Muslim men fined over $100,000 for illegal Northwest Sydney development

Two men have been fined more than $100,000 after they illegally cleared and developed a piece of land in Sydney's North West for a religious site.

Mustapha Kara-Ali and Diaa Kara-Ali could be heard laughing after they were told they had escaped jail time on the contempt of court charges in the Land and Environment Court.

The men, who were part of a Muslim group they've called Diwan Al Dawla, were charged late last year for what a judge called a "flagrant" breach of the court orders.

They claimed to have a "religious issue with the court" and refused to attend, which led to their arrest in November.

They eventually pleaded guilty to disobeying the orders that they stop building structures on the land and demolish buildings, fences and flagpoles already put up on the Colo site.

Diaa Kara-Ali later told a corrections officer he now accepted they should have followed the rules.

"They need to be followed otherwise courts will lose their power."

The court heard the men had also since taken steps to adhere to some of the orders.

But both heckled neighbours and a council worker in court before today's sentence and said "it's ridiculous isn't it, all a joke".

One of the men also ranted and claimed "religious persecution" as he left court with his brother.

Two brothers linked to a fringe Islamic group in Sydney have been convicted of contempt of court and fined more than $100,000 after claiming they were "exempt" from Australian law.

The NSW Land and Environment Court heard Mustapha Kara-Ali and his brother Diaa Kara-Ali had a "religious issue with the court" and had ignored court orders to cease construction at a site in Colo in north-west Sydney, for which they did not have development consent.

In a judgment on Thursday, Justice Terence Sheahan said the failure to comply with the orders, which also included requirements to demolish various structures such as flagpoles, had caused "further environmental harm". The brothers were fined more than $40,000 collectively while the company was fined $20,250.


Justice Sheahan said all three had engaged in a "flagrant breach" of court orders.

He said the Australian National Imams Council (ANIC), with the assistance of the NSW Judicial Commission, had made clear in an explanatory note that "Muslims in Australia will often be expected to participate in Court processes".

The note "even stresses that there are many similarities between the Western tradition and the Muslim concept of justice", he said, and it made clear that Muslims in Australia must comply with local laws as "this is a position mandated by the Holy Quran".

Mustapha Kara-Ali told the court the explanatory note "belongs in the trash bin" and "I do not subscribe to that council and they are not worthy of being called, 'Imams.'"

"They are hypocrites that have succumbed to another religion and they do not represent the religion that the youth want," he said.


Justice Sheahan noted that the men "clearly relied upon some elements of Australian law" and availed themselves of certain safeguards in the law while denying "any obligation to obey other equally valid laws dealing with planning and development".

Mr Rauf, spokesman for ANIC, said the explanatory note was "an important document which looks to provide assistance to members of the community as well as judicial and tribunal members relating to the legal processes".

"The council views it as important to provide such guidance and assistance to help towards ensuring a harmonious society and a positive engagement between the broader community and our legal institutions," he said.

In an episode of border security I remember a Jewish man bringing all these illegal stuff which you cant due to quarantine laws.
