Judicial activism; Pakistani court asks government to sever diplomatic relations with the USA
Pakistan’s superior courts are enjoying the new-found powers conceded by the weak executive government. In yet another decision, the Peshawar High Court ruling American drone strikes in the country’s restive tribal regions as illegal and inhuman, has ordered the government to consider severing diplomatic relations with the US. It ordered the Foreign Ministry to move a resolution in the United Nations against the attacks. The court issued the verdict against the American strikes on four writ petitions.
Pakistani top judges are generally perceived to be soft on the terrorists and the issue of drones strikes threaten terrorists than civilians. The terrorists apprehended by the security forces are released by the courts in most of the cases. There is a general perception that the majority of lawyers support the terrorists and some of them are elevated as judges. So far, nearly 40,000 innocent civilians have been killed by terrorists but no court has taken cognizance to direct the government to launch any operation against the terrorists.
In his judgment, Chief Justice of the Peshawar High Court, Dost Muhammad Khan, ruled that the drone strikes are illegal, inhuman and violation of the UN charter on human rights and the Government of Pakistan must ensure that no drone strike takes place in the future. The court asked the Foreign Ministry to table a resolution in the UN against the American attacks and if the US vetoes the resolution, then the country should think breaking diplomatic ties with the United States. The court also observed that the American strikes must be declared as war crime as it kill innocent people.

We encourage our own army to conduct operations..and our army is capable to do so....
i don't get it..in case of india...hum sab log ghairat aur shujaat ka paiker bun jatay hain but against americans hum log beghairti ki alamat kyun bun jatay hai??
