Pakistan court says marriage with underage Christian girl valid as she’s had her 1st menstrual cycle

The parents of a 14-year-old Pakistani Christian girl, who was abducted, forcibly converted to Islam and married off to her abductor, will approach the Supreme Court after a lower court ruled that marriage with an underage girl is valid as per the Sharia law if she has had her first menstrual cycle.

Huma was 14 when she was abducted in October last year and forced to marry her abductor Abdul Jabbar after being converted to Islam, according to her parents Younis and Nagheena Masih.

Their counsel Tabassum Yousuf on Friday said they would seek justice from the Supreme Court after the Sindh High Court, as per the Sharia law, said earlier this week that even if the girl, Huma, was found to be underage, the marriage between her and her alleged abductor, Jabbar, would be valid as she has already had her first menstrual cycle.

After they approached the Sindh High Court to see their daughter, the court, in a hearing on February 3, ordered the police to oversee the tests to confirm her age.

However, Judges Muhammad Iqbal Kalhoro and Irshad Ali observed that under the Sharia law, the marriage would be valid even if Huma was underage.

Tabbasum said that the ruling was not in accordance with the Sindh Child Marriage Restraint Act passed in 2014 which outlawed marriages of girls under 18 years, in a bid to stop forced marriages of minors in the province, primarily of Hindu and Christian community.

"The girl's parents were convinced that the police investigating officer was supporting Abdul Jabbar and his family. They also fear that the test results of Huma's age could be falsified and she might be sent with her husband," the lawyer said.

The parents had requested to keep Huma at a women''s shelter away from her alleged husband until her age was determined.

Tabassum said the parents produced documents including church, school documents confirming Huma''s age to be 14.

On the website of the Independent Catholic News, the girl's mother has appealed to the international community to support them.

The latest case has emerged amidst an increasing number of forcible conversions of girls belonging to the minority communities in Muslim-majority Pakistan.

In the last one month, at least two cases of forced conversion and marriage of Hindu girls after abduction have emerged in the province.

A Pakistani high court has ruled that any underage girl with an active menstrual cycle is ready for marriage as long as she had seen her first period; this is in accordance to the sharia law.

The Sindh High Court in Karachi passed down the ruling on February 3, 2020, during the hearing on alleged abduction, forced conversion and marriage of Huma Younus, a 14-year-old Catholic girl taken from her home on 10th October 2019.

14-year-old Huma was abducted and forced to marry her abductor, Abdul Jabbar, after being converted to Islam, according to her parents Younis and Nagheena Masih.

Her parents believe her marriage is invalid in line with the “Sindh Child Marriage Restraint Act” which forbids marriage under the age of 18.

Huma’s parents produced evidence – including a baptismal certificate and testimony from her school – purporting to show she is 14 years old, born on 22nd May 2005.




During the hearing on Monday, the judges, Muhammad Iqbal Kalhoro and Irshad Ali Shah, ruled that even if Huma was a minor, the marriage between her and her alleged abductor, Abdul Jabbar, would be valid as she had already had her first menstrual cycle.

Judges Muhammad Iqbal Kalhoro and Irshad Ali pronounced their judgment under the Sharia law.

After the judgement, Huma’s mother, Nagheena Younus, told Aid to the Church in Need (ACN) that Christians are not treated as equal citizens in Pakistan. She said:

“Once again, justice has been defeated and, once again, our state has shown itself unable to treat Christians as Pakistani citizens.”

The girl’s mother has appealed to the international community to support them.

On Topic, I think the legal age for Marriage should be 18, it was back in the days when people used to marry girls as young as 12-16 because they had their periods and ready to have kids, but mentally a girl needs time to grow and understand the true meaning of marriage .

I have given my apartment for rent to a hindu doctor in karachi and he is a great person. Apart from that it's true we need to do more for our minorities safeguard and rights as its told to us in Islam and Pakistan constitution.

Doesn't sound like eloping. At the very least, this is a case of exploitation of a vulnerable individual, on account of her age AND her minority status.

I'm not saying with certainty that she didn't have feelings of "love" towards the guy but it's still broadly classed as taking advantage of someone vulnerable in this context.

I do not have an issue with the news, they are Pakistani and enjoy equal rights as other Pakistanis, I believe they do not need any validation from me, as rights and equality in Pakistan are without question.

My issue is with the overblowing of some social issues. Life and property is the most essential part of safety in society, then other things follow. Just by that measure. it is extremely rare in Pakistan, but a massive daily occurrence in other countries, especially India.

Only a few days ago 42 Christian men were acquitted by the court for lynching 2 Muslim men, who were burnt alive by the mob. There was no retaliation, people did not go about making accusations after the acquittals. In India, their houses would have been burnt or they would have been lynched alive.

My reference point wasn't PDF, I was referring to Pakistani society on the ground. Out of 226 million people few may have different views, I am not aware of them.
We are concerned with the majority. And, with regards to Pakistan, the vast majority did nothing, as I've mentioned. NO revenge lynching no revenge burning of property or other measures.

This is plain wrong.

She eloped with the man she loved, there is absolutely no proof of any coercion. She was 14 years old, but in the US and other Western countries, she would be considered an emancipated minor and treated as an adult.

New laws need to be introduced for converts, esp women, to protect them from being forced to recant their faith. We are an Islamic state, we should be sympathetic, after all we originated the very same way.

When someone is not allowed to practice their religion in their home or if their parents disapprove of the man they want to marry, of course they will leave and try to find a better situation for themselves.

Pakistan is a 97% Muslim majority country, with Christians being 2% of the population, there is a very high probability that a Christian will fall in love with a member of the majority community.

I grew up with Christians in Faisalabad, and many of my best friends are Christians back home. We have absolutely no problems and help each other regularly. They have the same culture and modest social mores as Muslims.

Ahmadis don't have the same experiences as minorities in Pakistan. I dont know if Ahmadis are even considered minorities, dont you call yourselves Muslim? Even those against Ahmadis probably see them as a heretical sect if anything.

Many cases of kidnapping/rape/conversion in Pakistan, typically end up being cases where the girl entered into a consensual relationship and the family of the girl register a case of kidnapping/rape/conversion because they object to it. Thats not saying that legitimate cases don't exist, but imo maybe 60-80% of the cases just end up being exaggerated but of course international media never update their articles or report on any developements.

It is up to her, she has the most right to determine her future. Just like the Sikh girl from a few weeks back who ran away from abusive family to marry her beloved.

This concept of control over females is wrong and un-Islamic, which is present in all religious communities of Pakistan.

Once a woman reaches adulthood, which in Islam is puberty, she has every right to marry whomever she chooses, this means no forced marriages by parents or relatives.

A woman can emancipate herself if she feels her rights and views are not respected. She would be treated as independent, able to make her own decisions. She does not need a wali then.

Islamic fiqh rules are clear. Adults (emancipated ones too) have the right to marry whom they choose.

Our laws on this should become more clear so that in the future we don't have confusion.
