Do you folks realize what the Imran Khan has gained?
1. Now the onus of freeing the gongla is squarely on the courts, not the government. PM Imran Khan can simply say that he wanted to get the indemnity bond for the fines gongla owed but the courts decided to let him go without any monetary real assurance so the masses can question the courts, not me.
No, it wasn’t an admission of crime from a legal perspective. It was literally nothing note than a surety bond. It would have no impact on the legal case for establishing how much money was looted and/or should be recovered.
Thats a grey area. Locally it doesn't matter whether Nawaz admits to his wrongdoings or not..Court decides what he did and that should prevail..Nawaz Sharif hasnt pleaded guilty yet for the outside world to believe he was a victim of 'khalai makhlooq courts' and get support from the outside world to sponsor his daughter for next elections....
Govt. has all the right to use any tools at disposal to have its institutions police/IB/NAB/attorney XYZ retrieve the fined amount imposed by court and deposit that amount to treasury. They are fulfilling a court order as long as they dont bring BS like its a bond (will be returned once he is back). Govt. can also take over Jati umrah forcefully and sell it to recover the fine .. Its all about how far the govt. can push while keeping its fragile govt. in power...My take is PTI wont be able to save its govt. if it pushes too far and thats why they backed off. They will not challenge the interim order in SC and that will expose them in open that they are part of the game.If they do they will do it only for the sake of only getting their executive power(terms for exiting ECL) back which Lawhore High as f# Court challenged. The other theory i have in mind is Nawaz Sharifs life was under threat not from an illness but from his very own people as his death could have been used to make Maryam popular, something the agencies knew and warned IK about.
There are friendly countries that are ready to help and then their are countries like UK/USA that bargain things...
Pakistans govt. can work with foreign governments to extract looted money. Many countries have done this in past.
- The Philippines has recovered more than US$1 billion of money, mostly from Switzerland, stolen by Ferdinand Marcos.
- By 2007, Peru had recovered over US$174 million, from jurisdictions such as Switzerland, Cayman Islands and the United States, stolen by Vladimiro Montesinos.
- To date, US$700 million of money stolen by Sani Abacha, has been frozen and forfeited by Swiss authorities and has been returned to Nigeria.
- In 2006 and 2007, British and South African authorities helped Nigeria recover US$17.7 million of the illicit gains obtained by Diepreye Alamieyeseigha, governor of the oil-rich Bayelsa state.
These are just few of the many test cases.
Nawaz Sharif will go out and say he was kept in inhumane conditions and govt. tried to poison him etc. etc. This would save him in case PAkistan tries to extradite him in future..
Thats why he shouldnt have been allowed to go out in first place.
The only way left for us is to convince the downing street and legal system there that Pakistani jails and courts were more than lenient to him.
Legal systems around the world recognize that the justice system of any country can be abused for political purposes and that those accused of corruption may claim that their accusers are politically motivated. This is where Shehzad Akbar's advise to PM comes in to play.If he has given a wrong advise in regards to British system helping us reviewing the institutional, legal and policy context for asset recovery in Nawaz Sharifs case we are doomed..PM might have thought the British system might help him later (message delivered by prince) and that this is the time to save govt. avoid new elections , kick fazlu and focus on kashmir but time will tell what holds for him..
My last hoe is CJ ..he should take a Suo-moto here.If he cannot then whats the need of these british wigs
