Lawyers bring Punjab govts move into question
The Pakistan Muslim League-Nawaz (PML-N) led Punjab government has raised many eyebrows in the legal community by giving additional charge of the advocate general Punjab (AGP) to Mustafa Ramday after appointing him additional advocate general.
The government has adopted an indirect procedure to fill the vacant post of the principal law officer of the province with a confidant who has yet to attain the required age (45 years) to be eligible for the constitutional post.
Ramday is the son of retired Supreme Court judge Khalilur Rehman Ramday.
Article 140 of the Constitution requires that a person qualified to be appointed judge of the high court can be the AGP. The minimum age limit for a high court judge is 45 years and Ramday is not even 40 yet.
Sources say former AGP Ashtar Ausaf was governments first choice for the vacant post, but those at the helm of affairs changed their mind a week before Ramdays appointment. The party leadership was unhappy with Ausaf because he resigned despite partys opposition after establishment of the caretaker government in the province.
Ramday has been appointed additional advocate general and given additional charge of the AGP till further orders. He formally took the charge on Monday and also held a meeting with law officers.
Advocate Rana Asadullah Khan, former secretary of the Lahore High Court Bar Association, says the Constitution does not allow giving additional charge of the AGP for an indefinite period to a person who does not have the qualification to be appointed to the post.
He says the AGP is legally entitled to attending cabinet meetings and assembly sessions, but the acting AGP does not have these privileges. He says the criteria set by Article 140 of the Constitution should be followed in appointment of the acting AGP.
A senior bar member says appointing an ineligible person as the acting AGP through an indirect procedure amounts to usurping the rights of eligible candidates and suggests the bar lacks qualified and competent lawyers.
In 2009, Justice Ramdays late nephew Raza Farooq was appointed acting AGP through the same procedure.
