Musharaf should come to Pakistan, cannot emphasize more. Apart from criminal cases against him, something else is waiting.

That is incorrect. The part you are talking about is article 248(2) which pertains with actions taken by the person himself before getting
elected, or any actions taken by the person which is not concerned with duties of the government while in office. Actions taken in the power of office are deemed unprosecutable regardless of whether the person is in the office or not.

Now Sparklingway has brought to light common law precedents that may be used to override blanket immunity. I am personally not aware of the legal details here. But I have an argument against it. Back in '96, BBs govt was dismissed by Leghari for extra judicial killings. Nothing came of it in terms of prosecution. And in that case there was no openly declared rebellion. The involved agitators were fighting amongst themselves and state authorities but not on the pretext of armed rebellion. If BB didn't get prosecuted for any shady murders, I don't think there is any chance for a successful prosecution on behalf of someone who had openly declared rebellion against the state. Otherwise, it will make a mockery of state authority when it has been openly challenged.

Unless it can be shown that Musharraf himself gave explicit orders to get Bugti killed without any chance of surrender, there isn't much that will pull here.

I am pretty clear on this. And, i ve checked with several legal experts.
I'll point to one thing to back my assertion. The case against Musharraf would not have been taken up by the court if Musharraf could not be prosecuted. You may claim that the courts are biased against Musharraf, but in such a case, atleast Musharraf's lawyers would have brought it up. Neither they, nor Musharraf has claimed so. Because they know he has no legal cover anymore.

If BB didn't get prosecuted for any shady murders, I don't think there is any chance for a successful prosecution on behalf of someone who had openly declared rebellion against the state.

I am not debating the nature of the case or the reasons behind Akbar Bugti's muder. My only assertion was that Musharraf has to face this case.

What I was arguing was that the spirit of article 248(1) is to prevent any tom dick and harry from creating frivolous legal hurdles in the functioning of the government. Now this case can go on for a very long time, but defense argument will be strong. The ZAB case was pertaining to the killing of Kasuri's father when Kasuri was running for election - a totally harmless action. Now here we have a guy who - regardless of his grievances - is involved in racketeering arms, maintaining private militias, attacking government installations, even launching rocket attacks on the president's chopper. The defense can very easily show this to be within the domain of state authority and any actions taken forthwith to be appropriate to deal with such matters.

Agreed. And i am not challenging it. But if the article was to give life-time immunity to the holder for any actions committed during his tenure in that public office, then you can well imagine what would happen.

Good Programme Guys, On Mr. Musharraf's Return. I'm Pleased to see the Decent Lady Ms. Atiqa Odho on the right side of the Aurgument. I'd appreciate you two aswell for being objective on the Issue and you have put forwarded your aurguments rightly too. The difference between us and the people who oppose him is, that they keep on repeating some of the alledged flaws commited by him and his government while us being rational put the aurgument foward that none is perfect in this world, he might have commited some mistakes and even blunders but still he's proven himself to be different from the Political Wizards of this country, who manage to do all wrongs without accepting any mistakes what so ever. 7. Worked for Pakistan's Independent Forign Policy (Defied Iraq, Iran War Involvement / Defied US Pressure on IPI / Defied US Attacks on Waziristan and so On)
8. Stood firm on Kashmir Issue in Agra Summit and tried hard to bring India to senses in his eight years period

Interview: In high spirits, Musharraf to bank on ‘electables’

General (retd) Pervez Musharraf

DUBAI: Being out of power seems to have done General (retd) Pervez Musharraf a world of good. He appeared slimmer, happier and relaxed in a meeting on Monday at his party’s office which is located in a quiet apartment in the otherwise prestigious downtown Dubai area, not too far away from the world’s tallest building – the Burj Khalifa.

Musharraf is visiting Dubai so that party faithful as well as those interested in joining can fly down from Pakistan and meet with him. Musharraf himself has promised that not only will he return to fight in the country’s next elections, but he himself will stand from a number of seats from all over Pakistan. “I am waiting for the right time to make my comeback,” says the former military general and president, adding “my return will create the right momentum for the party.”

He decries the vendetta politics in Pakistan but says that he is not worried about cases being lodged against him. He also says that he takes the threat of militant groups in stride. “In this, I expect the government to provide me security.” The former President dismissed talk of his party not having enough political heavyweights.

“I am looking at second tier politicians – tehsil nazims and union council nazims – who will come on board and win elections for the party.” He added “these are good people. I call them the electables.”

Looking back, Musharraf said that his government – which was doing well in all areas, was brought down by the judicial crisis and the deteriorating law and order situation. The situation in Pakistan deteriorated to the extent that the Indian prime minister continued to postpone his visit. “Had the Indian PM come to Pakistan, we would have signed an agreement based on the four point formula I proposed.” He said that while he had no problem with the current government trashing his initiative, no counter has been put forward in lieu of his proposals.

On the issue of elections, Musharraf said he had already been offered a seat from Chitral. “I am a national politician,” he clarified, adding “I do not want to stand from Karachi only.”

Looking back at his rule, the former president said he regretted introducing the National Reconciliation Ordinance and sending the reference against the chief justice because of the repercussions it caused. These decisions made him unpopular with a number of people. “These were my two mistakes if you can call them that,” he said, adding “but I did nothing illegal.”

On the controversy that has arisen over Wikileaks, Musharraf said that he is not mentioned in any cable as sharing information with the US Ambassador. “It is sad that some people discussed national security matters with the US envoy. I can only condemn it.” But he did not comment on the contents of the cables and said those who were mentioned should reply for themselves. At the same time, he said, some of the statements and assumptions of the US envoy were ridiculous.

Musharraf said he missed friends in Pakistan and socialising with people. Playing bridge, tennis and golf as well as meeting friends and family is what he says he misses most. The former army chief also said he missed his prizewinning dogs “Che” and “Lara,” two German shepherds. Talking about his house, he said that he had not made a single penny illegally “and I challenge people to prove otherwise.” As president, he said, “I paid for the entertainment of my guests through my own pocket.”

On a more somber note, Musharraf warned against the rising intolerance and extremism in present day Pakistan. “Today Barelvi is fighting Deobandi. They are tearing each other apart.” He said that things have gone from bad to worse but the government was ignoring the situation.

He recalled how one day the DG ISI came out of Sultan Masjid in Karachi’s DHA and caught a young boy distributing hate literature while the police looked the other way. “The police need to be trained to look for extremism and its manifestations. This has not happened.”

That’s the Kind of Characters we need in our Politics. I Challenge the other ”Leaders” like Nawaz and Zardari to comeup with such courageous stand or leave the Politics.
