PML-N resisting IHC order to restore DG Health
After bashing PPP for the last five years for not respecting and obeying superior judiciarys orders, the PML-N government itself is being blamed for not adhering to superior judiciarys orders.
The case is of director general health, a post where PML-N wants its own man while the Islamabad High Court has restored the previous DG.
Details reveal that the PML-N posted Dr Jahanzeb Aurakzai as DG Health a few days ago while there exist audit paras against his absorption in the service while being appointed against a project job. The former DG Abdus Saboor Qazi knocked the doors of the Islamabad High Court, and the court stopped the ministry from transferring Qazi from the post of DG Health.
The court pronounced the order on 18-07-2013 and since then, the high-ups of the Ministry of National Health Services, Regulations & Coordination, led by Saira Afzal Tarar, have not let Qazi work again. Qazi Abdus Saboor is a BS-21 officer and besides being DG health, he was also CEO Drug Regulatory Authority of Pakistan (DRAP).
On Wednesday, DG Health Qazi Abdus Saboor tried to convene a meeting, but all the employees of the ministry were stopped by high-ups from attending the said meeting.
Minister of State for Health Sciences Regulation and Coordination, Saira Afzal Tarar while talking to The News said that she doesnt know who is stopping Qazi Saboor from working and who is not performing his duties.
She said Mr Qazi went to his office of DG Health on Thursday and also convened a meeting as CEO DRAP the other day. She disconnected the phone saying: All I can say is that the ministry is going to file an appeal against the decision of the IHC.
Qazi, when contacted, said that Justice Shaukat Aziz Siddiqui of IHC suspended both transfer notifications dated 09-07-2013 and 16-07-2013 of him from the posts of DG health and CEO DRAP respectively and ordered that he (Dr Qazi Abdus Saboor) may continue working as DG Health and CEO (DRAP).
Justice Shaukat Aziz, in his order, recognized the fact that he (Dr Qazi Saboor) had been appointed for a tenure of three years and that his tenure should be respected, said the DG Health.
However, the high-ups of Ministry of National Health Services Regulations & Coordination, while defying orders of the court, have ordered all officers not to put up any official files to Dr Qazi Abdus Saboor and to stop all official correspondence with him. Instead all the files are being put up to Dr Jahanzaib Khan Aurakzai whose notification as DG health has already been suspended by the Islamabad High Court. Similarly, all official files, pertaining to the Drug Regulatory Authority, are being put up to Arshad Khan whose notification of additional charge of CEO (DRAP) dated 09-07-2013 was also suspended by Justice Shaukat Aziz Siddiqui.
Not only this but the office room of DG health has been dismantled and attacked and his name plate has been removed on instructions of the high-ups because he is not liked by the PML-N minister, the DG health Qazi Saboor told The News. The Secretary Ministry of National Health Services, Regulations & Coordination was tried to be contacted but was not available for comments.
While the officer appointed by the PML-N government as DG and whose notification has been suspended by the IHC has a tainted service record as he was irregularly absorbed in the service because he was well-connected with a few federal secretaries close to the PPP government. The audit has also caught Dr Jahanzeb Aurakzais this adventure.
The audit para says, Irregular Absorption IN B-19 and promotion to B-20: Dr Jahanzeb Khan Aurakzai, a temporary employee of National Trust for Disabled, Ministry of Social Welfare and Special Education was posted as- Director Admin B-19 in National Institute of Health for an initial period of three years vide Ministry of Health Notification No F.4-1/2009-E-II dated 06.06.2009. The officer was absorbed against the post of Director Administration B-19 in NIH vide Ministry of Health Notification No F.10-22/2009-E-II, dated 05.08.2009 arid, was promoted to the post of Joint Executive Director BPS-20 w.e.f 03.01.2011 vide Ministry of Health Notification No F.10-42/201Q-E-II dated 03.01.2011. Audit observed that a temporary employee was absorbed in NIH on regular basis without NOC from lending Ministry i.e Ministry of Social Welfare and Special Education.
Audit is of the view that absorption of the officer in NIH without holding appointment on regular post in Ministry of Social Welfare and Special Education and without having NOC from the lending Ministry for absorption in NIH and subsequent promotion to the rank of Joint Executive Director BPS-20 is irregular and unauthorized. Audit recommends that a detailed inquiry against absorption and promotion of the officer in NIH may be conducted, responsibility fixed and results communicated to audit.
