More interesting is the case of PTI defending Musharraf. Declared themselves as party of establishment and puppets. Musharraf verdict is open and shut case as per article 6.

Its strange that elected democratic government which is entrusted to uphold supremacy of constitution is going to save a dictator who abrogated the constitution..

This is not the question, he imposed martial law. Court should initiate the hearing from 1999 not from 2007. If they start the hearing from 99 , then all present judges , Iftikhar kana will be in jail . But Nawaz and Iftikhar played all there cards...
Hearing from 2007 gave clean chit to all corrupt mafia and judicial mafia.

How does the Supreme Court of Pakistan conduct rulings on an issue (the coup by General Musharraf) that was itself validated by the Supreme Court of Pakistan? That's the Pandora's box here. Legally speaking, if the Supreme Court of Pakistan validated the actions of Musharraf in 1999, then Musharraf cannot be faulted.

Think about it - person X does something. The issue goes to the highest court, the court determines that the actions by person X are constitutional and allows person X to continue. How does the Supreme Court challenge a ruling by the same Supreme Court?

That's why the focus was on the emergency/suspension of constitution in 2007, but even here the legal argument in favor of treason fails for multiple reasons. It will be a travesty of the law if this decision, on appeal, is not overturned by the Supreme Court.

Musharraf is Traitor w.r.t constitution of 73 when it was written in 73 by the full backing of the Army. Army took oath on it as well.

Kindly go through media programs where they clearly said what changes were made in 18th amendment in article 6 which were not at time of 1999 or 2007 on which case was made.

He is not alone there are thousands or more who should be hanged too, he is biasedly targeted which is not justice.

In my view the solution to this is for the Supreme Court, if/when it hears an appeal, to dismiss the special court's decision and perhaps lay out clear guidelines against the imposition of martial law going forward as well as clarifications/guidelines on the parameters governing the imposition of emergency/suspension of constitution.

That should satisfy both sides.

Who’s we? Are you a member of the armed forces? Nevermind that, even if you were, this isn’t directed towards you.

Musharraf foolishly undertook Kargil misadventure which ended with the deaths of our NLI, if we’re talking about fighting and dying, it’s they who were martyred. Musharraf’s incompetence led to their deaths and he then faced the possibility of court martial.

He suspended the constitution and assembly, removed judges and jailed dissenters and the serving PM. He broke his own oath as a member of the armed forces. An oath which starts with a promise to uphold the constitution, he then made judges renounce their oaths to the constitution and serve him under PCO, no need to even talk about his political record during his illegitimate tenure. Removal of judges in 07 and enforcement of PCO was again illegal and unconstitutional too.

Anytime he is challenged on either his illegal and unconstitutional political schemes, or Kargil...

He drapes himself in the flag rather than owning up. So yes, he is the type described here:
