First of all - if cornerstone of Nawaz Sharif - that Qatari letter was striked down then the whole case was finished.

There are too many contradictions in the entire judgement - at one point they say Qatari letter is absurd and ludicrous and we do not see it as evidence in defence and then say all institutions have failed and then in same breath says the same failed institutions ask the same questions in a way that "right" answers can be obtained.

Lets move forward and assume JIT unanimously says that Qatari letter is genuine and we have established its truthfulness and it fabricates bank accounts statements and create backdated and forged documents and term the same rightful and valid then what will happen? Onus on establishing the truth and validity has been shifted from SCP to JIT - no?

As you said they need help of FIA, NAB, SECP, and SBP and do you think when heads of all these were ridiculed and shamed by SC itself, would subordinates of the same disgraced chiefs would all of a sudden become angels and truthful and do true and honest investigations?

Seriously?!?

Judges contradicted themselves in the same judgement - they established something as black, and now seeking confirmation of those corrupt institutions by asking them and saying that please tell us what we said and termed as black is really black in color or not?

Supreme Court should send a show-cause notice to Dr. Shahid Masood and Haroon Rasheed and ask them to clarify their statements.

If the same bench of 5 respectable and honourable judges are cross examined on this entire detailed judgement they will not be able to defend the contradictions in operative order and detailed comments.

One Lawyer was saying on ARY News that these 5 judges will not be part new bench.

I Have read dissenting notes by Justice Khosa and Gulzar...amd court order, operative part of main judgment

ISLAMABAD: Implementation on the Supreme Court’s orders in Panama case has already been started and two names reportedly have been suggested for the head of Joint Investigation Team (JIT) which would probe the offshore properties of Prime Minister Nawaz Sharif and the money trail, ARY News reported.

According to sources, the names of Additional Directors of Federal Investigation Agency (FIA), Ahmed Latif and Wajid Zia, being suggested for the head of JIT. However, Interior Minister Chaudhry Nisar Ali Khan would make the final decision.

According to ARY News correspondent Zulqarnain Haider both officials belonged to the police group of the FIA. He reported that Wajid Zia being considered as strong candidate to head the JIT.

Wajid Zia has a considerable reputation and also hails from Rawalpindi. He has also been invited in key meetings chaired by the interior minister, sources said.

Ahmed Latif is currently serving as additional director crime circle of the FIA, while Wajid Zia has been additional director immigration.

It is worth mentioning here that Interior Minister Chaudhry Nisar would approve the final name after which the Director General (DG) FIA would submit the name of the official to the apex court.

Panama verdict: SC judge dubs media debate ‘ill-informed’

ISLAMABAD: Justice Azmat Saeed Sheikh has slammed the debate about the Panamagate issue in the media and public, terming it ‘ill-informed and misguided’; however the Supreme Court resisted the temptation to restrain such coverage and public comments.

Justice Sheikh, in his 40-page additional note, has observed that the Panama issue attracted more public interest and media attention than anyone expected.

“Some of such attention unfortunately is contaminated with factually incorrect opinions, legally fallacious concepts and predicted decisions, which are bounced around on the airwaves every evening. The temptation to restrain such media coverage and public comments is resisted,” he adds.

The justice observed: “Freedom of expression and press is a right enshrined in Article 19 of the Constitution of the Islamic Republic of Pakistan, 1973 and this court is bound to defend the same.”

“An open court is the essence of our legal system. Restraining comments on the court proceedings would perhaps negate the very concept of an open court. Being insulated from all criticism, it can do more harm to an institution than a little unfair criticism.”

He observed in instant cases, strong emotions were unleashed from both sides of the aisle “but this court cannot allow itself to succumb to populism and must remain steadfast to its oath”.

Justice Azmat further observed: “They [justices] cannot be tempted to pronounce a popular decision but must decide all cases in accordance with law without fear or favour, affection or ill-will.”

“Tragically, some of such legal fallacies of the often ill-informed and misguided public debate penetrated into the courtroom; hence, it has become imperative to address the same even at the risk of stating the obvious.”

how about their political affiliation with PML-N, will any of them selected be remain neutral through JIT?

Judges cannot do everything. They need assistance from relevant quarters. l don't like the JIT idea myself but that's the reality.

If they needed help from relevant quarters and further investgation..they should have atleast suspended or taken all powers from heads of these instituitions..just like Justce Khosa and Gulzar have taken powers form chairman NAB, while also they have disqualified the PM......majority judges should have atleast suspended the PM, if not disqualified him....and suspended Chairman NAB, for fair inqury..... Justice Qazi Faiz Isa and Amir Hani Muslim had also suspended many members of NAB, in other case in SC, recently.. It means tht SC has the power to do it... So, when they have the power, and they themselves say Qamar Zaman Chaudhry being chairman NAB is like legalising corruption.. Yet not removing or suspending him, neither taking any powers of him as Chairman, and asking members from his instituition to be part of JIT, nominated by the same Chairman.... Same goes for FBR... Seriously... Does thisj judgment make any sense?

Even Justice Khosa and Gulzar have given some explanation..as to why they are not sending case of Chairman NAB to supreme judicial council, themselves....because of jurisdiction issues, and since Justice Khosa is himself part of tht...so its a conflict..hence avoided sending him to supreme judicial council himself... I think majority judges didnt even bother to give any explanation as to ....why are they not sending NAB chairman to SJC?

However.. Justice Khosa, despite not sending Chairman NAB to SJC....then in the same judgment say...tht since chairman NAB is compromised....we take all relevant powers from him, as chairman NAB, in cases against PM, and ask the NAB to report directly to a bench of SC.....

Why couldnt the majority judges..do atleast..this much or suspend him as Chairman NAB, just like Justce Qazi faiz Isa and Justce Amir hani, did with members of NAB in another case?

I personally know an officer who is putting all his efforts to be appointed in this case and has approached Asfandyar to recommend his name to Nisar. I am steadfast in my opinion; it's all topi drama. Although I earnestly wish that some muaujza happens and truth prevails.

I read in Dunya news....tht SC, when it sent the copes of decision to all relevant instituitions...it gave instructions to them..tht give us a list of 3 names...and then SC (the same panama bench) will finalise the names of ppl in JIT.....

Its still better.. But..since.. the list will also be given by the same instituitions.... I have very little, if any, hope at all...

I was referring towards the majority Judges, sab se pehlay or sab se ziada mirchen Pakoray ko lagi hain

Waqayi pakora judge ne sab se ziada petitioners ke againt remarks diye hain...shayad.. Itnay t advocate ne bhi nahi diye, shayad.... At inki judgment par beth karakoray khaanay chahyein.. Yehi deserve karti woh senseless judgment

Have heard tht Justice Ijazul Ahsan's comments are very similar to the dissenting judges,....he just disagreed with the final conclusion

Question: In 69 years of Pakistan's existence, can anyone give one example of credible and meritorious SCP decision involving ashrafiya and implicating them in crime and specially in Sharif's case?

As most believe future result can be predicted on past performances; but irony is that our institutions' past performances are so low that our expectations cannot reach that low level and hence we expect better than last jolt - but fact of the matter is; we always get disappointed but still want to keep hope alive - which is fine, but unfortunately it doesn't change the hard facts!
