Ballistic means following a ballistic decent. So its a technical point and legally this may be fine.

However for all practical purposes it IS a ballistic missile and given the spirit behind the agreement, Pakistan should have been notified. Although this is not the first time, we have carried out some 15 tests before this one.

Best to reword the agreement.
