the case. And Quran tells you over and over again God does not bring harm to humans but humans themselves.

But god doesn't stop us from doing so, why? Isn't this world (supposedly made by god) so warped? Why god made a deer food for a lion, for example? Why someone has to die, for someone else to survive? If we look around, of all the natural beauty, there is no grand design. No hand of god (else, it would be a terrible irony that god, the perfect and just being, made this world so brutal for some and so terribly biased for some. Unless, you believe in karma and moksha).

He was talking of only Hindu men indulging in rape in India and for you it was just an idea but when I say government of India should prevent Muslim men from visiting the mosques it was an extreme idea. Why was my idea extreme?

Firstly, My idea would give equal rights. Since Muslim Indian women are not allowed to go to mosques, government by banning Muslim men from going to mosques would ensure that gender equality is maintained.

This policy would also have an added benefit that by staying at home Muslim men can ensure and protect Muslim women by being raped by Hindu men.

Now this could also be achieved by allowing both Muslim men and women to go to mosques but as I understand it would be very complex as described below. Also, by going out on the street she runs the risk that she could be raped by a Hindu on the way. Hence I did not suggest the other way.


49898: Conditions of women going out to the mosque
Is it permissible for women to go and pray tahajjud in the mosque without a mahram when the mosque is next to the house and the men in the family do not do this prayer?.

It is permissible for women to go to the mosque and pray, subject to certain conditions. It is not one of these conditions that she should be accompanied by a mahram, so there is nothing wrong with her going to the mosque to pray without a mahram.

It says in Fataawa al-Lajnah al-Daa’imah, 7/332:

It is permissible for a Muslim woman to pray in the mosque and her husband does not have the right to stop her if she asks him for permission to do that, so long as she is properly covered and no part of her body is showing that it is forbidden for “strangers” (non mahrams) to see. It was narrated that Ibn ‘Umar said: I heard the Messenger of Allaah (peace and blessings of Allaah be upon him) say: “When your womenfolk ask you for permission to go to the mosque, give them permission.” According to another version, “Do not forbid women their share of the mosques if they ask you for permission.” Bilaal – a son of ‘Abd-Allaah ibn ‘Umar – said, “By Allaah, we will stop them.” ‘Abd-Allaah said to him, “I say ‘The Messenger of Allaah (peace and blessings of Allaah be upon him) said…’ and you say, ‘We will stop them’?!” Both reports were narrated by Muslim.

If the woman is uncovered and any part of her body is showing that it is forbidden for “strangers” (non mahrams) to see, or she is wearing perfume, then it is not permissible for her to go out of her house in this state, let alone go out to the mosque and pray there, because of the fitnah (temptation) involved. Allaah says (interpretation of the meaning):

“And tell the believing women to lower their gaze (from looking at forbidden things), and protect their private parts (from illegal sexual acts) and not to show off their adornment except only that which is apparent (like both eyes for necessity to see the way, or outer palms of hands or one eye or dress like veil, gloves, headcover, apron), and to draw their veils all over Juyoobihinna (i.e. their bodies, faces, necks and bosoms) and not to reveal their adornment except to their husbands…”

[al-Noor 24:31]

“O Prophet! Tell your wives and your daughters and the women of the believers to draw their cloaks (veils) all over their bodies (i.e. screen themselves completely except the eyes or one eye to see the way). That will be better, that they should be known (as free respectable women) so as not to be annoyed. And Allaah is Ever Oft-Forgiving, Most Merciful”

Zaynab al-Thaqafiyyah used to narrate that the Messenger of Allaah (peace and blessings of Allaah be upon him) said: “If any one of you (women) attends ‘Isha’ prayer, let her not put on perfume that night.” According to another report, “If any one of you (women) attends the mosque, let her not put on perfume that night.” Narrated by Muslim in his Saheeh.

It was proven in saheeh ahaadeeth that the women of the Sahaabah used to attend Fajr prayer in congregation, covering their faces, so that no one would recognize them. It was proven that ‘Amrah bint ‘Abd al-Rahmaan said: I heard ‘Aa’ishah, the wife of the Prophet (peace and blessings of Allaah be upon him), say: “If the Messenger of Allaah (peace and blessings of Allaah be upon him) had seen the way the women are behaving, he would have forbidden them to go to the mosque as the women of the Children of Israel were forbidden.” It was said to ‘Amrah: Were the women of the Children of Israel forbidden to go to the mosque? She said: Yes. Narrated by Muslim in his Saheeh.

These texts clearly indicate that if the Muslim woman adheres to proper Islamic etiquette in her dress and avoids adorning herself in ways that will provoke fitnah and affect those of weak faith, there is no reason why she should not pray in the mosque. If she appears in such a way that evil people and those in whose heart is a disease will be tempted by her, then she is not allowed to enter the mosque, rather she is not allowed to leave her home and attend the mosque.

Shaykh Ibn ‘Uthaymeen said in Majmoo’ al-Fataawa, 14/211:

There is nothing wrong with women attending taraaweeh prayers if there is no danger of fitnah, subject to the condition that they go out looking decent and not wearing adornments, make-up or perfume.

In his book Hiraasat al-Fadeelah (p. 86), Shaykh Bakr Abu Zayd listed the conditions for women to go out to the mosque. He said:

Women are allowed to go out to the mosque according to the following rulings:

1- That there is no risk of them tempting others or being tempted

2- That their attendance will not lead to anything that is forbidden according to sharee’ah

3- That they do not jostle with men in the street or in the mosque

4- That they should go out not wearing perfume

5- That they should go out wearing hijab, not making a wanton display of their adornment

6- A door should be set aside in the mosque just for women to enter and exit, as mentioned in the hadeeth narrated in Sunan Abi Dawood and elsewhere.

7- The women’s rows should be behind the men

8- The best rows for women are those at the back, unlike the case for men

9- If the imam makes any mistake in his prayer, men should say “Subhan Allaah!” and women should clap

10-The women should leave the mosque before the men, and the men should wait until the women have dispersed to their homes, as mentioned in the hadeeth of Umm Salamah (may Allaah be pleased with her) in Saheeh al-Bukhaari and elsewhere.

Triple talak is forbidden in Islam .full stop (the most hated thing before God is divorce )but as you know subcontinent has its own rules but it's haram ie forbidden

people die and people are born every day in every situation you see death in every situation you see birth in every situation

we need uniform law, this is BS justification for womens rights. bring in the much needed 1 child policy .

They say the number of messengers is around 124,000 ......... they were all given the books, the guidance, to make people respect each other, live together in unity and benefit from the resources of this land. The Creator sent instructions to make humans base their regulations on them, those instructions were sent according to the mental maturity of humans of that time till the Quran was sent. Now would it be just and lawful of God to descend to Earth and become party in our man made conflicts? God is just and lawful, HE doesn't meddle in the freedom HE gave us. If HE had wanted HE could interfere and snatch our freedom to act and think on our own ............ but then think where would it leave being accountable for our own actions? It wasn't God who made men kings and others slave, it wasn't God who made capitalist and communist societies ............. HE made mothers to give birth to free humans ......... whatever follows is what humans made of this world. Just think of it if the divine powers like making rains, changing weathers, shifting day to night and night to day .......... etc were in hands of humans what would we make of it. Just think nothing could stop us from abusing our own inventions.


Why god made a deer food for a lion, for example?

Didn't God give deer the legs, stamina and speed? The deer can run fast, it lacks strength compared to lion but it has greater stamina. A lion doesn't always gets to kill the deer, sometimes deer escapes the attack and survives.

Why did God make this Earth so full of resources? All this technology boom and development, automation would it be possible without the natural resources? If Earth didn't have all these resources would it still be possible for humans to take this huge development leap?


Why someone has to die, for someone else to survive?

To maintain the balance and equilibrium perhaps? Every other creation except humans follows built in instructions, as I said humans have been given the freedom ............... and you will see in almost all the cases human is responsible for extinction and destruction of species and resources. Thank God that HE hasn't given the same will and freedom like humans to any other species otherwise it would be "Planet of Apes" fighting and killing only.

The presence of gravity, the presence of mountains with roots, the scheme of everything moon, earth and sun revolving, the unlimited ever expanding universe, the snow, the rain, the seasons, the night, the day, the plants, the fruit, the water etc .................. these all happen to be NOT invented by humans.

Just imagine what would happen if someday gravity tries to be funny. And you say there is no grand design?

And what was the need to create a self-destructive species called humans in the first place? Why create an intelligent being when you are not interested in controlling it. Creating humans at best would be called an epic failure of god, isnt it? after all, even after sending 124000 messengers, quran and everything, god has not been able to control and contain us.

That is 1961 census. Polygamy for hindus was banned in 1956 but the pre 1956 marriages were legal. So obviously the numbers are not relevant today.

Also the statement by the govt is absolutely technically correct.

Just because something is "allowed" it does not become religious practice.

Namaz - religious practice

2nd Wedding - social practice

Pav bhaji - food habit

Slavery of pows - rules of war

All are allowed as per islam. Not all are religious practices. The first one can not be curbed (except in deeper than you know what country), but the rest are under the gambit of governance.

No we are not God's children ........ you may think so, but for me Quran clearly discusses this and the last chapter is very clear about this.

Humans are not mirror image of God that's another belief that has no place in Islam. Humans are control freaks and God is lawful and just, humans bring destruction upon themselves and their own kind, God on the other hand gave them brains to think, act, identify good from bad. God doesn't intervene in our affairs, HE gave us the guidance and clearly told us "read it understand it think about it, if you act upon it its for your own good, and if you turn away from it, its your loss".

And if deer survives, lion has to do without food. If lion has to eat and survive, deer has to die. Why so?

So a land full of lions and deer and humans and all others living and breathing should remain unchanged forever? Wouldn't that disturb the whole ecosystem? How long one would live till he gets tired and wishes that he could die? These things are governed by laws and the law in Quran is "Everything has to taste death" ......... the order on this Earth would prevail as long as one benefits the other.

Boring ................. struggle is the key ....... Quran stresses saying "A man gets what he struggles for", at another place it says "The state of people won't change unless they themselves struggle to change it". God is not a control freak. HE clearly told us you would be held accountable for your actions in this life. If you believe in life hereafter you would understand, and if you don't then this much I can assure God is not coming to this world to interfere in our affairs and problems ............. HE gave us intelligence, lent us guidance and made us capable of making decisions ............ so we should own our decisions and actions and not blame God for those.
